REGULATION UNDER THE CUSTOMS ACT 1901-1973 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulation under the Customs Act 1901-1973 and the Commerce (Trade Descriptions) Act 1905-1973.

Amendments of the Exports (Fresh Fruit) Regulations 

Third Schedule.

Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in sub-paragraph 1 (1) (in the second column) after the variety Scarlet the following words and figures:—

“ Spartan ...........................................................	SPR.	70	40
Starkrimson ....................................................	SKRIM.	95	75 ”;

(b) by omitting sub-paragraph 1 (2) (in the second column) and substituting the following sub-paragraphs:—

“ (2) Apples of the varieties Cleopatra, King Pippin, Scarlet and Tasman’s Pride shall not be exported to the United Kingdom or the Republic of Ireland.

“ (2a) Apples of the varieties Cox’s Orange Pippin, King Pippin and Legana shall not be exported to a destination in the Continent of Europe.

“ (2b) Apples of the variety Scarlet shall not be exported to the United Kingdom, the Republic of Ireland, Sweden, Finland, Norway or Denmark.”;

(c) by inserting after paragraph (3a) the following paragraphs:—

“ (3b) Apples packed in a Standard apple box or a tray pack shall not be exported to the United Kingdom, the Republic of Ireland or to a destination in the Continent of Europe other than Sweden, Finland, Norway or Denmark.

“ (3c) Apples packed in an Australian apple box shall not be exported to the United Kingdom, the Republic of Ireland or the Continent of Europe.”;

(d) by omitting sub-paragraphs 1 (4), 1 (5), 1 (5a), 1 (6) and 1 (7) (in the second column) and substituting the sub-paragraphs in the Schedule to these Regulations;

(e) by omitting from sub-paragraph 1 (8a) (in the second column) the word “, Starkrimson ”; and

(f) by omitting from sub-paragraph 6 (1b) (in the second column) the words “ Delicious or Red Delicious ” and substituting the words “ Delicious, Red Delicious or Starkrimson ”.

(4) Apples packed otherwise than in a Standard apple box, an Australian apple box, a cell pack carton, an Australian tray carton or a tray pack shall be of a size within the range of sizes applicable in relation to the variety and destination in accordance with the following table:—

(5a) Notwithstanding the provisions of the last preceding sub-paragraph, apples of the variety Granny Smith intended for export to the United States of America or Canada, when packed in a fibreboard carton that is equipped with trays, shall be packed to a count within the count range 150-80.

(6) Apples packed in an Australian apple box shall be packed to a count within the count range applicable in relation to the variety and destination of the apples in accordance with the following table:—
