Exports (Fresh Fruit) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901 and the Commerce (Trade Descriptions) Act 1905.

Interpretation

1. Regulation 4 of the Exports (Fresh Fruit) Regulations is amended by omitting from sub-regulation (1) the definition of “appointed place” arid substituting the following definition:

“ ‘appointed place’ means—

(a) a wharf, airport, depot, railway station or railway siding at which or from which fresh fruit intended for export is to be stored or transported;

(b) an aircraft, ship, railway wagon, road transport vehicle or container system unit used, or intended to be used, for the conveyance for export of fresh fruit; or

(c) a place appointed under regulation 16.”.

2. Regulation 8 of the Exports (Fresh Fruit) Regulations is amended by omitting from paragraph (1) (b) “, citrus fruit and pineapples” and substituting “and citrus fruit”.

3. Regulation 9 of the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from sub-regulation (1) “, citrus fruits or pineapples” and substituting “or citrus fruit”;

(b) by adding “and” at the end of paragraph (2) (d);

(c) by omitting paragraph (2) (e); and

(d) by omitting from sub-regulation (5) “,citrus fruits or pineapples” and substituting “or citrus fruit”.

Requirements as to trade description

4. Regulation 12 of the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting “and” from the end of paragraph (1) (b); and

(b) by adding at the end of sub-regulation (1) the following word and paragraph:

“; and (d) shall contain, notwithstanding the requirements of paragraph (c)—

(i) in the case of citrus fruit—the name of the owner, or the registration number, of the export establishment in which the fruit was packed; and

(ii) in the case of apples or pears—the identification number of the establishment in which the apples or pears were packed.”.

Second Schedule

5. The Second Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting from the table in sub-paragraph 3 (1)—

“Australian dump package........................ 450     220     360     Apples”

Third Schedule

6. (1) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting sub-paragraph 1 (1) (in the second column) and substituting the following sub-paragraphs:

“(1) Subject to these Regulations, apples shall not be exported unless—

(a) the apples are ‘Class I’ apples;

(b) the apples belong to a variety specified in column 1 of the following table; and

(c) each apple has the minimum percentage of colour, characteristic of the variety, specified in column 3 opposite that variety:

“(1aa) In these Regulations, a reference to a variety of apples specified in column 1 of the table in sub-paragraph (1) shall be taken to be a reference to the name of a variety of apples having an abbreviation specified in column 2 of that table opposite that variety.”.

(2) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting sub-paragraphs 1 (3b), (3c), (4), (4a), (5), (5a), (6), (7), (7a) and (8) (in the second column) and substituting the following sub-paragraphs:

“(4) An apple belonging to a variety specified in the following table shall not be packed for export in a package other than a Standard package, a Standard tray pack, an Australian tray pack or a cell pack unless its diameter is within the size range specified in millimetres opposite that variety:

(3) Item 8 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting sub-paragraphs 1 (1) and (2) (in the second column) and substituting the following sub-paragraphs:

“(1) Subject to these Regulations, the exportation of pears belonging to a variety other than a variety specified in the following table is prohibited:

“(2) In these Regulations, a reference to a variety of pears specified in the table in sub-paragraph (1) shall be taken to be a reference to the name of a variety of pears having an abbreviation specified opposite that variety.”;

(b) by omitting from sub-paragraph 1 (3) (in the second column) “tables contained in the last two preceding sub-paragraphs” and substituting “table contained in sub-paragraph (1)”; and

(c) by omitting paragraph 2 (in the second column) and substituting the following paragraph:

“2. (1) Pears that are wrapped individually in paper shall each be completely enclosed in the wrapping paper.

“(2) Wrapping paper used for the purposes of sub-paragraph (1) shall be of a size and quality approved by the Secretary.”.

Further amendments of the Third Schedule

7. The Third Schedule to the Exports (Fresh Fruit) Regulations is amended as set out in the Schedule.

Fourth Schedule

8. The Fourth Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from Form 1 “pineapples”;

(b) by omitting from the heading to Form 2—

“CERTIFICATE OF REGISTRATION OF EXPORT ESTABLISHMENT”

and substituting—

“CERTIFICATE OF REGISTRATION OF EXPORT ESTABLISHMENT

(c) by omitting from Form 2 “pineapples”.

“(b) in letters at least 12 millimetres high—

(i) the name of the grower or the packer; or

(ii) the registered brand of the grower or the packer.”.

Item 10—

Omit paragraph 2, substitute—

“2. Plums shall not be exported unless they are—

(a) in the case or plums of a variety other than Narrabeen—not less than 40 millimetres in diameter; and

(b) in the case of plums of the variety Narrabeen—not less than 50 millimetres in diameter.”.
