Exports (Fresh Fruit) Regulations (Amendment) (Cth)
REGULATIONS UNDER THE CUSTOMS ACT 1901-1950 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1950.*
WHEREAS by section 112
of the
(
a ) the exportation of which would, in his opinion, be harmful to the Commonwealth ; or(
b ) which have not been prepared or manufactured for export under the prescribed conditions as to purity, soundness or freedom from disease, or which do not conform to the prescribed conditions as to purity, soundness or freedom from disease :
And whereas it is provided by the said section that the said power of prohibition shall extend to authorize the prohibition of the exportation of the goods generally, or to any specified place, and either absolutely or so as to allow of the exportation of the goods subject to any condition or restriction :
And
whereas it is provided by section 17 of the
And whereas I am of opinion that the exportation of fresh fruit, except subject to the conditions and restrictions prescribed by the Exports (Fresh Fruit) Regulations, as amended by the following Regulations, would be harmful to the Commonwealth :
Now
therefore I, the Administrator of the Government of the Commonwealth of
Australia, acting with the advice of the Federal Executive Council, hereby make

by omitting paragraph (
“ (
d ) the exporter has received an export permit in accordance with these Regulations in respect of the fresh fruit, and the export permit is in force at the time when the fruit is exported.”.
“ (2.) If the Secretary is satisfied that the premises are constructed, equipped and operated in an efficient and hygienic manner and, in particular, that—
(
a ) they are so constructed as to be adequately lighted for the purposes of efficient inspection of the fruit and the operations of the packing shed ;(
b ) they are ventilated in a manner approved by an officer ;(
c ) their floors are constructed of concrete or other suitable material that permits of rapid and effective cleansing ;(
d ) they and their immediate surroundings are such as to minimize harborage for fungi or insects and contamination of the fruit by foreign substances during stacking, handling, loading, processing, grading and packing ;(
e ) in the case of premises used for the receipt, processing, packing or storage of pineapples—they are situated in a locality where pineapples are grown commercially ; and(
f ) the plant and equipment are of types approved by an officer, the Secretary shall register the premises as an export establishment.”.
“ (1) If an officer has reasonable cause to think that, since the receipt by an exporter of an export permit, the condition, quality, grade or class of the fruit specified in the permit has changed, he may re-examine the fruit.
“ (1a.) Where an officer re-examines fruit in pursuance of the last preceding sub-regulation, and he is satisfied that, having regard to the condition, quality, grade or class of the fruit, the exportation of the fruit is prohibited by these Regulations, he may cancel the export permit and a certificate as to the condition of the fruit issued in respect of that fruit.”.
(
a ) by omitting from the table in paragraph 3 in the second column of item 1 the words and figures—

and inserting in their stead the words and figures—

(
b ) by adding at the end of that table the following words and figures :—
|

c ) by inserting in the second column of item 1, after paragraph 5, the following paragraph:—“ 5a. Boxes described as ‘ Australian apple box ’ in the table contained in paragraph 3 of this item shall be constructed in accordance with the following specifications :—
(
a ) Each end shall measure 8⅞ inches wide by 14¼ inches deep by ⅝ inch thick and shall be made of one piece, or of two pieces effectively joined.(
b ) Each side shall consist of two, three or four pieces, each piece being 19¼ inches long by ¼ to ⅜ inch thick and not less than 3¼ inches wide, the combined width of all pieces being not less than 13¼ inches.(
c ) The top shall consist of—(i) one piece being 19‚ to 19 5/16 inches long by 3/16 to ‚ inch thick by not less than 8¼ inches wide; or
(ii) two pieces, each piece being 19‚ to 19 5/16 inches long by 3/16 to ‚ inch thick by not less than 4 inches wide, the combined width of both pieces being not less than 8‚ inches.
(
d ) The bottom shall consist of—(i) one piece being 19‚ inches long by ‚ to 5/16 inch thick by not less than 8‚ inches wide; or
(ii) two pieces, each piece being 19‚ inches long by ‚ to 5/16 inch thick by not less than 4 inches wide, the combined width of both pieces being not less than 8‚ inches.
(
e ) The sides, top and bottom of a box shall not project over the ends.” ;(
d ) by inserting in the second column of item 1, after paragraph 8, the following paragraphs :—“ 8a. Boxes described as ‘Pineapple’ in the table contained in paragraph 3 of this item shall be constructed in accordance with the following specifications :—
(
a ) Each end shall measure 12 inches wide by 10 inches deep by ¾ inch thick and shall consist of two pieces, which shall be joined by two cleats each measuring 10 inches long by 2 inches wide by 5/16 inch thick placed parallel to the top and bottom of each end.(
b ) Each side shall consist of two pieces, each piece being 26‚ inches long by 5/16 inch thick, the combined width of both pieces being not less than 10 inches. An aperture ⅝ inch wide shall be allowed between the pieces.(
c ) The top and bottom shall each consist of two pieces, each piece being 26‚ inches long by 5/16 inch thick, the combined width of both pieces being not less than 11½ inches and not more than 12 inches.“ 8b. Boxes described as ‘ Tropical ’ in the table contained in paragraph 3 of this item shall be constructed in accordance with the following specifications :—
(
a ) Each end shall measure 12 inches wide by 12 inches deep by ¾ inch thick and shall consist of two pieces, which shall be joined by two cleats each measuring 12 inches long by two inches wide by 5/16 inch thick, placed parallel to the top and bottom of each end.(
b ) Each side shall consist of three pieces, each piece being 26‚ inches long by 5/16 inch thick, the combined width of the three pieces being not less than 11 inches. An aperture ¾ inch wide shall be allowed between the pieces.(
c ) The top and bottom shall each consist of two pieces, each piece being 26‚ inches long by 5/16 inch thick, the combined width of both pieces being not less than 11½ inches and not more than 12 inches.” ;(
e ) by inserting in the second column of item 1, after paragraph 10, the following paragraph :—“ 11. Where paper labels are used, they shall be applied with an adhesive which—
(
a ) is approved by the Secretary; and(
b ) contains an effective fungicide.” ;(
f ) by inserting in the second column of item 3, after paragraph 8, the following paragraph :—“ 9. The grapes in each box shall weigh not less than 29 pounds.” ;
7a. Peaches and nectarines | 1. The outer layers or shown surfaces of the peaches or nectarines shall be a true indication of the contents of each box. | 1. The trade description shall be placed on one end of each box, and, if printed on the box or applied by means of printed paper labels, shall be in letters at least ½ inch high, and, if stencilled on the box, in letters at least ¾ inch high. | |
2. Each box shall contain one variety of peach or nectarine only, and the peaches or nectarines in each box shall be of uniform size. | |||

4. Unless the Secretary permits otherwise, peaches or nectarines shall be packed in boxes of the types described as “ Australian half box ”, “ Standard half box ”, “ Long half box ” or “ Tray ” in the table contained in paragraph 3 of item 1 of this Schedule. |

5. At the bottom, sides and ends of each box, the peaches or nectarines shall be protected by packing materials of corrugated straw board, wood-wool or other suitable material and of a quality approved by the Secretary. One layer only of peaches or nectarines shall be packed in a tray. |

6. Peaches or nectarines for export in a vessel (other than a vessel used in navigation by air) shall be delivered to the vessel precooled to a flesh temperature not exceeding 40 degrees Fahrenheit and shall be shipped under refrigeration. |

3. For the purposes of the last preceding paragraph, the following abbreviations may be used in lieu of the name of the variety :— | |||

4. Each box shall be packed without a bulge and shall contain from 2½ to 3 pounds of wood-wool (or other suitable packing material) which shall be placed at the bottom, sides and ends of the box and between each fruit. |

5. During the months of November to March inclusive, the fruit shall contain at the time of shipment not less than 12 per centum of sugar, and yellow colour shall not exceed 25 per centum of the superficial area of the fruit. During the months of April to October inclusive, the fruit shall contain at the time of shipment not less than 10 per centum of sugar, and yellow colour shall not exceed 50 per centum of the superficial area of the fruit. |

j ) by inserting in paragraph 3 in the second column of item 9, after the word “ disease ”, the words “ and capable of normal ripening ” ;(
h ) by inserting in paragraph 4 in the second column of that item, after the words “ long half box ”, the words “ or Tray ” ;(
l ) by inserting in the second column of that item, after paragraph 5, the following paragraph :—“ 6. At the top, bottom and sides of each box or tray the plums shall be protected by packing material of corrugated straw-board, wood-wool or other suitable material, and of a quality approved by the Secretary.” ;

r ) by omitting from paragraph 5 in the second column of that item the words “ The ground colour ” and inserting in their stead the words “ Where tomatoes are to be shipped in non-refrigerated space, the ground colour ” ; and(
s ) by omitting paragraph 3 in the third column of that item and inserting in its stead the following paragraph :—“ 3. For the purposes of the last preceding paragraph, the size of the tomatoes shall be stated as follows :—
‘ 1¾ inches ’ where the tomatoes are 1¾ inches or more but less than 2 inches in diameter.
‘ 2 inches ’ where the tomatoes are 2 inches or more but less than 2‚ inches in diameter.
‘ 2‚ inches ’ where the tomatoes are 2‚ inches or more but less than 2½ inches in diameter.
‘ 2½ inches ’ where the tomatoes are 2½ inches or more but less than 2¾ inches in diameter.
‘ 2¾ inches ’ where the tomatoes are 2¾ inches or more but less than 3 inches in diameter.
‘ 3 inches ’ where the tomatoes are 3 inches or more but less than 3‚ inches in diameter.”.
