REGULATIONS UNDER THE CUSTOMS ACT 1901-1954 AND

THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1950.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1954 and the Commerce (Trade Descriptions) Act 1905-1950.

Amendments of the Exports (Fresh Fruit) Regulations. 

Interpretation.

1. Regulation 4 of the Exports (Fresh Fruit) Regulations is amended by omitting from the definition of "disease" in sub-regulation (1.) the words ", growth or decay" and inserting in their stead the words "or growth".

Requirements as to trade description.

2. Regulation 12 of the Exports (Fresh Fruit) Regulations is amended by inserting in paragraph (b),after the words "legible characters,", the words "the name and".

Inspection fees.

3. Regulation 32 of the Exports (Fresh Fruit) Regulations is amended by omitting from sub-regulation (1.) the words "Thirteen shilling's" and inserting in their stead the words "Fourteen shillings and sixpence".

Second Schedule.

4. The Second Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from paragraph (a) of item 5 the figures and words " inch thick" and inserting in their stead the figures and words " inch thick";

(b) by omitting from paragraph (a)of item 6 the figures "" and inserting in their stead the figures "";

(c) by omitting from paragraph (b)of item 6 the figures "" and inserting in their stead the figures "";

(d)by omitting from paragraph (d) of item 6 the figures "" and inserting in their stead the figures "";

(e) by omitting from paragraph (a)of item 7 the word "jointed," and inserting in its stead the word "joined,"; and

(f) by omitting paragraph (b) of item 7 and inserting in its stead the following paragraph:—

"(b) Each side shall consist of two, three, four or five boards each 27 inches long by inch thick by not less than 2 inches wide with a maximum spacing of ⅜ inch between any two boards. Dressed hardwood may be inch thick. Boards at the top of the box shall be flush with the ends and the centre partition.".

Third Schedule.

5. The Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting sub-paragraph (b) of paragraph 7 in the Second Column of item 6 and inserting in its stead the following sub-paragraph:—

"(b) the oranges are free from malformations and protruding navels and have not more than slight creasing, corrugation or ridging; and";

(b) by omitting sub-paragraph (a) of paragraph 9 in the Second Column of item 6 and inserting in its stead the following sub-paragraph:—

"(a) the skin of the oranges is not excessively coarse or thick; and ";

(c) by inserting, in sub-paragraph (b) of paragraph 5 in the Second Column of item 8, before the words "black spot", the word " dead ";

(d)by inserting in sub-paragraph (1.) of paragraph 7 in the Second Column of item 8 before the word "russeting", the words "smooth and not unsightly";

(e) by omitting from sub-paragraph (2.) of paragraph 7 in the Second Column of item 8 the words "Doyenne de Cornice" and inserting in their stead the words "Doyenne du Cornice";

(f) by inserting in sub-paragraph (2.) of paragraph 7 in the Second Column of item 8 before the word "russeting" the words" smooth and not unsightly";

(g)by inserting in paragraph 2 in the Second Column of item 10 after the word "disease"; the words "and capable of normal ripening";

(h)by omitting paragraph 3 in the Second Column of item 10 and inserting in its stead the following paragraph:—

"3. Plums shall be packed in the boxes described as the 'Australian half box', the 'Standard half box', the 'Long half box' or the 'Tray' specified in item 3 of the Second Schedule, or in such other containers as the Secretary permits."; and

(i)by omitting from paragraph 2 in the Third Column of item 10 the words—

"Golden Drop ........................................................... G. Drop" and inserting in their stead the words—

"Coe's Golden Drop .................................................. Coe's G. D.".

Fourth Schedule. Form 4.

6. The Fourth Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting from Form 4 the words " I hereby certify that— " and inserting in their stead the words " I hereby certify that, with the exception of— ".

Fourth Schedule. Form 7.

7. The Fourth Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting Form 7 and inserting in its stead the following form:—

CERTIFICATE AS TO CONDITION OF FRESH FRUIT.

This is to certify that the fresh fruit described hereunder has been examined and found, upon examination of packages selected at random, to be free from disease at the time of shipment and to be packed and graded in accordance with the provisions of the Exports (Fresh Fruit) Regulations.

* This paragraph is applicable to citrus fruits only.

*The fruit comprising this shipment was grown in  and it is certified that that State is free from citrus canker.  Vessel. Date of Shipment.
