REGULATIONS UNDER THE CUSTOMS ACT 1901-1975 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1973.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Customs Act 1901-1975 and the Commerce (Trade Descriptions) Act 1905-1973.

Amendments of the Exports (Fresh Fruit) Regulations 

Third Schedule—Item 1.

1. Item 1 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by inserting in sub-paragraph (2) of paragraph 4 in the second column, after clause (a), the following clause:—

“ (aa) in the case of an apple of the Spartan variety, not more than 15 per cent;”.

Third Schedule— Item 3.

2. Item 3 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting from paragraph 4 in the second column the words “ thirty-three per centum ” and substituting the figures and words “ 35 per cent ”.

Third Schedule— Item 4.

3. Item 4 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in paragraph 3 in the second column, after the word “ sound,” the word “ and ”; and

(b) by omitting from that paragraph the words “, and shall have been clipped from the tree”.

Third Schedule— Item 5.

4. Item 5 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting sub-paragraphs (1) and (2) of paragraph 4a in the second column and substituting the following sub-paragraphs:—

“ (1) The mandarins shall be in such condition that the juice has, at 20 degrees Celsius, a total soluble-solids to acid ratio of not less than 6 to 1 with a total soluble-solids content of not less than 8 per cent by weight.

(2) The determination of the total soluble-solids to acid ratio and the soluble-solids content of mandarin juice for the purposes of sub-paragraph (1) shall be made by methods approved by the Secretary.”.

Third Schedule— Item 6.

5. Item 6 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in sub-paragraph (1) of paragraph 5 in the second column, after the word “ has ”, the words “, at 20 degrees Celsius ”; and

(b) by omitting from clause (a) of that sub-paragraph the words “ at 20 degrees Centigrade ”.

Third Schedule-Item 8.

6. Item 8 of the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in paragraph 5 in the second column, after the words “ Packhams Triumph ” (wherever occurring) the words “ or Beurre Bosc ”;

(b) by inserting in sub-clause (iv) of clause (b) of sub-paragraph (1) of that paragraph, after the word “ blemishes ”, the words “, not including superficial hail marks,”;

(c) by inserting in sub-clause (v) of clause (b) of sub-paragraph (1) of that paragraph, after the word “ blemishes ”, the words “, including superficial hail marks,”;

(d) by omitting from paragraph 8 in the second column the word “ polythene ” (wherever occurring) and substituting the word “ polyethylene ”;

(e) by omitting from clause (c) of sub-paragraph (1) of paragraph 11 in the second column the word “ polythene ” and substituting the word “ polyethylene ”; and

(f) by omitting sub-paragraphs (2) and (3) of paragraph 12 in the second column and substituting the following paragraph:—

“ (2) Where pears are packed in a fibreboard carton, the fibreboard carton shall, when stored in a vessel (whether or not it is stored in a container system unit in that vessel), be stored in such a manner that at least one face of each carton is freely exposed to the cooling air.”.
