EXPORTS (FRESH FRUIT) REGULATIONS.

Statutory Rules 1963, No. 15.(a)

Definitions.

1. Regulation 4 of the Exports (Fresh Fruit) Regulations is amended by omitting the definition of “analyst”.

Register of brands.

2. Regulations 23, 24 and 25 of the Exports (Fresh Fruit) Regulations are repealed and the following regulations inserted in their stead:—

“23.—(1.) Subject to regulation 25 of these Regulations, the Secretary—

(a)may register a brand as a brand that may be included in the trade description of fresh fruit; and

(b)shall keep a register, to be known as the Register of Brands, of the brands so registered.

“(2.) A brand may be registered for a particular type of fresh fruit.

“(3.) The register of brands kept by the Secretary under these Regulations as in force immediately before the commencement of this regulation and any register incorporated with and forming part of that register shall be incorporated with and form part of the register kept under this regulation.

Application to be accompanied by copies of brand.

“24. An application for the registration of a brand shall be accompanied by seven copies of the brand.

Registration as trade mark necessary.

“25. A brand shall not be registered under these Regulations unless it is registered, or deemed to be registered, in the Register of Trade Marks kept under the Trade Marks Act 1955-1958, as a trade mark in respect of fresh fruit or of a particular kind of fresh fruit and unless the applicant is the registered proprietor or a registered user of the trade mark.”.

3. Regulations 29, 30 and 31 of the Exports (Fresh Fruit) Regulations are repealed and the following regulations inserted in their stead:—

Analysts.

“29.—(1.) The Minister may appoint to be analysts, for the purposes of these Regulations, persons who he is satisfied have the necessary qualifications.

“(2.) An officer of the Department of Customs and Excise for the time being occupying a prescribed office in that Department shall be deemed to have been appointed to be an analyst under the last preceding sub-regulation.

“(3.) The following offices are prescribed offices for the purpose of the last preceding sub-regulation:—

(a)Commonwealth Analyst;

(b)Supervising Analyst;

(c)Senior Analyst; and

(d) Analyst.

“(4.) An analyst may analyse samples of fresh fruit taken by an officer under the Commerce (Trade Descriptions) Act 1905-1950.

Certificates of analysis.

“30. In proceedings under the Customs Act 1901-1960, the Commerce (Trade Descriptions) Act 1905-1950 or these Regulations in relation to fresh fruit—

(a)a certificate by writing under the hand of an analyst setting out that he has examined or made an analysis of a sample

(a) Made under the Customs Act 1901-1960 and the Commerce (Trade Descriptions) Act 1905-1950 on 20th February, 1963; notified in the Commonwealth Gazette on 25th February, 1963.

 

of fresh fruit and stating the result of the examination or analysis is prima facie evidence of the matters stated in the certificate; and

(b)a document purporting to be such a certificate shall, unless the contrary is proved, be deemed to be such a certificate.

Fees for certificates of analysis.

“31. Where a certificate of analysis of fresh fruit has been given by an analyst stating the result of an examination or analysis of a sample of fresh fruit, the Secretary may furnish a copy of the certificate to the exporter if the exporter so requests and pays—

(a) in the case of an examination or analysis made at the request of the exporter—a fee of One pound one shilling; or

(b) in any other case—a fee of Three shillings.”.

Third Schedule—item 1.

4. The Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting paragraph 1 in the second column of item 1 and inserting in its stead the following paragraph:—

“1.—(1.) Subject to this paragraph, apples intended for export shall be of the varieties specified in the following table and each apple shall conform to the minimum percentage of colour characteristic of the variety for whichever grade is applicable in relation to the apple:—

“(2.) Apples of the varieties French Crab, Gravenstein, King Pippin, McIntosh Red, Nickajack and Stayman shall not be exported to the United Kingdom, the Republic of Ireland or a destination in the Continent of Europe.

“(3.) Apples of a variety other than a variety specified in sub-paragraph (1.) of this paragraph may be exported if the Secretary has, by instrument in writing under his hand, consented to the export of apples of that variety.

“(4.) Apples packed in containers other than the Standard apple box or the Australian apple box shall be of a size within the range of sizes applicable in relation to the variety and destination of the apples in accordance with the following table:—

“(7.) Apples of the varieties Crofton, Dougherty, Jonathan, Red Jonathan, Scarlet and Yates may be exported to the United Kingdom and the Republic of Ireland notwithstanding that the provisions of sub-paragraph (4.), (5.) or (6.) of this paragraph, as the case may be, have not been complied with in relation to the apples if:—

(a) they are of the grade Extra Fancy;

(b)in the case of apples packed in containers other than the Standard apple box or the Australian apple box—the diameter of each apple is no less than 2⅛ inches but is less than 2¼ inches; and

(c) in the case of apples packed in the Standard apple box or the Australian apple box—they are packed in such of the counts in the following table as are applicable in relation to those apples:—

(b)in the case of apples packed in the Standard apple box or the Australian apple box—they are packed in such of the counts in the following table as are applicable in relation to those apples:—

“(9.) For the purposes of this paragraph—

‘colour characteristic of the variety’ means—

(a)in the case of apples of the Alfriston, French Crab and Granny Smith varieties—the normal green, or green and flushed, colouration of apples of the particular variety;

(b)in the case of apples of the Red Jonathan variety—the normal full blush of that variety; and

(c) in the case of apples of any other variety—the normal pink or red colouration of apples of the particular variety;

‘count’, in relation to apples in a box or container, means the number of apples in the box or container;

‘count range’, in relation to a count of apples, means the range of numbers of apples within which the count is required to fall.”.

Third Schedule—item 8.

5. The Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a)by omitting from sub-paragraph (a) of paragraph 1 in the third column of item 8 the words “size and”; and

(b)by omitting paragraphs 2, 3 and 4 in the third column of item 8 and inserting in their stead the following paragraphs:—

“2. The name of the variety of pear, the details required by paragraph (c)of Regulation 12 of the Regulations and the number of pears contained in the box shall be set out in the trade description in that order.

“3. Notwithstanding the provisions of paragraphs 1 and 2 of this item, the trade description applied to bulk bins shall set out:—

(a) the size or size range of the pears packed in the container; and

(b)the gross weight and the tare of the container or the net weight.

“4. For the purposes of paragraph 3 of this item, the size of pears that is set out in the trade description shall be stated as follows:—

‘2⅛ inches’ where the fruit is two and one-eighth inches or more in diameter but is less than two and one-quarter inches;

‘2¼ inches’ where the fruit is two and one-quarter inches or more in diameter but is less than two and one-half inches;

‘2¼ inches’ where the fruit is two and one-half inches or more in diameter but is less than two and three-quarter inches;

‘2¾ inches’ where the fruit is two and three-quarter inches or more in diameter but is less than three inches;

‘3 inches’ where the fruit is three inches or more in diameter but is less than three and one-quarter inches;

‘3¼ inches’ where the fruit is three and one-quarter inches or more in diameter but is less than three and one-half inches;

‘3½ inches’ where the fruit is of three and one-half inches or greater diameter.”.
