REGULATIONS UNDER THE CUSTOMS ACT 1901-1966 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1966 and the Commerce (Trade Descriptions) Act 1905-1966.

Notwithstanding the provisions of the last preceding subparagraph in relation to apples exported to a destination in the Continent of Europe, the minimum sizes for varieties of apples packed in containers other than the Standard apple box, Australian apple box or cell pack carton, for export to Sweden, Finland and Norway, may be the same as the minimum sizes for those varieties of apples for export to the United Kingdom and the Republic of Ireland as specified in the table in the last preceding subparagraph.

“(4b.) The last preceding sub-regulation does not apply to the variety Cox’s Orange Pippin.”;

(g) by omitting the table in sub-paragraph (5.) of paragraph 1 (in the second column) and inserting in its stead the following table:—

(d) wooden boxes equipped with trays, of dimensions and construction approved by the Secretary and subject to such conditions as the Secretary determines.”;

(m) by omitting from sub-paragraph (1.) of paragraph 9A (in the second column) the words “varieties Worcester Pearmain and” and inserting in their stead the word “variety”;

(n) by omitting from sub-paragraph (1.) of paragraph 12 (in the second column) the words “box containing” and inserting in their stead the words “container, other than a bulk bin, containing”;

(o) by omitting from that sub-paragraph the word “box” (second and third occurring) and inserting in its stead the word “container”;

(p) by omitting from that sub-paragraph the words”, and the shipping mark only,”; and

(q) by adding at the end of paragraph 12 (in the second column) the following sub-paragraph:—

“(3.) Where a shipping mark is affixed or applied to the end of a container opposite to the end where the trade description is placed the name of the variety, or the abbreviation of the name of the variety, and the number of apples contained in the container, may be written on the end of the container where the shipping mark is affixed or applied but nothing else shall be written on that end of the container.”.

Third Schedule—Item 8.

2. Item 8 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by inserting in paragraph 6a (in the second column) before the words “in the case of”, the words “but subject to the next succeeding paragraph,”;

(b) by inserting after paragraph 6a (in the second column) the following paragraph:—

“6b. Where pears are exported to the United Kingdom, the Republic of Ireland or a destination in the Continent of Europe, they shall be packed within the count or size range applicable in relation to the type of container and the variety of the pears in accordance with the following table:—
