Amendments of the Exports (Fresh Fruit) Regulations
“9a.—(1.) A person who is the owner or occupier of premises which comprise or include a fumigation chamber may apply to the Secretary for registration of the chamber as a fumigation chamber for fruit.
“(2.) An application made in pursuance of the last preceding sub-regulation shall be in accordance with Form 1a and shall be accompanied by detailed specifications showing the type of construction of the chamber, its capacity, the plant and equipment used or to be used in connexion with the operation of the chamber and the manner in which and the means by which fumigation is or will be carried out in the chamber.
“(3.) Where—
(
a )the fumigation chamber is so designed and constructed as to be capable of fumigating in an efficient manner and by hygienic means;(
b )the fumigation chamber or the premises in which the chamber is included are in a clean condition; and(
c ) the premises and their immediate surroundings are such as to minimize the harbourage of fungi and insects and the possibility of contamination of the fruit by foreign substances,
the Secretary shall register the chamber as a fumigation chamber for fruit and shall issue a certificate of registration in accordance with Form 2a in respect of the chamber.

“(4.) Where—
(
a )fumigation is not being carried out in a fumigation chamber in an efficient manner; or(
b )the standard of hygiene in a fumigation chamber, the premises (if any) in which it is included or its immediate surroundings is such that, in the opinion of an officer, fruit may become infested with insects, contaminated by foreign substances or dangerous to the health of consumers,
the Secretary may cancel the registration of the chamber as a fumigation chamber.”.
(2.) A fumigation chamber registered under the Exports (Fresh Fruit) Regulations shall be deemed to be registered under those Regulations as amended by these Regulations but only in relation to citrus fruits.
(
a ) by omitting from paragraph (a ) the words “One pound one shilling” and inserting in their stead the words “Two dollars ten cents”; and(
b )by omitting from paragraph (b )the words “Three shillings” and inserting in their stead the words “Thirty cents”.
(
a ) by omitting from sub-item (2.) of item 1 the words “or tray” (twice occurring) and inserting in their stead the words “, tray or fibreboard carton”; and(
b )by adding at the end of that item the following sub-item:—“(3.) Except as otherwise provided by these Regulations, fresh fruit shall be fruit that has not been subjected to any chemical treatment after harvesting other than fumigation in a fumigation chamber by means and in a manner approved by the Secretary.”.

d ) be otherwise held, transported and stored in such manner as will conserve their storage life.“11a. Pears shall not be shipped if their temperature at the time of loading into a vessel exceeds—
(
a ) where they are packed in a box or tray, 45 degrees Fahrenheit; and(
b )where they are packed in a fibreboard carton, 40 degrees Fahrenheit.”;(
h )by adding at the end of paragraph 12 (in the second column) the following sub-paragraph:—“(2.) Pears packed in a fibreboard carton shall, when stowed in a vessel, be stowed in such a manner that at least one long face of each carton is freely exposed to the cooling air.”; and
(
i ) by inserting after paragraph 13 (in the second column) the following paragraph:—“13a. Pears which have been treated with either of the chemical substances commonly known as diphenylamine and ethoxyquin shall not be exported to a country other than a country the law of which does not prohibit the use in that country of either of those substances in the treatment of pears.’.

APPLICATION FOR REGISTRATION OF A FUMIGATION CHAMBER

I, , of hereby apply, in pursuance of the Exports (Fresh Fruit) Regulations, for the registration of a chamber situated at in the State of as a fumigation chamber for the fumigation of the fresh fruit intended for export specified in the first column
of the following table with the fumigant/fumigants* specified in the second column of that table opposite to that fruit in the first column. I enclose detailed specifications showing the type of construction of the chamber, its capacity, the plant and equipment to be used in connexion with its operation and the manner in which and the means by which fumigation is or will be carried out in the chamber.

(2.) The Fourth Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting from Form 2 the words “in respect of citrus fruits/ pineapples” and inserting in their stead the words “in respect of bananas/ citrus fruits/ pineapples”.
(3.) The Fourth Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting Form 2a and inserting in its stead the following Form:—
