REGULATIONS UNDER THE CUSTOMS ACT 1901-1949 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1933.*

WHEREAS by section 112 of the Customs Act 1901-1949 it is provided that the Governor-General may, by regulation, prohibit the exportation of any goods—

(a) the exportation of which would, in his opinion, be harmful to the Commonwealth ; or

(b) which have not been prepared or manufactured for export under the prescribed conditions as to purity, soundness, or freedom from disease, or which do not conform to the prescribed conditions as to purity, soundness, or freedom from disease :

And whereas it is provided by the said section that the said power of prohibition shall extend to authorize the prohibition of the exportation of the goods generally, or to any specified place, and either absolutely or so as to allow of the exportation of the goods subject to any condition or restriction :

And whereas I am of opinion that the exportation of fish, except subject to the conditions and restrictions prescribed by the Exports (Fish) Regulations, as amended by the following Regulations, would be harmful to the Commonwealth :

Now therefore I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1949 and the Commerce (Trade Descriptions) Act 1905-1933.

Amendments of the Exports (Fish) Regulations.

Trade description.

1. Regulation 9 of the Exports (Fish) Regulations is amended—

(a) by inserting in paragraph (c) of sub-regulation (2.), after the word “ exporter ; ” (second occurring), the word “ and ”;

(b) by omitting paragraph (d) of that sub-regulation; and

(c) by adding at the end thereof the following sub-regulation :—

“ (6.) Except in the case of frozen fish, each immediate container of fish shall have embossed thereon the letters ‘ Ex ’.”.

Registration of export establishment or appointed place.

2. Regulation 12 of the Exports (Fish) Regulations is amended by omitting from sub-regulation (3.) the words “ thirty-first day of December in the year in which it is issued ” and inserting in their stead the words “ thirtieth day of June next following the date on which it was issued ”.

Fees for officers’ services.

3. Regulation 36 of the Exports (Fish) Regulations is amended—

(a)by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation :—

“ (1.) Whenever, at the request of an exporter, the services of an officer are made available to the exporter for the purposes of these Regulations before or after official hours or on any Sunday or holiday, the exporter shall, except as provided by sub-regulation (3.) of this regulation, be charged for those services a fee at the rate of eight shillings per hour or part of an hour.” ; and

(b) by adding at the end thereof the following sub-regulation :—

“ (4.) For the purposes of this regulation, ‘ holiday ’ means any day observed as a holiday in the Public Service of the Commonwealth under section 76 of the Commonwealth Public Service Act 1922-1948.”.

The Second Schedule.

4. The Second Schedule to the Exports (Fish) Regulations is amended by omitting from Form 2 the words “ 31st December ” and inserting in their stead the words “ 30th June ”.
