"WHEREAS by section 112 of the Customs Act 1901-1936 it is provided that the
Governor-General may, by regulation, prohibit the exportation of any goods-

(a) the exportation of which would, in his opinion, be harmful to the
Commonwealth; or

(b) which have not been prepared or manufactured for export under the
prescribed conditions as to purity, soundness, or freedom from disease, or which do not conform to the prescribed conditions as to purity, soundness, or freedom
from disease:

"And whereas it is provided by the said section that the said power of
prohibition shall extend to authorize the prohibition of the exportation of
goods generally, or to any specified place, and either absolutely or so as to
allow of the exportation of the goods subject to any condition or restriction:

"And whereas I am of the opinion that the exportation of dried fruits, except subject to the conditions and restrictions prescribed by the following
Regulations, would be harmful to the Commonwealth:

"Now therefore I, the Governor-General in and over the Commonwealth of
Australia, acting with the advice of the Federal Executive Council, hereby make
the following Regulations under the Customs Act 1901-1936 and the Commerce
(Trade Descriptions) Act 1905-1933."

Citation

PART I-PRELIMINARY

1. These Regulations may be cited as the Exports (Dried Fruits) Regulations.*1*

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 2.
Commencement

2. These Regulations shall come into operation on the fifteenth day of December, 1938.

Interpretation

5. (1) In these Regulations, unless the contrary intention appears-

"analyst" means a person who holds, or is to be deemed to hold, office as an analyst under sub-regulation 29A (1);

"appointed place" means-

(a) an export establishment;

(b) a wharf, airport, depot, railway station or railway siding at which or from which dried fruits intended for export are to be stored or transported;

(c) an aircraft, ship, railway wagon, road transport vehicle or container system unit used, or intended to be used, for the conveyance for export of dried fruits; or

(d) a place appointed under regulation 16;

"bold ", in relation to dried fruits, means fleshy and full-bodied;

"cap-stem ", in relation to a dried vine fruit, means the small woody stem that attaches a grape to the branch of the bunch;

"clean ", in relation to dried fruits, means free from stalks, dirt, sand, grit, insect refuse or any other matter foreign to dried fruits;

"container system unit" means a container (including a lift van, but not including a vehicle) designed for repeated use as a unit of cargo handling equipment in which goods are transported to, in and from ships, that are specially constructed, adapted or equipped to handle and carry containers of that kind;

"coverings" means all the principal coverings in which dried fruits are contained;

"currants" means dried fruit, by whatever name known, which are produced solely from currant grapes;

"discolouration ", in relation to dried fruit (other than dried vine fruit), means such darkening of the fruit that the fruit does not comply with the conditions and restrictions included in an item in Schedule 2;

"disease" means any abnormal condition of or in dried fruits, and includes any condition arising from the presence of, or caused by, or due to, the operations, development, growth or decay of any insect or fungus;

"export establishment" means premises that are registered as an export establishment under regulation 7;

"foreign material ", in relation to dried fruits, means any visible substance, whether organic or inorganic, not indigenous to the fruit that is embedded in, or adheres to, any part of the fruit and affects its appearance or edibility;

"fresh ", in relation to dried fruits, means that the dried fruits are the produce of the latest crop, and that the condition of the dried fruits has not been materially impaired by age or other cause;

"fruit material" in relation to dried fruits means-

(a) pits;

(b) stems;

(c) seeds;

(d) peel;

(e) calyces;

(f) pieces of pit, stem, seed, peel and calyces; and

(g) any other plant matter that is part of, or originates in, the dried fruits;

"immature "-

(a) in relation to dried vine fruits means berries that are very light in mass, shrivelled and hard and lacking in sugar; and

(b) in relation to dried apricots, nectarines, peaches and pears means units that are lacking in sugar, tough and bitter to the taste or possess a green or other colour indicative of unripe fruit of that kind;

"immediate container" means any carton, jar, bottle, can, tin, or cellophane or other wrapping, which contains dried fruits;

"lexias" means dried fruit, by whatever name known, produced from dipped Waltham Cross grapes or dipped Gordo Blanco grapes;

"mould" means the growth produced on dried fruit by a micro-fungus, being a micro-fungus that has a well-marked mycelium or spore mass;

"muscatels" means dried fruit, by whatever name known, produced from grapes of the Waltham Cross or Gordo Blanco varieties that have not been dipped;

"natural sultanas" means dried fruit produced solely from sultana grapes that have not been dipped;

"officer" means an officer as defined by the Commerce (Trade Descriptions) Act 1905-1933;

"other blemishes ", in relation to dried apples, means that a piece of apple-

(a) is appreciably discoloured;

(b) has worm holes;

(c) has calyx or stem atached;

(d) has red skin attached aggregating in area the area of a circle 7 millimetres in diameter; or

(e) has green or yellow skin attached aggregating in area the area of a circle 15 millimetres in diameter;

"processed prunes" means prunes that have been washed or oiled or subjected to such other treatment as is approved by the Secretary;

"prunes" means the dried fruits derived by drying fully ripened D'Agen, Robe de Sargent, Splendor, Old French, Fellemberg, Imperial or Sugar plums;

"quarters ", in relation to dried apples, means pieces of apple from apples cut lengthwise through the core into three, four or six approximately equal segments;

"raisins" means grapes from which a part of the natural moisture has been removed;

"registered brand" means a brand registered, or deemed to be registered, under Part V of these Regulations;

"rings ", in relation to dried apples, means pieces of apple which are at least three quarters of slices from apples cut at right angles to the core;

"season" means the period commencing on the first day of November in any year and ending on the thirty-first day of October of the succeeding year;

"seeded lexias" means lexias from which the seeds or stones have been removed;

"seeded muscatels" means muscatels from which the seeds have been removed;

"slab" in relation to dried apricots, nectarines, peaches and pears means a unit of fruit which has been broken or mutilated to the extent that it has lost its normal contour;

"slices ", in relation to dried apples, means practically whole pieces of apples, whether cut at right angles to the cores or otherwise;

"State" includes any Territory under the authority of the Commonwealth;

"sound" in relation to fruit or dried fruits, means free from disease, damage, fermentation, mould, decay or deterioration arising from any cause;

"sultanas" means the dried fruit, by whatever name known, produced from dipped sultana grapes;

"the Department" means the Department of Primary Industry;

"the Minister" means the Minister of State for Primary Industry;

"the repealed Regulations" means the Regulations repealed by these Regulations;

"the Secretary" means the Secretary of the Department.


(2) In these Regulations, any reference to a Schedule shall be read as a reference to a Schedule to these Regulations, and any reference to a Form shall be read as a reference to a Form contained in the Third Schedule.

(3) For the purposes of these Regulations, dried fruits shall be taken to have been damaged if injured by physical, pathological or other means, or by insects, so that the appearance, edibility or keeping quality of the dried fruits has been affected.

(4) For the purposes of these Regulations, dried vine fruit shall be taken to have been dipped if, in order to increase the rate of drying of the fruit, an oil emulsion has been applied to the fruit by means of immersion or spray.

(5) For the purposes of these Regulations, a piece of dried apple shall be taken to have an excessive core when it has attached seed-cell (endocarp) aggregating more than 15 millimetres in diameter.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 6.
Application

6. These Regulations shall not apply to-

(a) ships' or aircrafts' stores brought to or transported from Australia;

(b) a parcel of dried fruits, not exceeding 5 kilograms, that is exported by post, ship or air; or

(c) dried fruits that are not produced or subjected to any process in Australia.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 6A.
Delegation

6A. (1) The Secretary may, either generally or as otherwise provided by the instrument of delegation, by writing signed by him, delegate to a person any of his powers under these Regulations, other than this power of delegation.


(2) A power so delegated, when exercised by the delegate, shall, for the purposes of these Regulations, be deemed to have been exercised by the Secretary.


(3) A delegation under this regulation does not prevent the exercise of a power by the Secretary.

Compliance with Forms

6B. Strict compliance with the Forms contained in Schedule 3 is not necessary and substantial compliance is sufficient.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 7.
Registration of export establishments

PART II-GENERAL PROVISIONS AS TO EXPORTATION OF DRIED FRUITS

7. (1) The owner or occupier of premises who desires to use the premises for the carrying on, in the period of twelve months commencing on the next succeeding first day of February or in a period ending on the next succeeding thirty-first day of January, of any operations in connexion with the receipt, processing, packing or storage of dried fruits intended for export, may make to the Secretary, an application in accordance with Form 1 for the registration of the premises as an export establishment in that period.

(2) Subject to these Regulations, where the Secretary is satisfied-

(a) that the premises are so constructed, and fitted with such machinery and equipment to comply with the requirements of Schedule 5; and

(b) that the operations on the premises in connexion with the receipt, processing, packing or storage of dried fruit are carried on in an efficient and hygienic manner in accordance with Schedule 6,

the Secretary shall register the premises as an export establishment and shall issue to the applicant a certificate of registration in accordance with Form 2 for those premises for the period specified in the certificate.


(3) The registration of premises as an export establishment that was in force immediately before the commencement of this regulation shall, subject to the next succeeding regulation, continue in force until the thirty-first day of January, 1961.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 7A.
Cancellation of registration

7A. Where the Secretary is satisfied that-

(a) an export establishment has ceased to comply with the requirements in Schedule 5 or Schedule 6;

(b) the equipment available in an export establishment has ceased to be adequate for carrying on the operations in connexion with the receipt, processing, packing or storage of dried fruits in an efficient and hygienic manner;

(c) the operations being carried on in an export establishment are not being carried on in an efficient and hygienic manner;

(d) an export establishment has ceased to be used for the receipt, processing, packing or storage of dried fruits; or

(e) the person in whose name an export establishment is registered-

(i) has ceased to be the owner or occupier, as the case may be, of that establishment; or

(ii) has failed to comply with a provision of these Regulations applicable to him,

the Secretary may, by notice in writing to the person in whose name the export establishment is registered, cancel the registration of the export establishment.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 7B.
Cancellation of certificate of registration

7B. Where the registration of premises as an export establishment is cancelled, the person in whose name the premises were so registered shall, within fourteen days after the date of cancellation, deliver the certificate of registration issued in respect of the premises to the Secretary.


Penalty: One hundred dollars.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 9.
Officers may enter establishments, take samples, &c.

9. (1) Any officer may enter any export establishment in which any dried fruits are being prepared for export, and may open any packages, take samples and do all other things necessary to enable him to ascertain whether the provisions of these Regulations are being complied with.


(2) The owner or occupier of every export establishment shall provide suitable office accommodation for the exclusive use of any officer employed at that export establishment.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 10.
Exportation of dried fruits prohibited except subject to conditions

10. (1) The exportation of dried fruits is prohibited unless-

(a) the dried fruits comply with the conditions and restrictions specified in Schedule 1; (b) the dried fruits comply with the conditions and restrictions specified in the second column of an item in Schedule 2;

(c) where the dried fruits are subject to any defect specified in Schedule 4 in relation to that particular kind of dried fruit, the proportion of the dried fruit subject to that defect does not exceed the proportion specified in that Schedule in relation to that defect in dried fruit of that particular kind;



(d) the dried fruits have been processed, packed and stored only at an export establishment; and

(e) the exporter has obtained an export permit in accordance with these Regulations in respect of the dried fruits and the export permit is in force when the dried fruits are exported.

(3B) The exportation of seeded lexias and seeded muscatels is prohibited unless the seeds have been removed by a process approved by the Secretary.


(4) This regulation shall not apply to any dried fruits in respect of which the Minister certifies that, for the purposes of experiment, or on account of special circumstances, it is desirable that this regulation should not apply to those dried fruits.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 11.
Exportation of dried fruits prohibited unless trade description applied

PART III-TRADE DESCRIPTIONS

11. (1) Subject to this regulation, the exportation of dried fruits is prohibited unless there is applied to the dried fruits a trade description in accordance with these Regulations.


(2) This regulation shall apply to dried fruits which are imported into Australia, and are not held in bond, unless the Secretary is satisfied that the dried fruits are not the produce or manufacture of Australia.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 12.
Trade description

12. (1) The trade description to be applied to dried fruits intended for export shall comply with the following provisions and with the provisions (if any) specified in the third column of the Second Schedule opposite to the name or description of the kind and grade of those dried fruits:

(a) It shall be in the form of a principal label or brand affixed to the coverings containing the dried fruits, in a prominent position and in a conspicuous and reasonably permanent manner.


(b) Where the dried fruits are packed in immediate containers-

(i) in the case of processed prunes, the portion of the trade description relating to the grade of the prunes shall be set out on both the immediate containers and the outer containers; and

(ii) in the case of any other dried fruits, it shall be sufficient if the portion of the trade description relating to the grade of the dried fruits is set out on the outer containers.


(c) It shall contain, in prominent and legible characters, a true description of the dried fruits, together with the word "Australia ", and may include in addition the name of the State in which the dried fruits were produced.


(d) It shall include one or both of the following particulars, namely:

(i) the name of the producer, packer or exporter;

(ii) the registered brand of the producer, packer or exporter:

Provided that the Secretary may, subject to such conditions as he thinks fit, permit the consignee's name or brand to be included in the trade description on the immediate container, in lieu of the registered brand of the producer, packer or exporter:

Provided further that where the producer or packer is not the exporter, the trade description shall include the producer's or packer's name or registered brand, unless the exporter sets forth in the notice of intention to export the name and address of the producer or packer.


(e) Where-

(i) currants of a grade specified in item 11, 12, 13, 14 or 15 of Schedule 2;

(ii) lexias of a grade specified in item 17 or 18 of Schedule 2; or

(iii) sultanas of a grade specified in item 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 50 or 51 of Schedule 2,

have been size graded in accordance with the provisions of one of those items, it shall include a statement of the size grade of the dried fruit.


(f) It shall contain the name of the dried fruits set out in bold and legible characters, and if any pictorial representation of fruit is included in the trade description, that representation shall be a representation of the kind of dried fruits contained in the covering to which the pictorial representation is applied.

(2) The Secretary may permit cypher marks not less than 19 millimetres in length approved by him to be included in the trade description instead of those portions of the trade description relating to the grade, size grade and colour of the dried fruits.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 13.
Trade description applies as at time of shipment

13. The trade description to be applied to dried fruits in pursuance of these Regulations shall have relation to the condition of the dried fruits as at the time of shipment.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 14.
Trade descriptions and official marks not to be interfered with

14. A person shall not, except by the authority of an officer, remove, alter or interfere with a trade description or official stamp or mark marked on or applied to any dried fruits which are intended for export and have been inspected by an officer.


Penalty: One hundred dollars.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 15.
Preparation of dried fruits under supervision

PART IV-SUPERVISION, INSPECTION AND EXAMINATION

15. (1) Upon the application of any person engaged in the preparation of any dried fruits intended for export, the Secretary may make available the services of an officer to supervise the preparation of the dried fruits and that person may then attach or affix to the dried fruits, or to the coverings containing the dried fruits, a label setting out that the dried fruits have been so prepared, and the supervising officer may sign or stamp his name upon the label.

(2) Where the services of an officer are made available in pursuance of an application under this regulation, the applicant shall pay to the Department the sum of Thirty cents for each hour during which the officer is engaged in supervising the preparation of the dried fruits, and, in addition, in any case where the amount so payable is exceeded by the expenses incurred by the Department in supplying the services of the officer, the Minister may require to be paid, and if the Minister so requires, the applicant shall pay, a sum equal to the amount of the excess.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 16.
Secretary may appoint places for inspection of dried fruits

16. (1) The Secretary may, by writing under his hand, appoint any place to be a place where dried fruits intended for export may be inspected and examined.


(2) In exercising his powers under this regulation, the Secretary may limit the appointment of any place to the inspection and examination of any particular dried fruits or class of dried fruits, or may attach to the appointment any other condition or restriction.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 17.
Dried fruits to be sent to appointed places

17. All dried fruits intended for export shall be sent to an appointed place in sufficient time before shipment to enable an officer to inspect and examine them.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 18.
Examination at places other than appointed places

18. The Secretary may permit the inspection and examination of dried fruits to be made at a place other than an appointed place.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 19.
Notice of intention to export, and declaration

19. A person who intends to export any dried fruits shall furnish to the Department a notice and declaration in writing in accordance with Form 3 at least three clear working days before the proposed date of shipment.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 20.
False declarations

20. (1) A person shall not make any false or misleading statement in any declaration furnished in pursuance of the last preceding regulation.

(2) In any proceedings for an offence against the last preceding sub-regulation, a certificate signed by the Secretary, a Deputy Secretary or a First Assistant Secretary of the Department certifying that the declaration was furnished in pursuance of the last preceding regulation, and was made by the person by whom it purports to have been made, shall be prima facie evidence of the matters certified to.

(3) Judicial notice shall be taken of the signature to any certificate made under the last preceding sub-regulation, and of the fact that the person whose signature it purports to bear holds, or has held, the office of Secretary, Deputy Secretary or First Assistant Secretary of the Department.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 21.
Export permits and certificate as to examination of dried fruits

21. (1) Where an officer has examined any dried fruits intended for export and-

(a) the dried fruits are marked in the prescribed manner with the prescribed trade description; and

(b) the officer is satisfied that the conditions and restrictions applicable under these Regulations in respect of the dried fruits have been complied with,

he shall sign the certificate at the foot of the notice of intention to export furnished in respect of those dried fruits, and the exporter shall be entitled to receive an export permit in accordance with Form 4.

(2) When dried fruits are brought to a wharf or airport for shipment, the exporter shall deliver the export permit in respect of the dried fruits to the Officer of Customs on duty at the ship or aircraft by which the dried fruits are to be exported.

(3) Unless the Secretary otherwise expressly permits, the dried fruits shall be loaded in the presence of an officer into the ship or aircraft by which they are to be exported.


(4) Where an officer is satisfied that the dried fruits have been shipped, the exporter shall be entitled to receive a certificate in accordance with Form 5 as to the condition of the dried fruits.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 22.
Dried fruits may be re-examined and permit cancelled

22. (1) If any officer has reasonable cause to think that, since the examination of any dried fruits intended for export, the condition, quality, grade or class of the dried fruits has changed, he may re-examine the dried fruits and if, having regard to the condition, quality, grade or class of the dried fruits as disclosed by the re-examination-

(a) the dried fruits are not marked in the prescribed manner with the prescribed trade description; or

(b) the officer is satisfied that any condition or restriction applicable under these Regulations has not been complied with,

he may cancel the export permit and any certificate as to the condition of the dried fruits issued in respect of those dried fruits.

(2) Where an export permit or certificate as to the condition of any dried fruits has been cancelled under the last preceding sub-regulation, the exporter shall, if so required by an officer, forthwith surrender the permit or certificate, as the case may be, to the officer.


Penalty: One hundred dollars.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 23.
Register of brands

23. (1) Subject to regulation 25 of these Regulations, the Secretary-

(a) may register a brand as a brand that may be included in the trade description of dried fruits; and

(b) shall keep a register, to be known as the Register of Brands, of the brand so registered.


(2) A brand may be registered for a particular type of dried fruits.


(3) The register of brands kept by the Secretary under these Regulations as in force immediately before the commencement of this regulation and any register incorporated with and forming part of that register shall be incorporated with and form part of the register kept under this regulation.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 24.
Application to be accompanied by copies of brand

24. An application for the registration of a brand shall be accompanied by 9 copies of the brand.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 25.
Registration as trade mark necessary

25. A brand shall not be registered under these Regulations unless-

(a) it is registered, or to be deemed to be registered, in the Register of Trade Marks kept under the Trade Marks Act 1955, as a trade mark in respect of dried fruits or of a particular kind of dried fruit; and

(b) the applicant is the registered proprietor or a registered user of the trade mark.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 26.
Registration number

26. The Secretary shall allot a number to each registered brand, and that number may be applied to dried fruits in conjunction with the brand.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 27.
Assignments, transmissions, of trade marks to be notified

27. (1) Where-

(a) a trade mark that is registered as a brand under these Regulations is assigned or transmitted to a person; or

(b) a person becomes a registered user of a trade mark that is registered as a brand under regulation 23,

the person shall give notice in writing to the Secretary of the assignment or transmission, or of his becoming such a registered user, as the case may be.


Penalty: $50.


(2) Where a person ceases to be a registered user of a trade mark that is registered as a brand under regulation 23, he shall give notice in writing to the Secretary of his ceasing to be a registered user of that trade mark.


Penalty: $50.


(3) Upon receipt of a notice given by a person under sub-regulation (1) in respect of a trade mark that is registered as a brand under regulation 23, the Secretary shall enter in the Register of Brands the name and address of the person as a user or registered proprietor of the brand to which the notice relates.


(4) Where the Secretary is satisfied that a person has ceased to be the registered proprietor or a registered user of a trade mark that is registered as a brand under regulation 23, the Secretary shall remove the name of that person from the Register of Brands as a user of the brand.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 28.
Cancellation of brand where no longer registered as a trade mark

28. Where a trade mark that is registered as a brand under regulation 23, ceases to be registered as a trade mark, the Secretary shall cancel the registration of the brand.

Analysts

29A. (1) The Minister may appoint to be analysts, for the purposes of these Regulations, persons who he is satisfied have the necessary qualifications.


(2) The person for the time being occupying, or performing the duties of-

(a) the office of Assistant Secretary in the Analytical Services Branch in the Department of Science; or

(b) an office in the Analytical Services Branch in the Department of Science the designation of which includes the word "Science ",

shall be deemed to have been appointed to be an analyst under sub-regulation (1).


(3) An analyst may analyse samples of dried fruits that are taken by an officer under the Commerce (Trade Descriptions) Act 1905.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 30.
Certificates of analysts

30. In proceedings under the Customs Act 1901, the Commerce (Trade Descriptions) Act 1905 or these Regulations in relation to dried fruits-

(a) a certificate signed by an analyst setting out that he has analysed a sample of dried fruits and stating the result of the analysis, is evidence of the matters stated in the certificate; and

(b) a document purporting to be such a certificate shall, unless the contrary is proved, be deemed to be such a certificate.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 31.
Fees for certificates of analysts

31. Where a certificate of analysis relating to dried fruits has been given by an analyst, the Secretary may furnish a copy of the certificate to the exporter of the dried fruits, if the exporter so requests and pays-

(a) in the case of an analysis made at the request of the exporter-a fee of $2.10; or

(b) in any other case-a fee of 30 cents.

EXPORTS (DRIED FRUITS) REGULATIONS - SECT. 32.
Fees for Officers' services

Sub-reg. (1) substituted by 1974 No. 230; amended by 1977 No. 250; 1980 No. 126 32. (1) Subject to sub-regulation (3), where, at the request of a person, the services of an officer are made available to the person for the purposes of these Regulations, the person shall be charged-

(a) in respect of services rendered-

(i) on a week day either before the hour of 7 o'clock in the morning or after the hour of 10 o'clock in the night of that day; or

(ii) on a Saturday or Sunday,

a fee of $3.20 for each quarter-hour or part of a quarter-hour during which the services are so rendered;

(aa) in respect of services rendered on a holiday-a fee of $3.90 for each quarter-hour or part of a quarter-hour during which the services are so rendered;

(b) in respect of services rendered on a week day after the hour of 5 o'clock in the afternoon and before the hour of 10 o'clock in the night of that day-a fee of $2.35 for each quarter-hour or part of a quarter-hour during which the services are so rendered; or

(c) in respect of services rendered on a week day after the hour of 7 o'clock in the morning and before the hour of 5 o'clock in the afternoon of that day, being services so rendered for more than eight hours-a fee of $2.35 for each quarter-hour or part of a quarter-hour during which the services are so rendered after the services have been so rendered for eight hours.

(2) In calculating the fee to be charged a person under sub-regulation (1) in respect of the services of an officer made available to him, the time reasonably occupied by the officer in proceeding to and returning from the place where his attendance is required shall be treated as time during which the services are rendered.


(3) Where an officer is required to proceed on duty away from his ordinary station, the rate of charge to be made in respect of his services shall be fixed by the Minister.

(4) In this regulation-

"holiday" in relation to the services of an officer on a day, means a day observed, at the place at which the attendance of the officer is required, as a holiday under section 76 of the Public Service Act 1922-1964;

"officer" has the same meaning as in section 4 of the Customs Act 1901-1965;

"week day" in relation to the services of an officer on a day, means a Monday, Tuesday, Wednesday, Thursday or Friday that is not a holiday. -----------

CONDITIONS AND RESTRICTIONS TO BE COMPLIED WITH BY ALL DRIED FRUITS
INTENDED FOR EXPORT

1. The following provisions shall be complied with in respect of the
preparation of the dried fruits for export:

(a) The drying ground and drying racks and the immediate surroundings thereof shall (except in the case of those materials in actual use in the drying of the
fruit) be free from materials capable of harbouring insect pests.

(b) The fruit on the drying grounds and drying racks shall be protected from
contamination by insects, insect refuse and other foreign substances.

(c) The dried fruits shall be packed at an export establishment.

(d) Immediately prior to the commencement of each packing season, all
second-hand hessians, sweat boxes, drying trays and packing boxes shall be-

(i) immersed for not less than five minutes in water heated to a
temperature of not less than 65 degrees Celsius;

(ii) treated with a steam jet; or

(iii) fumigated with a gas to kill all insect life.

(e) All dried fruits shall be delivered to an export establishment in clean
containers constructed of material that does not adversely affect the condition
of the fruit.

(f) The fruit shall be covered with a tarpaulin, or other suitable covering
as a protection against dirt and dust whilst being conveyed to an export
establishment on any vehicle.

(g) Any fruit which is unfit for processing for human consumption or for
packing shall not be received into an export establishment, and an officer shall have power at any time to order the removal of any such fruit.

(i) Immediately after the completion of each drying season, all drying racks shall be cleansed of fruit or d'ebris, which shall be burnt or disposed of in
such manner as an officer directs.

2. The dried fruits shall, in the opinion of an officer, be-

(a) in suitable containers in respect of size, nature, durability and
cleanliness; and

(b) not likely, for any other reason, to arrive at their destination in a
deteriorated condition.

3. The outer layers or shown surfaces of the dried fruits shall be a true
indication of the average grade of the contents of the container.

4. The dried fruits shall-

(a) be prepared from sound, naturally ripened fruit; and

(b) possess the flavour characteristic of its kind.

4A. Subject to paragraph 5B and Schedule 4, the dried fruits shall be clean.

5. Subject to paragraph 5A, the dried fruits shall be-

(a) thoroughly cured;

(b) free from stickiness arising from any cause whatsoever; and

(c) free from excess moisture.

5A. The moisture content of dried tree fruit shall not exceed-

(a) in respect of dried apples and dried nectarines-22 per cent;

(b) in respect of dried pears-23 per cent;

(c) in respect of dried peaches-24 per cent; and

(d) in respect of dried apricots-25 per cent.

5B. Mineral impurities shall not be present in raisins to the extent that the
eating quality or usability of the raisins is affected.

6A. (1) Dried apples, apricots, nectarines and peaches shall contain sulphur
dioxide to an extent not less than 1,400 parts per million and dried pears shall contain sulphur dioxide to an extent not less than 1,000 parts per million, but
the sulphur dioxide content of dried apples, apricots, nectarines, peaches or
pears shall not exceed the amount estimated to give a content of 2,000 parts per million in the country of import.

(2) Where sodium or potassium metabisulphite is added to dried fruits it shall be thoroughly mixed with the fruit.

8. The dried fruits shall not be oiled to an extent that will cause undue
staining to the immediate container.

9. Dried fruits except-

(a) seeded lexias;

(b) seeded muscatels;

(c) dried apples; and

(d) dried tree fruit packed in insect-tight immediate containers,

shall, at the time of packing, be treated with a fumigant to kill all insect
life.

9A. Dried fruits except-

(a) dried apples; and

(b) dried fruits packed in insect-tight containers,

shall, after packing and prior to shipment, be fumigated with a gas to kill all
insect life.
10. Dried fruits shall be packed in accordance with the following provisions:

(a) The dried fruits (whether or not enclosed in immediate containers) shall
be packed-

(i) in clean new cases securely constructed of sound well-seasoned wood
that has been smoothly sawn or dressed;

(ii) in clean new fibreboard cartons that are sufficiently strong to
withstand such handling as is ordinarily incidental to transportation to
destinations beyond Australia; or

(iii) in metal drums, tin plate containers or any other type of container
approved by the Secretary.

(b) Cases containing dried fruits shall be strapped with metal strapping or
wire where-

(i) the contents exceed 12.5 kilograms; or

(ii) in any other case-the strapping is necessary to preserve the quality
and presentation of the dried fruits.

(c) Subject to any direction to the contrary by the Secretary, each case,
fibreboard carton, drum or immediate container in which dried fruits are packed
shall contain only one kind and grade of dried fruits.

(d) The position, size, colour and nature of any labels or markings on the
immediate containers of dried fruits, or on the cases, fibreboard cartons, drums or other containers in which dried fruits are packed, that are in addition to
the trade description and any other labels or markings applied in accordance
with any other provision of these Regulations shall be such as are approved by
the Secretary.

(e) Cases and drums containing dried fruits that are not enclosed in
immediate containers, shall be lined throughout with greaseproof paper or with a polyethylene liner.

(f) Dried tree fruits, lexias and seeded muscatels, shall, when packed in
bulk in a fibreboard carton, be packed in a polyethylene bag in that carton.

(g) Currants, sultanas and muscatels (other than seeded muscatels) shall,
when packed in bulk in a fibreboard carton, be packed so there is a layer of
greaseproof paper or polyethylene between the dried fruits and the top of the
carton and the dried fruits and the bottom of the carton.

(h) Figures and such ciphers as are approved by the Secretary to indicate
when the dried fruits were packed, shall be placed on the end of the case,
fibreboard carton, drum or immediate container.

11. A container system unit, railway wagon, road transport conveyance ship or
aircraft into which dried fruits are loaded shall be sound, free from insect
infestation, obnoxious odours and any other form of contamination.

17. Lexias-Five

fairly uniform brown or brownish
green colour, of firm texture
and full sweet flavour. They

2. Where the lexias are not

19. Midget lexias . 1. The lexias shall be of such

flavour and texture, and a

than eighty per cent by number
of lexias prepared from grapes
that are seedless.

20. Muscatels . . . Muscatels, whether in clusters
or loose, shall be of firm, full
texture, good flavour, of any
colour natural to the fruit, and
shall not include any blackened
or otherwise blemished berries. The trade description
shall include the word
"Muscatels ".

21. Midget
Muscatels . . . . . Midget muscatels shall be of
such a size as will pass through
a sieve the circular meshes of
which measure 10 millimetres in
diameter and over a sieve the
circular meshes of which measure
6 millimetres in diameter. They
shall be of good flavour and
texture, and each package shall
contain not less than 80 per
cent by number of muscatels
prepared from grapes that are
seedless. The trade description
shall include the word
"Midget ".

22. Dried
Nectarines-Fancy
Quality 1. The dried nectarines shall
consist of cleanly cut complete
halves of sound nectarines,
fully ripened and thoroughly
cured, of good colour, quality
and texture, and shall be free
from blackness.

2. The dried nectarines shall
be graded into sizes as follows: The trade description
shall include the word
"Fancy" together with
the word or words
"Jumbo ", "Extra
Large" or "Large ", as the case may be.

(a) Jumbo-consisting of
fruit of such a size as cannot
be passed through a 40
millimetre riddle; except that a
maximum of 10 per cent by number
of the fruit may be of such a
size as can be passed through a
40 millimetre riddle but cannot
be passed through a 35
millimetre riddle.
(b) Extra Large-consisting
of fruit of such a size as
cannot be passed through a 35
millimetre riddle; except that a
maximum of 10 per cent by number
of the fruit may be of such a

(c) Large-consisting of
fruit of such a size as can be

Nectarines-Choice
Quality 1. The dried nectarines shall

Regulation 7
CONDITIONS TO BE COMPLIED WITH IN RESPECT OF PREMISES REGISTERED AS
AN EXPORT ESTABLISHMENT

1. The premises shall be of sufficient size for the purpose intended without
crowding of machinery, equipment or personnel and shall be so designed as to
permit effective cleaning.

2. The premises shall be of such construction as to minimize any harbourage
for insects or any contamination of dried fruits by foreign substances during
the operations of stacking, handling, loading, stemming, processing, grading and storage.

3. The premises shall be so constructed as to minimize the entry of birds and
rodents.

4. The premises shall be so constructed as to minimize the entry of
objectionable odours, fumes, smoke and dust and shall be ventilated in a manner
which will quickly remove steam and obnoxious fumes.

5. The floors of the premises shall be constructed of concrete or other
suitable material, which shall be impervious to insects and permit effective
fumigation of fruit.

6. The premises shall be properly drained and the arrangements for the
disposal of the drainage shall be such as not to contaminate the areas
surrounding the premises.

7. Sufficient light shall be provided for the purpose of efficient inspection
and for the operations carried out within the premises.

8. The premises shall have adequate and convenient toilet facilities. The
toilets shall be well lit and ventilated and shall not open directly into food
handling areas. Hand washing facilities, soap and single use towels shall be
provided in the toilet area and notices shall be posted in that area stating
that personnel must wash their hands before leaving the area.

9. The premises shall have a dressing room and the facilities for the storage
of clothing separate from the food handling area.

10. Provision shall be made to ensure that an adequate supply of pressurized
cold water, and hot water, where necessary, is available in any part of the
premises. The water shall be of potable quality.

11. Adequate and convenient hand washing facilities shall be provided in the
vicinity of the processing line for use by personnel and in the vicinity of the
inspection tables for use by officers. The facilities shall consist of
pressurized water, hand basins, soap and single use towels.

12. Light bulbs and fixtures suspended over dried fruits shall be of the safety type or otherwise protected to prevent food contamination in the case of
breakage.

13. Where premises are used for the processing and packing of dried fruits,
machinery capable of detecting and removing foreign materials from the dried
fruit during processing and packing shall be provided.

14. Except in the case of premises that are used for processing tree fruit
which has been mechanically dried, each processing line along which packed
processed dried fruit passes shall incorporate an electrically operated metal
detector of an accuracy sufficient to record by warning signal the presence of a 5 millimetre steel ball passing through the magnetic field.

15. Facilities shall be provided for the removal and collection of dust and
screenings from the dried fruit during processing.

16. Inspection tables shall be provided on each processing line for use by
officers.
The tables shall be not less than 1.5 metres by 1 metre in surface area topped with white plastic coated board on other impervious material and be so
constructed as to permit the quick return of the dried fruit to the container.

17. Premises engaged in the processing of dried vine fruit shall operate a
gritometer capable of determining the grit content of dried vine fruit.

18. Where fumigation of dried fruit is to be undertaken, suitable equipment
shall be provided.

Regulation 7
CONDITIONS TO BE COMPLIED WITH IN RESPECT OF OPERATIONS CARRIED ON AT PREMISES REGISTERED AS AN EXPORT ESTABLISHMENT

1. The machinery and equipment on the premises shall be maintained and
operated in an efficient manner.

2. Before the commencement of each season and at such other times as an
officer considers necessary the premises shall be cleaned thoroughly by spraying the walls with an insecticide approved by the Secretary. The walls shall be
painted with a material approved by the Secretary when an officer considers it
necessary.

3. Processed dried fruit shall be separated from unprocessed dried fruit by a
distance of at least 3 metres and an effective insect barrier shall be provided
between the processed fruit and the unprocessed fruit.

4. Unless dried fruit is stored in refrigeration or fumigation chambers, dried fruit shall be stored at least 500 millimetres from dividing walls on the
premises and an effective insect barrier shall be laid between the wall and the
dried fruit.

5. Packed, processed dried fruit shall be stored under hygienic conditions.
The dried fruit and a container of the dried fruit shall be protected against
rodent and insect infestation and deterioration.

6. Fruit debris, fruit waste and screenings, other than that put aside for
further processing, shall be removed completely from the buildings used for
processing or packing dried fruit at least once daily and from the premises at
least once weekly.

7. Low grade fruit and screenings awaiting further treatment shall be
protected from contamination by insects, rodents and birds.

8. At least once each week the floors at the premises shall be cleaned of all
fruit debris and washed. The premises shall be sprayed with an insecticide
approved by the Secretary and effective insect barriers shall be laid or re-laid to protect the dried fruit from migrating insects.

9. All machinery, equipment and surrounding floor area shall be thoroughly
cleaned of all dried fruit and debris-

(a) where one kind of dried fruit only is being processed and packed-at
least twice weekly at intervals of not more than 3 days;

(b) immediately after the processing and packing of one kind of dried fruit
has been completed and before any other kind of dried fruit is passed through
the machinery; and

(c) before commencing the processing and packing of dried fruit where a
period of more than 3 days has elapsed since processing and packing ceased.

10. Any material or produce likely to be a source of infestation of dried fruit shall not be stored or handled in a building used for the processing or storage
of dried fruit.

11. Rodenticides, fumigants, insecticides or other toxic substances shall be
stored in such a manner as to prevent contamination of the dried fruit. Toxic
materials shall not be stored in an area of a building where dried fruit is
handled or stored.

12. Domestic animals shall be excluded, at all times, from the buildings
forming part of the premises.

13. Glass containers, except where any article of glass is used for packaging,
shall be excluded from the processing areas of the premises.

14. Personnel engaged in the handling, loading, grading and packing of dried
fruit shall wear clean clothes appropriate to the duties being performed and
maintain a high degree of personal cleanliness.

15. The eating of meals, smoking, spitting and use of chewing gum is prohibited in areas of the premises where dried fruit is processed, packed and stored.

16. A person known to be affected with a disease capable of being transmitted
to food, or known to be a carrier of such a disease shall not work in any area
of the premises if there is a likelihood of that person contaminating dried
fruit or dried fruit contact surfaces with pathogenic organisms.

17. Hand-washing facilities and toilets shall be kept in a sanitary condition
at all times.
