Exports (Dried Fruits) Regulations (Amendment) (Cth)
REGULATIONS UNDER THE CUSTOMS ACT 1901 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905*

AMENDMENTS OF THE EXPORTS (DRIED FRUITS) REGULATIONS
(a) by omitting from sub-regulation (1) the definitions of “ appointed place ” and “ bold ” and substituting the following definitions:
“ ‘ appointed place ’ means—
(a) an export establishment;
(b) a wharf, airport, depot, railway station or railway siding at which or from which dried fruits intended for export are to be stored or transported;
(c) an aircraft, ship, railway wagon, road transport vehicle or container system unit used, or

intended to be used, for the conveyance for export of dried fruits; or
(d) a place appointed under regulation 16;
‘ bold ’, in relation to dried fruits, means fleshy and full-bodied;
‘ cap-stem ’, in relation to a dried vine fruit, means the small woody stem that attaches a grape to the branch of the bunch;”;
(b) by inserting in sub-regulation (1), after the definition of “ clean ”, the following definition:
“ ‘ container system unit ’ means a container (including a lift van, but not including a vehicle) designed for repeated use as a unit of cargo handling equipment in which goods are transported to, in and from ships, that are specially constructed, adapted or equipped to handle and carry containers of that kind;”;
(c) by omitting from sub-regulation (1) the definition of “ currants ” and substituting the following definitions;
“ ‘ currants ’ means dried fruit, by whatever name known, which are produced solely from currant grapes;
‘ discolouration ’, in relation to dried fruit (other than dried vine fruit), means such darkening of the fruit that the fruit does not comply with the conditions and restrictions included in an item in Schedule 2;”;
(d) by omitting from sub-regulation (1) the definition of “ excessive core ”;
(e) by omitting from sub-regulation (1) the definition of “ export establishment ” and substituting the following definitions:
“ ‘ export establishment ’ means premises that are registered as an export establishment under regulation 7;
‘ foreign material ’, in relation to dried fruits, means any visible substance, whether organic or inorganic, not indigenous to the fruit that is embedded in, or adheres to, any part of the fruit and affects its appearance or edibility;”;
(f) by inserting in sub-regulation (1), after the definition of “ fresh ”, the following definitions:
“ ‘ fruit material ’ in relation to dried fruits means—
(a) pits;
(b) stems;
(c) seeds;
(d) peel;
(e) calyces;
(f) pieces of pit, stem, seed, peel and calyces; and
(g) any other plant matter that is part of, or originates in, the dried fruits;
‘ immature ’—
(a) in relation to dried vine fruits means berries that are very light in mass, shrivelled and hard and lacking in sugar; and
(b) in relation to dried apricots, nectarines, peaches and pears means units that are lacking in sugar, tough and bitter to the taste or possess a green or other colour indicative of unripe fruit of that kind;”;
(g) by inserting in sub-regulation (1), after the definition of “ immediate container ”, the following definition:
“ ‘ lexias ’ means dried fruit, by whatever name known, produced from dipped Waltham Cross grapes or dipped Gordo Blanco grapes;”;
(h) by omitting from sub-regulation (1) the definition of “ muscatels ” and substituting the following definitions:
“ ‘ mould ’ means the growth produced on dried fruit by a micro-fungus, being a micro-fungus that has a well-marked mycelium or spore mass;
‘ muscatels ’ means dried fruit, by whatever name known, produced from grapes of the Waltham Cross or Gordo Blanco varieties that have not been dipped:
‘ natural sultanas ’ means dried fruit produced solely from sultana grapes that have not been dipped;”;
(i) by omitting from the definition of “ other blemishes ” in sub-regulation (1) “ a quarter of an inch ” and “ half an inch ” and substituting “ 7 millimetres ” and “ 15 millimetres ” respectively;
(j) by omitting from sub-regulation (1) the definition of “ raisins ” and substituting the following definition:
“ ‘ raisins ’ means grapes from which a part of the natural moisture has been removed;”;
(k) by inserting in sub-regulation (1), after the definition of “ season ”, the following definitions:
“ ‘ seeded lexias ’ means lexias from which the seeds or stones have been removed;
‘ seeded muscatels ’ means muscatels from which the seeds have been removed;
‘ slab ’ in relation to dried apricots, nectarines, peaches and pears means a unit of fruit which has been broken or mutilated to the extent that it has lost its normal contour;”;
(1) by omitting from sub-regulation (1) the definitions of “ sultanas ” and “ table or dessert raisins ” and substituting the following definition:
“ ‘ sultanas ’ means the dried fruit, by whatever name known, produced from dipped sultana grapes;”;
(m) by omitting from sub-regulation (1) the definition of “ walthams ”; and
(n) by adding at the end thereof the following sub-regulations:
“ (3) For the purposes of these Regulations, dried fruits shall be taken to have been damaged if injured by physical, pathological or other means, or by insects, so that the appearance, edibility or keeping quality of the dried fruits has been affected.
“ (4) For the purposes of these Regulations, dried vine fruit shall be taken to have been dipped if, in order to increase the rate of drying of the fruit, an oil emulsion has been applied to the fruit by means of immersion or spray.
“ (5) For the purposes of these Regulations, a piece of dried apple shall be taken to have an excessive core when it has attached seed-cell (endocarp) aggregating more than 15 millimetres in diameter.".
“ 6. These Regulations shall not apply to—
(a) ships’ or aircrafts’ stores brought to or transported from Australia;
(b) a parcel of dried fruits, not exceeding 5 kilograms, that is exported by post, ship or air; or
(c) dried fruits that are not produced or subjected to any process in Australia.
“ 6a. (1) The Secretary may, either generally or as otherwise provided by the instrument of delegation, by writing signed by him, delegate to a person any of his powers under these Regulations, other than this power of delegation.
“ (2) A power so delegated, when exercised by the delegate, shall, for the purposes of these Regulations, be deemed to have been exercised by the Secretary.
“ (3) A delegation under this regulation does not prevent the exercise of a power by the Secretary.
“ 6b. Strict compliance with the Forms contained in Schedule 3 is not necessary and substantial compliance is sufficient.”.
“ (a) that the premises are so constructed, and fitted with such machinery and equipment to comply with the requirements of Schedule 5; and
“ (b) that the operations on the premises in connexion with the receipt, processing, packing or storage of dried fruit are carried on in an efficient and hygienic manner in accordance with Schedule 6,”.
(a) by omitting from paragraph (a) “ the conditions and restrictions specified in regulation 8 of these Regulations ” and substituting “ the requirements in Schedule 5 or Schedule 6 ”; and
(b) by omitting from paragraph (b) “ and storage ” and substituting “ or storage ”.
(a) by omitting sub-regulations (1) and (2) and substituting the following sub-regulation:
“ (1) The exportation of dried fruits is prohibited unless—
(a) the dried fruits comply with the conditions and restrictions specified in Schedule 1;
(b) the dried fruits comply with the conditions and restrictions specified in the second column of an item in Schedule 2;
(c) where the dried fruits are subject to any defect specified in Schedule 4 in relation to that particular kind of dried fruit, the proportion of the dried fruit subject to that defect does not exceed the proportion specified in that Schedule in relation to that defect in dried fruit of that particular kind;
(d) the dried fruits have been processed, packed and stored only at an export establishment; and
(e) the exporter has obtained an export permit in accordance with these Regulations in respect of the dried fruits and the export permit is in force when the dried fruits are exported.”; and
(b) by omitting from sub-regulation (3b) “ seeded or stoned raisins ” and substituting “ seeded lexias and seeded muscatels ”.
(a) by omitting paragraph 1 (da) and substituting the following paragraph:
“ (e) Where—
(i) currants of a grade specified in item 11, 12, 13, 14 or 15 of Schedule 2;
(ii) lexias of a grade specified in item 17 or 18 of Schedule 2; or
(iii) sultanas of a grade specified in item 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 50 or 51 of Schedule 2,
have been size graded in accordance with the provisions of one of those items, it shall include a statement of the size grade of the dried fruit.”; and
(b) by omitting from sub-regulation (2) “ 3/4 inch ” and substituting “ 19 millimetres ”.
(a) by omitting from sub-regulation (2) “ or an Assistant Secretary ” and substituting “, a Deputy Secretary or a First Assistant Secretary ”;
(b) by omitting from sub-regulation (3) “ or Assistant Secretary ” and substituting “, Deputy Secretary or First Assistant Secretary ”.
(a) by omitting sub-regulation (2) and substituting the following sub-regulation:
“ (2) When dried fruits are brought to a wharf or airport for shipment, the exporter shall deliver the export permit in respect of the dried fruits to the Officer of Customs on duty at the ship or aircraft by which the dried fruits are to be exported.”; and
(b) by inserting in sub-regulation (3) “ or aircraft ” after “ ship ”.
“ 23. (1) Subject to regulation 25 of these Regulations, the Secretary—
(a) may register a brand as a brand that may be included in the trade description of dried fruits; and
(b) shall keep a register, to be known as the Register of Brands of the brand so registered.
“ (2) A brand may be registered for a particular type of dried fruits.
“ (3) The register of brands kept by the Secretary under these Regulations as in force immediately before the commencement of this regulation and any register incorporated with and forming part of that register shall be incorporated with and form part of the register kept under this regulation.
“ 24. An application for the registration of a brand shall be accompanied by 9 copies of the brand.
“ 25. A brand shall not be registered under these Regulations unless—
(a) it is registered, or to be deemed to be registered, in the Register of Trade Marks kept under the
Trade Marks Act 1955, as a trade mark in respect of dried fruits or of a particular kind of dried fruit; and(b) the applicant is the registered proprietor or a registered user of the trade mark.
“ 26. The Secretary shall allot a number to each registered brand, and that number may be applied to dried fruits in conjunction with the brand.
“ 27. (1) Where—
(a) a trade mark that is registered as a brand under these Regulations is assigned or transmitted to a person; or
(b) a person becomes a registered user of a trade mark that is registered as a brand under regulation 23,
the person shall give notice in writing to the Secretary of the assignment or transmission, or of his becoming such a registered user, as the case may be.
Penalty: $50.
“ (2) Where a person ceases to be a registered user of a trade mark that is registered as a brand under regulation 23, he shall give notice in writing to the Secretary of his ceasing to be a registered user of that trade mark.
Penalty: $50.
“ (3) Upon receipt of a notice given by a person under sub-regulation (1) in respect of a trade mark that is registered as a brand under regulation 23, the Secretary shall enter in the Register of Brands the name and address of the person as a user or registered proprietor of the brand to which the notice relates.
“ (4) Where the Secretary is satisfied that a person has ceased to be the registered proprietor or a registered user of a trade mark that is registered as a brand under regulation 23, the Secretary shall remove the name of that person from the Register of Brands as a user of the brand.
“ 28. Where a trade mark that is registered as a brand under regulation 23, ceases to be registered as a trade mark, the Secretary shall cancel the registration of the brand.”.
“ 30. In proceedings under the
(a) a certificate signed by an analyst setting out that he has analysed a sample of dried fruits and stating the result of the analysis, is evidence of the matters stated in the certificate; and
(b) a document purporting to be such a certificate shall, unless the contrary is proved, be deemed to be such a certificate.
“ 31. Where a certificate of analysis relating to dried fruits has been given by an analyst, the Secretary may furnish a copy of the certificate to the exporter of the dried fruits, if the exporter so requests and pays—
(a) in the case of an analysis made at the request of the exporter—a fee of $2.10; or
(b) in any other case—a fee of 30 cents.”.
(a) by omitting the heading “ FIRST SCHEDULE ” and substituting the heading “ SCHEDULE 1 ”;
(b) by omitting from clause (i) of sub-paragraph 1 (d) “ 150 degrees Fahrenheit; or ” and substituting “ 65 degrees Celsius;”;
(c) by inserting after clause (ii) of sub-paragraph 1 (d) the following word and clause:
“; or (iii) fumigated with a gas to kill all insect life.”;
(d) by omitting sub-paragraph 1 (e) and substituting the following sub-paragraph:
“ (e) All dried fruits shall be delivered to an export establishment in clean containers constructed of material that does not adversely affect the condition of the fruit.”;
(e) by omitting sub-paragraph 1 (h);
(f) by omitting from sub-paragraph 2 (a) “ contained in cases or containers which are suitable ” and substituting “ in suitable containers ”;
(g) by omitting from paragraph 3 “ case or ”;
(h) by omitting paragraphs 4, 5 and 5a and substituting the following paragraphs:
“ 4. The dried fruits shall—
(a) be prepared from sound, naturally ripened fruit; and
(b) possess the flavour characteristic of its kind.
“ 5. Subject to paragraph 5a, the dried fruits shall be—
(a) thoroughly cured;
(b) free from stickiness arising from any cause whatsoever; and
(c) free from excess moisture.
“ 5a. The moisture content of dried tree fruit shall not exceed—
(a) in respect of dried apples and dried nectarines— 22 per cent;
(b) in respect of dried pears—23 per cent;
(c) in respect of dried peaches—24 per cent; and
(d) in respect of dried apricots—25 per cent.
“ 5b. Mineral impurities shall not be present in raisins to the extent that the eating quality or usability of the raisins is affected.”;
(i) by omitting paragraph 7;
(j) by omitting paragraph 8 and substituting the following paragraph:
“ 8. The dried fruits shall not be oiled to an extent that will cause undue staining to the immediate container.”; and
(k) by omitting paragraphs 9 and 10 and substituting the following paragraphs:
“ 9. Dried fruits except—
(a) seeded lexias;
(b) seeded muscatels;
(c) dried apples; and
(d) dried tree fruit packed in insect-tight immediate containers,
shall, at the time of packing, be treated with a fumigant to kill all insect life.
“ 9a. Dried fruits except—
(a) dried apples; and
(b) dried fruits packed in insect-tight containers, shall, after packing and prior to shipment, be fumigated with a gas to kill all insect life.
“ 10. Dried fruits shall be packed in accordance with the following provisions:
(a) The dried fruits (whether or not enclosed in immediate containers) shall be packed—
(i) in clean new cases securely constructed of sound well-seasoned wood that has been smoothly sawn or dressed;
(ii) in clean new fibreboard cartons that are sufficiently strong to withstand such handling as is ordinarily incidental to transportation to destinations beyond Australia; or
(iii) in metal drums, tin plate containers or any other type of container approved by the Secretary.
(b) Cases containing dried fruits shall be strapped with with metal strapping or wire where—
(i) the contents exceed 12.5 kilograms; or
(ii) in any other case—the strapping is necessary to preserve the quality and presentation of the dried fruits.
(c) Subject to any direction to the contrary by the Secretary, each case, fibreboard carton, drum or immediate container in which dried fruits are
packed shall contain only one kind and grade of dried fruits.
(d) The position, size, colour and nature of any labels or markings on the immediate containers of dried fruits, or on the cases, fibreboard cartons, drums or other containers in which dried fruits are packed, that are in addition to the trade description and any other labels or markings applied in accordance with any other provision of these Regulations shall be such as are approved by the Secretary.
(e) Cases and drums containing dried fruits that are not enclosed in immediate containers, shall be lined throughout with greaseproof paper or with a polyethylene liner.
(f) Dried tree fruits, lexias and seeded muscatels, shall, when packed in bulk in a fibreboard carton, be packed in a polyethylene bag in that carton.
(g) Currants, sultanas and muscatels (other than seeded muscatels) shall, when packed in bulk in a fibreboard carton, be packed so there is a layer of greaseproof paper or polyethylene between the dried fruits and the top of the carton and the dried fruits and the bottom of the carton.
(h) Figures and such ciphers as are approved by the Secretary to indicate when the dried fruits were packed, shall be placed on the end of the case, fibreboard carton, drum or immediate container.
“ 11. A container system unit, railway wagon, road transport conveyance ship or aircraft into which dried fruits are loaded shall be sound, free from insect infestation, obnoxious odours and any other form of contamination.”.
14. The Second Schedule to the Exports (Dried Fruits) Regulations is repealed and the following Schedule substituted:

SCHEDULE 5 Regulation 7
CONDITIONS TO BE COMPLIED WITH IN RESPECT OF PREMISES REGISTERED AS AN EXPORT ESTABLISHMENT
1. The premises shall be of sufficient size for the purpose intended without crowding of machinery, equipment or personnel and shall be so designed as to permit effective cleaning.
2. The premises shall be of such construction as to minimize any harbourage for insects or any contamination of dried fruits by foreign substances during the operations of stacking, handling, loading, stemming, processing, grading and storage.
3. The premises shall be so constructed as to minimize the entry of birds and rodents.
4. The premises shall be so constructed as to minimize the entry of objectionable odours, fumes, smote and dust and shall be ventilated in a manner which will quickly remove steam and obnoxious fumes.
5. The floors of the premises shall be constructed of concrete or other suitable material, which shall be impervious to insects and permit effective fumigation of fruit.
6. The premises shall be properly drained and the arrangements for the disposal of the drainage shall be such as not to contaminate the areas surrounding the premises.
7. Sufficient light shall be provided for the purpose of efficient inspection and for the operations carried out within the premises.
SCHEDULE 5—
8. The premises shall have adequate and convenient toilet facilities. The toilets shall be well lit and ventilated and shall not open directly into food handling areas. Hand washing facilities, soap and single use towels shall be provided in the toilet area and notices shall be posted in that area stating that personnel must wash their hands before leaving the area.
9. The premises shall have a dressing room and the facilities for the storage of clothing separate from the food handling area.
10. Provision shall be made to ensure that an adequate supply of pressurized cold water, and hot water, where necessary, is available in any part of the premises. The water shall be of potable quality.
11. Adequate and convenient hand washing facilities shall be provided in the vicinity of the processing line for use by personnel and in the vicinity of the inspection tables for use by officers. The facilities shall consist of pressurized water, hand basins, soap and single use towels.
12. Light bulbs and fixtures suspended over dried fruits shall be of the safety type or otherwise protected to prevent food contamination in the case of breakage.
13. Where premises are used for the processing and packing of dried fruits, machinery capable of detecting and removing foreign materials from the dried fruit during processing and packing shall be provided.
14. Except in the case of premises that are used for processing tree fruit which has been mechanically dried, each processing line along which packed processed dried fruit passes shall incorporate an electrically operated metal detector of an accuracy sufficient to record by warning signal the presence of a 5 millimetre steel ball passing through the magnetic field.
15. Facilities shall be provided for the removal and collection of dust and screenings from the dried fruit during processing.
16. Inspection tables shall be provided on each processing line for use by officers.
The tables shall be not less than 1.5 metres by 1 metre in surface area topped with while plastic coated board or other impervious material and be so constructed as to permit the quick return of the dried fruit to the container.
17. Premises engaged in the processing of dried vine fruit shall operate a gritometer capable of determining the grit content of dried vine fruit.
18. Where fumigation of dried fruit is to be undertaken, suitable equipment shall be provided.
SCHEDULE 6 Regulation 7
CONDITIONS TO BE COMPLIED WITH IN RESPECT OF OPERATIONS CARRIED ON AT PREMISES REGISTERED AS AN EXPORT ESTABLISHMENT
1. The machinery and equipment on the premises shall be maintained and operated in an efficient manner.
2. Before the commencement of each season and at such other times as an officer considers necessary the premises shall be cleaned thoroughly by spraying the walls with an insecticide approved by the Secretary. The walls shall be painted with a material approved by the Secretary when an officer considers it necessary.
3. Processed dried fruit shall be separated from unprocessed dried fruit by a distance of at least 3 metres and an effective insect barrier shall be provided between the processed fruit and the unprocessed fruit
4. Unless dried fruit is stored in refrigeration or fumigation chambers, dried fruit shall be stored at least 500 millimetres from dividing walls on the premises and an effective insect barrier shall be laid between the wall and the dried fruit.
5. Packed, processed dried fruit shall be stored under hygienic conditions. The dried fruit and a container of the dried fruit shall be protected against rodent and insect infestation and deterioration.
6. Fruit debris, fruit waste and screenings, other than that put aside for further processing, shall be removed completely from the buildings used for processing or packing dried fruit at least once daily and from the premises at least once weekly.
7. Low grade fruit and screenings awaiting further treatment shall be protected from contamination by insects, rodents and birds.
8. At least once each week the floors at the premises shall be cleaned of all fruit debris and washed. The premises shall be sprayed with an insecticide approved by the Secretary and effective insect barriers shall be laid or re-laid to protect the dried fruit from migrating insects.
SCHEDULE 6—
9. All machinery, equipment and surrounding floor area shall be thoroughly cleaned of all dried fruit and debris—
(a) where one kind of dried fruit only is being processed and packed—at least twice weekly at intervals of not more than 3 days;
(b) immediately after the processing and packing of one kind of dried fruit has been completed and before any other kind of dried fruit is passed through the machinery; and
(c) before commencing the processing and packing of dried fruit where a period of more than 3 days has elapsed since processing and packing ceased.
10. Any material or produce likely to be a source of infestation of dried fruit shall not be stored or handled in a building used for the processing or storage of dried fruit.
11. Rodenticides, fumigants, insecticides or other toxic substances shall be stored in such a manner as to prevent contamination of the dried fruit. Toxic materials shall not be stored in an area of a building where dried fruit is handled or stored.
12. Domestic animals shall be excluded, at all times, from the buildings forming part of the premises.
13. Glass containers, except where any article of glass is used for packaging, shall be excluded from the processing areas of the premises.
14. Personnel engaged in the handling, loading, grading and packing of dried fruit shall wear clean clothes appropriate to the duties being performed and maintain a high degree of personal cleanliness.
15. The eating of meals, smoking, spitting and use of chewing gum is prohibited in areas of the premises where dried fruit is processed, packed and stored.
16. A person known to be affected with a disease capable of being transmitted to food, or known to be a carrier of such a disease shall not work in any area of the premises if there is a likelihood of that person contaminating dried fruit or dried fruit contact surfaces with pathogenic organisms.
17. Hand-washing facilities and toilets shall be kept in a sanitary condition at all times.

(2) During the period of 10 years from the commencement of these Regulations, dried fruit that under these Regulations is required to be of such a size that it will pass through a riddle size specified in column 1 of the following table, shall be deemed to comply with that requirement if it passes through the riddle size specified in column 2 opposite to that first-mentioned riddle size.
