Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council,

 make the following Regulations under the Export Inspection (Service Charge) Act 1985.

1.   Commencement

1.1   These Regulations commence on 1 July 1991.

2.   Amendment

2.1   The Export Inspection (Service Charge) Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Interpretation)

3.1   Omit the regulation, substitute:

“3.

In these Regulations, unless the contrary intention appears:

‘Act’ means the Export Inspection (Service Charge) Act 1985;

‘Export Control Orders’ means the Export Control (Processed Fruits and Vegetables) Orders;

‘external export inspection service’ means an inspection service carried out by an authorised officer that:

  • (a)

    relates to the preparation of documentation for the export of the commodity; and

  • (b)

    is carried out at an office of the Department or an office of a Department of the Government of a State or Territory;

‘processed fruits and vegetables’ means fruits and vegetables declared to be prescribed goods in the Export Control Orders as in force on 1 July 1991.”.

4.   Regulation 4 (Imposition of charge)

4.1   Paragraph 4 (e):

Omit the paragraph, substitute:

“(e)

fish;

 (f) processed fruits and vegetables.”.

5.   Regulation 5 (Rates of charge)

5.1   Subregulation 5 (1):

Omit the subregulation, substitute:

“(1)

For the purposes of section 7 of the Act, the rate of charge applicable to an establishment that is registered for operations associated with the preparation of:

(a)

dairy produce is:

 (i) $101 for each half hour or part of a half hour for each attendance by an authorised officer; and

 (ii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service;

  • (b)

    dried tree fruit (other than prunes) is

 (i) $101 for each half hour or part of a half hour for each attendance by an authorised officer; and

 (ii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service;

  • (c)

    dried vine fruit is:

 (i) $101 for each half hour or part of a half hour for each attendance by an authorised officer; and

 (ii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service;

(d)

eggs is:

 (i) $101 for each half hour or part of a half hour for each attendance by an authorised officer; and

 (ii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service;

(e)

fish is:

 (i) $101 for each attendance by an authorised officer for a continuous period of half an hour; and

 (ii) $101 for each half hour or part of a half hour for each attendance by an authorised officer occurring in a prescribed monthly aggregate; and

 (iii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service;

(f)

processed fruits and vegetables is:

 (i) $101 for each half hour or part of a half hour for each attendance by an authorised officer; and

 (ii) $11 for each quarter of an hour or part of a quarter of an hour for an external export inspection service.”.
