I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Export Inspection (Service Charge) Act 1985.

1Name of Regulations

 These Regulations are the Export Inspection (Service Charge) Amendment Regulations 2001 (No. 1).

2Commencement

 These Regulations commence on gazettal.

 These Regulations are the Export Inspection (Service Charge) Regulations 1985.

Export Control Orders means orders made under the Export Control Act 1982.

processed fruits and vegetables means fruits and vegetables declared to be prescribed goods in the Export Control (Processed Fruits and Vegetables) Orders as in force on 1 July 1991.

export inspection service at an establishment means an export inspection service that is provided at an establishment by an authorised officer and is not an export inspection service referred to in subregulation 6 (1).

6Exemption from Export Control Orders

  • (1)

    For subsections 7 (1) and 7 (2) of the Act, the rate of charge for an export inspection service by an authorised officer is:

    • (a)

      for determining whether prescribed commodities may be exempted from the Export Control Orders under order 12 of the Prescribed Goods (General) Orders 1985 — the rate mentioned in subregulation (2); and

    • (b)

      for determining whether an exemption may be given, under subclause 6.1 of Schedule 7 to the Export Control (Processed Food) Orders, in relation to an establishment preparing dairy products — $75 for each half hour or part of a half hour, with a minimum charge of $150; and

    • (c)

      for determining whether an exemption may be given, under subclause 6.1 of Schedule 8 to the Export Control (Processed Food) Orders, in relation to an establishment preparing dairy products — $75 for each half hour or part of a half hour, with a minimum charge of $150.

  • (2)

    For paragraph (1) (a), the rate is:

    • (a)

      for the first service in a year — $75 for each half hour or part of a half hour, with a minimum charge of $150; and

    • (b)

      for a second service in a year — $83.30 for each half hour or part of a half hour, with a minimum charge of $250; and

    • (c)

      for a third or subsequent service in a year — $83.30 for each half hour or part of a half hour, with a minimum charge of $500.

  • (3)

    In subregulation (2):

year means the period of 12 months commencing at the beginning of the day of the making of the first application.
