266 Expo '88 (Modification of Laws) Act 1988, No. 31 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Expo '88 (Modification of Laws) Act 1988. 2. Interpretation . (1).In this Act, unless a contrary intention appears- "Expo '88" means The International Exposition on Leisure intended to be presented in Brisbane in the year 1988 under the sanction of the International Bureau of Expositions and registered by that body in accordance with the Convention relating to International Expositions of 1928 as amended by Protocols of 10 May 1948, 16 November 1966 and 30 November 1972; "the Act" means the Liquor Act 1912-1987; "the Expo period" means the period commencing on 23 April 1988 and terminating on 6 November 1988. (2) For the purposes of this Act the Expo period shall be taken to terminate on the expiration of the 6 November 1988. (3) Where any term or expression is used in this Act that is not defined in this Act, that term or expression shall, unless a contrary intention appears, have. the meaning assigned to it by the Act. 3. Licensing Commission may modify the Act. (1) Upon the application of a holder of- a licensed victualler's license; a tavern license; a limited hotel license; a club license; a restaurant license; a cultural centre license; a theatre license; a tourist park license; a bistro license; a packet license; or a cabaret license, and on payment by him of a fee of $100, the Licensing Commission may in its absolute discretion, by its order- (a) extend the hours between which; and (b) enlarge the period or periods within those hours during which,
Expo '88 (Modification of Laws) Act 1988, No. 31 267 the licensee is authorized by the Act to keep his licensed premises open for the sale of liquor, to sell or supply liquor on his licensed premises or to permit liquor to be drunk or consumed on his licensed premises, and may if it thinks fit make its order subject to conditions or restrictions or both. A licensee upon whose application an order referred to in this subsection is made is, subject to his compliance with those conditions and restrictions, authorized by that order to keep his licensed premises open for the sale of liquor and to sell and supply liquor and to permit liquor to be drunk or consumed on his licensed premises in accordance with that order during the Expo period or such shorter period as is specified in the order, any provision of the Act notwithstanding. (2) Upon the application of a holder of- a limited hotel license; a club license; a packet license; or a bistro license, and on payment of a fee of $100, the Licensing Commission may in its absolute discretion, by its order- (a) exempt the holder from the operation of all or any of the provisions of the Act that restrict the persons to whom, the places where or the circumstances in which he is authorized by the Act to sell or supply liquor or permit liquor to be drunk or consumed on his licensed premises; and (b) if it thinks fit, impose other conditions or restrictions as to those matters specified in paragraph (a). A licensee upon whose application an order referred to in paragraph (a) of this subsection is made is exempt from the operation of the provisions of the Act referred to in the order, being provisions of a description specified in that paragraph, during the Expo period or such shorter period as is specified in the order and if an order referred to in paragraph (b) of this subsection is made, that licensee is, subject to his compliance with the conditions and restrictions of a description specified in that paragraph, authorized by that order to sell and supply liquor and to permit liquor to be drunk or consumed on his licensed premises to and by persons and in places and circumstances in accordance with that order during the Expo period or such shorter period as is specified in the order, any provision of the Act notwithstanding. (3) The Licensing Commission may from time to time vary or rescind an order made under subsection (1) or (2) and an order as so varied shall be deemed to be the order made by the Commission under the relevant subsection. (4) Where the Licensing Commission makes an order under subsection (1) or (2) it may thereby require, as a condition of the order,
268 Expo '88 (Modification of Laws) Act 1988, No. 31 that the licensee upon whose application the order is granted shall comply with one or more of the provisions of the Act as specified in the order. (5) An application under subsection (1) and an application under subsection (2) may be considered and determined by the Licensing Commission as one application. (6) An application under this Act shall be made in such form and shall contain such particulars as the Licensing Commission may require: Provided that the Commission may consider and determine any application received that is not in the required form or does not contain all of the required particulars, or both. 4. Expiry of operation of Act. The provisions of this Act shall expire on the termination of the Expo period and shall thereafter cease to have force and effect.
