Expo '88 Act Amendment Act 1988, No. 76 879 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Expo '88 Act Amendment Act 1988. .2 Citation . (1) In this Act the Expo '88 Act 1984-1987 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Expo '88 Act 1984-1988. 3. Amendment of s. 50. Regulations . Section 50 of the Principal Act is amended- (a) by omitting the word "and" occurring between paragraphs (b) and (c); (b) by re-designating paragraph (c) as paragraph (d); (c) by inserting after paragraph (b) the following paragraph:- "(c) protecting an official symbol of the Authority from exploitation for profit without the Authority's consent and, to that end- (1) prohibiting the use of prescribed symbols or prescribed expressions in connexion with any business, trade, profession or occupation or for any prescribed purpose, without the Authority's consent; (ii) providing for seizure and forfeiture of goods by means of which or in relation to which a prescribed symbol or prescribed expression is used in breach of the regulations; prescribing persons who may be proceeded against (generally or in particular cases) for use of a prescribed symbol or prescribed expression in breach of the regulations;". 4. Validity of certain regulations . It shall be, deemed that the power to make regulations conferred by section 50 of the Principal Act has always included powers to make regulations protecting an official symbol of the Brisbane Exposition and South Bank Redevelopment Authority from exploitation for profit as specified in paragraph (c) of that section, and it is declared that the Expo '88 (Protection of Symbols and Expressions) Regulations 1988 made on 15 September, 1988 and published in the Gazette of 17 September, 1988 at pages 292 to 299 are and always have been valid.
