I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Explosives Act 1961.

PART 1—PRELIMINARY

Citation

 1. These Regulations may be cited as the Explosives Regulations.

Interpretation

 2. In these Regulations, unless the contrary intention appears:

“articulated vehicle” means a road vehicle that consists of:

 (a) a motor vehicle and a semi-trailer that is attached to the motor vehicle; or

(b)

a motor vehicle and 2 semi-trailers, if 1 of the semi-trailers is attached to the other semi-trailer and that other semi-trailer is attached to the motor vehicle;

“Australian Code” means the Australian Code for the Transport of Dangerous Goods by Road and Rail published in the Gazette, No. P 15, on 7 April 1987;

“authorised person” means a person who is, because of an appointment under regulation 9, an authorised person for the purposes of the provision in which the expression is used;

“Commonwealth explosives” means explosives to which Part II of the Act applies;

“Commonwealth explosives area” has the same meaning as in Part III of the Act;

“Competent Authority” means a person appointed under regulation 10 to be a Competent Authority;

“dangerous goods” means goods that bear a fire, corrosive, radioactive, explosive, poisonous, toxic, oxidising or infectious risk;

“division”, in relation to explosives specified in Schedule 1, means the U.N. hazard division in which, under regulation 4, those explosives are included;

“freight container” means a receptacle that:

(a)

is designed to be:

 (i) used repeatedly in the transportation of packaged or bulk goods; and

 (ii) transferred, in the course of that transportation, between different means of transport; and

 (iii) secured to a vehicle on which the receptacle is designed to be transported; and

(b)

has steel external surfaces; and

(c)

is not collapsible; and

(d)

is weatherproof; and

(e)

is fire resistant; and

(f)

is capable of being sealed and locked;

“group”, in relation to explosives specified in Schedule 1, means the U.N. compatibility group in which, under regulation 4, those explosives are included;

“handling” has the same meaning as in Part I of the Act;

“hazard classification code”, in relation to explosives specified in Schedule 1, means the U.N. hazard classification code applicable, under regulation 4, to those explosives;

“mechanical handling vehicle” means a forklift truck, mobile crane, gantry crane, dump truck, tractor trolley, motorised jack, a vehicle commonly known as a toodle or any other vehicle designed to be used for the mechanical handling of goods;

“motor vehicle” means a road vehicle that has, or is designed to have, as its principal means of propulsion, its own source of power, being a source of power other than human or animal power;

“net explosive quantity”, in relation to Commonwealth explosives, means the mass of the explosive matter contained in the explosives;

“N.O.S.”, in an item in Schedule 1, means not otherwise specified;

“prescribed marking”, in relation to explosives, means a marking or label that:

  • (a)

    is diamond-shaped and (except if the marking has been stencilled onto the surface to which it is affixed) of a light orange background colour; and

(b)

includes:

 (i) at the top a symbol, coloured black, depicting a bursting bomb and, below that symbol, printed in black capital letters, the word “EXPLOSIVE”; and

 (ii) in the lower half of the label, printed in black characters:

 (A) if the label relates to a quantity of explosives comprising explosives that are included in different divisions and groups—the division in which those explosives are together included in accordance with subregulation 21 (6); and

 (B) in any other case—the hazard classification code of the explosives contained in the package to which the label is affixed; and

 (c) is of an appropriate size, namely:

 (i) if the net content of the package weighs 0.5 kilogram or less, not less than15 millimetres square; and

 (ii) if the net content of the package weighs more than 0.5 kilogram but not more than 5 kilograms, not less than 20 millimetres square; and

 (iii) if the net content of the package weighs more than 5 kilograms but not more than 20 kilograms, not less than 30 millimetres square; and

 (iv) if the net content of the package weighs more than 20 kilograms, not less than 100 millimetres square; and

 (v) if the prescribed marking is affixed to the external surface of a freight container, not less than 250 millimetres square; and

 (vi) if the prescribed marking is affixed to the external surface of a road vehicle, not less than 250 millimetres square; and

 (vii) if the prescribed marking is affixed to the external surface of a rail vehicle, not less than 100 millimetres square; and

(d)

is stencilled or printed with waterproof materials onto:

 (i) the external surface of the packaging; or

 (ii) a weatherproof plate that is firmly adhered to the external surface of the packaging;

“railway authority”,in relation to a railway system, means the authority that, or the person who, has the direction and control of the railway system;

“rail vehicle” means a vehicle of a kind used for transporting goods on a railway;

“RDX” means the explosive substance known as cyclotrimethylene trinitramine;

“road vehicle” means a vehicle of a kind used for transporting goods on a road and includes a mechanical handling vehicle;

“semi-trailer” means a trailer that is so constructed that:

  • (a)

    the front of the trailer can be attached to a motor vehicle in such a manner that the trailer is superimposed on the motor vehicle at the point of attachment and pivots about that point of attachment; and

  • (b)

    if the trailer is attached to a motor vehicle, the load of the trailer is borne:

     (i) at the rear of the trailer by an axle system forming part of the trailer; and

     (ii) at the front of the trailer by the motor vehicle to which the trailer is attached;

“supervisor”,in relation to the handling of Commonwealth explosives, or a part of that handling, means a person appointed under subregulation 11 (1) to supervise that handling, or that part of that handling, as the case may be;

“the Act” means the Explosives Act 1961;

“trailer” means a road vehicle without motive power that is designed to be attached to a motor vehicle;

“U.N. classification system” means the system of classification commonly known as the United Nations classification system for dangerous goods as specified in the Recommendations on the Transport of Dangerous Goods (seventh revised edition, 1991) published by the United Nations as document ST/SG/AC.10/1/Rev.7;

“U.N. number” means a number allotted to a substance or article in accordance with the U.N. classification system;

“vessel” has the same meaning as in Part II of the Act.

Substances prescribed to be explosives

 3. For the purposes of paragraph (b) of the definition of “explosives” in section 5 of the Act, each substance or article specified in column 2 of Schedule 1 that is not capable of producing an explosive, incendiary or pyrotechnic effect is prescribed.

Classification of explosives

4. In these Regulations:

  • (a)

    explosives are classified, for the purpose of adopting, as far as practicable, the U.N. classification system, by U.N. hazard division and U.N. compatibility group; and

  • (b)

    explosives specified by name (in column 2) and U.N. number (in column 3) in an item in Schedule 1:

     (i) are included in the U.N. hazard division specified (in column 4) in that item; and

     (ii) are included in the U.N. compatibility group specified (in column 5) in that item; and

     (iii) have the hazard classification code consisting of the relevant U.N. hazard division number followed immediately by the relevant U.N. compatibility group letter.

Regulations not to apply in certain circumstances

5.

(1)   These Regulations do not apply to:

 (a) the handling of Commonwealth explosives in a place:

 (i) that is permanently occupied by a part of the Defence Force; or

(ii) that is declared by the Minister to be a defence practice area under regulation 49 of the Defence Force Regulations; or

 (iii) where explosives are manufactured or tested; or

 (iv) that is declared by the Minister in writing to be a place to which these Regulations do not apply; or

(b)

the transport, between a place where a part of the Defence Force is temporarily encamped for the purposes of a particular training exercise and a nearby place where that training exercise is being, or is to be, carried out, on a vehicle forming part of the equipment of that part of the Defence Force, of Commonwealth explosives to be used for the purposes of that training exercise; or

(c)

the transport of an explosives demolition kit by the Defence Force for the demolition of explosives in an emergency.

 (2) In this regulation, “Defence Force” includes a naval, military or air force of a country other than the Commonwealth that is in the Commonwealth or an external Territory with the approval of the Commonwealth for the purposes of, or a purpose related to, the defence of the Commonwealth.

Samples

6.

(1)  Subject to subregulation (2) and to orders made by the Minister under regulation 69, these Regulations apply without modification to samples of Commonwealth explosives.

 (2)A Competent Authority may give directions in writing in relation to the handling of samples of Commonwealth explosives of kinds that are not specified in Schedule 1, and such a declaration has effect:

  • (a)

    in relation only to the particular sample or samples specified in it; and

  • (b)

    for such period, not exceeding 90 days, as is specified in it.

Saving of laws of States and Territories

 7. These Regulations and orders made under regulation 69 are not intended to exclude or limit the concurrent operation of any law of a State or Territory.

Handling of certain explosives prohibited

 8.(1)  A person must not knowingly handle, except in accordance with the directions of a Competent Authority, packaged Commonwealth explosives, being explosives specified in Schedule 1, if:

  • (a)

    the packaging is not of a kind approved by a Competent Authority; or

  • (b)

    the hazard classification code and U.N. number applicable to the explosives, and the name of the explosives as specified in column 2 of Schedule 1, are not clearly visible on an external surface of the packaging.

 (2) A person must not handle Commonwealth explosives that are not specified in Schedule 1, except in accordance with the directions of a Competent Authority.

Authorised persons

 9. The Minister or a Competent Authority may, in writing, appoint:

(a)

a specified person; or

  • (b)

    a person for the time being holding or performing the duties of a specified office or position; or

  • (c)

    a person included in a specified class of persons;

to be an authorised person for the purposes of a specified provision of these Regulations.

Competent Authority

 10.(1)  The Minister may, in writing, appoint a person, being:

  • (a)

    a Senior Executive Officer within the meaning of the Public Service Act 1922; or

  • (b)

    a commissioned officer of the Defence Force, being an officer of at least the rank of Commodore, Brigadier or Air Commodore;

to be either or both of the following:

(c)

a Competent Authority for the purposes of regulation 69;

  • (d)

    a Competent Authority for the purposes of these Regulations, other than regulation 69.

 (2) An appointment under paragraph (1) (c) may be limited to the power to make orders in accordance with regulation 69 in relation to a particular matter, or class of matters, or to a particular place and has effect subject to such conditions or restrictions (if any), as are specified in the instrument of appointment.

Supervisors

11.

(1)  Subject to subregulations (2) and (3), an authorised person must, in relation to the handling of Commonwealth explosives to which the appointment of that authorised person relates or in relation to each part of that handling, in writing, appoint a person who:

  • (a)

    is experienced and trained in the safe handling of explosives; and

  • (b)

    has a practical knowledge of Commonwealth explosives and of the legislation relating to the handling of such explosives;

to be a supervisor of:

(c)

that handling; or

(d)

a part of that handling;

as the case requires.

 (2) If a part of the handling of Commonwealth explosives to which the appointment of an authorised person relates is concerned with the transportation of the explosives by rail, the authorised person may appoint a person, being a person having the qualifications referred to in paragraphs (1) (a) and (b), to be a supervisor of that part of the handling but the authorised person is not obliged to do so.

 (3)In the case of Commonwealth explosives to which regulation 14 applies, an authorised person is obliged under subregulation (1) to appoint a supervisor only in respect of the loading of those explosives.

 (4) An authorised person must give any necessary directions to a person appointed by the authorised person to be a supervisor under subregulation (1) or (2) in relation to the handling or that part of the handling, as the case may be, that the supervisor is appointed to supervise.

 (5) Directions given under subregulation (4) at the time the appointment is made must be in writing.

 (6) An authorised person must cause to be given to each person appointed as a supervisor under subregulation (1) or (2) a written statement to the effect that the person to whom the statement is given is a supervisor for the purposes of the handling of Commonwealth explosives or a specified part of that handling, as the case requires.

 (7) A supervisor must:

  • (a)

    attend at and supervise the handling, or the part of the handling, that the supervisor is appointed to supervise; and

  • (b)

    comply with any directions given to the supervisor under subregulation (4).

Directions by supervisors

12.

(1)  A supervisor may give directions, in relation to any part of the handling of Commonwealth explosives that the supervisor is appointed to supervise, to a person engaged in that part of the handling of those explosives.

 (2) A supervisor must, when requested to do so by a person referred to in subregulation (1), produce the written statement given to the supervisor under subregulation 11 (6).

 (3) A person must not, without reasonable excuse, fail to comply with a direction given under subregulation (1).

PART 2—ROAD TRANSPORT

Division 1—General

Interpretation

13. In this Part, unless the contrary intention appears:

“attendant” means a person who, in accordance with an arrangement made under subregulation 27 (1), accompanies a road vehicle or a convoy of road vehicles as an attendant.

Small loads

 14.(1)  This regulation applies to Commonwealth explosives that are, or are to be, loaded onto a single road vehicle if:

  • (a)

    the net explosive quantity of such portion (if any) of those explosives as comprises explosives that have the hazard classification code 1.4S does not exceed 20 kilograms; and

  • (b)

    the net explosive quantity of such portion (if any) of those explosives as comprises explosives other than explosives that have the hazard classification code 1.4S does not exceed 20 kilograms; and

  • (c)

    the net explosive quantity of any part of those explosives (other than explosives that have the hazard classification 1.4S) that consists of explosives that are included in a particular division does not exceed the mass in kilograms that is equal to the number (if any) specified, in relation to that division, in the column of Schedule 2 that relates to the group in which the explosives forming that part are included.

 (2) Regulations 13, 15, 16, 18, 20, 21 and 22, paragraphs 23 (b) and (c), regulations 24, 26, 27, 28, 29, 31 and 32, subregulation 33 (1), regulations 35 to 41 and regulations 44, 46, 47 and 49 do not apply to the handling of Commonwealth explosives to which this regulation applies.

 (3) The supervisor of the loading of Commonwealth explosives to which this regulation applies must attend at and supervise the loading of those explosives and ensure:

  • (a)

    that the road vehicle on which those explosives are loaded complies with clause 1 of Part 1 of Schedule 3; and

  • (b)

    if those explosives include explosives that are included in division 1.1 or 1.2, that:

     (i) a prescribed marking is affixed to the external surface of:

     (a) the front of the vehicle; and

     (b) each side, and the rear, of the vehicle unless the explosives are contained in freight containers to which are affixed prescribed markings that are clearly visible from each side of the vehicle and from the rear of the vehicle when the containers are loaded onto the vehicle; and

  •  (ii) the vehicle is equipped with an efficient fire extinguisher capable of extinguishing an oil or petrol fire.

Unsupervised handling prohibited

 15. A person must not handle Commonwealth explosives in connection with their transportation by road unless the handling is supervised by a supervisor.

Division 2—Loading

Supervisor’s responsibility

 16. A supervisor of the loading of Commonwealth explosives in connection with their transportation by road must ensure that the loading is conducted in accordance with this Division.

Packaging and labelling

17.

(1)Commonwealth explosives must not be loaded onto a road vehicle unless:

  • (a)

    the explosives are enclosed in packaging of a kind approved by a Competent Authority; and

  • (b)

    the external surface of that packaging is clearly marked or labelled with:

     (i) a prescribed marking in respect of the packaged explosives; and

     (ii) additional information in relation to the explosives or, if the packaging contains more than 1 type of explosives, each of the explosives contained in that packaging; and

  • (c)

    the prescribed marking and additional information are of a size and form sufficient to make the letters and figures that form part of the marking and information legible from a distance of 1 metre and clearly distinguishable from any other markings appearing on the packaging to which the prescribed marking and additional information are affixed;

  • (d)

    the prescribed marking and additional information are affixed in a position in which they will normally be visible when the package is stacked with other packages of a similar kind; and

  • (e)

    if the explosives, packaged in accordance with paragraph (a), are of a single type and are enclosed in a receptacle other than a freight container, or stacked on a pallet, as a unit load:

     (i) the outside of the unit load is clearly marked or labelled with a prescribed marking and additional information in relation to those explosives (unless the prescribed marking and additional information on the outside of the constituent packages is readily visible); and

     (ii) the unit load is loaded onto the vehicle in such a manner as to ensure that the prescribed marking and additional information are not obscured (except by another unit load of explosives of the same type); and

  • (f)

    if the explosives, packaged in accordance with paragraph (a), are of more than 1 type and are enclosed in a receptacle other than a freight container, or stacked on a pallet, as a unit load:

     (i) the outside of the unit load is clearly marked or labelled with a prescribed marking indicating the division in which those explosives are together included in accordance with subregulation 21 (6); and

     (ii) the unit load is loaded onto the vehicle in such a manner as to ensure that the prescribed marking and additional information are not obscured (except by another unit load of explosives included in the same division); and

  • (g)

    if the explosives are contained in a freight container, there is affixed firmly to the external surface of each of the 4 sides of the freight container (being, in respect of 2 sides that are opposite to each other, in diagonally opposite positions on those 2 sides):

     (i) in respect of each division of explosives in the container a prescribed marking; and

     (ii) where the container contains only 1 type of explosives, additional information in relation to those explosives; and

  • (h)

    if the explosives are contained in a freight container, the surface of the freight container immediately surrounding the areas to which the prescribed marking and additional information are (in accordance with paragraph (c)) affixed is of a colour that makes a distinct contrast with the colour of the marking and additional information.

 (2) In subregulation (1):

“additional information”, in relation to explosives, means:

  • (a)

    in the case of explosives that are specified in Schedule 1, the name and U.N. number of those explosives appearing in columns 2 and 3 of that Schedule; and

  • (b)

    in any case, such other matter (if any) as is specified by a Competent Authority in relation to those explosives;

“type”, in relation to explosives, means a type specified in a single item in Schedule 1.

Requirements for road vehicles

18.

(1)  Subject to subregulation (3), Commonwealth explosives must not be loaded onto a motor vehicle, or onto an articulated vehicle, if:

(a)

in the case of a vehicle that:

 (i) is manufactured on or after the date of commencement of these Regulations; or

 (ii) was manufactured before that date and is used primarily for the transport of explosives;

 it does not comply with Part 1 of Schedule 3; and

(b)

in any other case it does not comply with clauses 1 and 2 of Part 2 of Schedule 3.

 (2) In subregulation (1), “articulated vehicle” includes a motor vehicle, together with a semi‑trailer that is intended to be attached to that motor vehicle or to another semi‑trailer that is intended to be attached to that motor vehicle, if, at the time of loading, the semi-trailer has not been so attached.

 (3) Commonwealth explosives may be loaded onto a mechanical handling vehicle that does not comply with sub-subparagraph 7 (a) (i) (b), subparagraph 7 (a) (ii), paragraph 7 (c) or paragraph 7 (e) of Part 1 of Schedule 3.

 (4) Commonwealth explosives must not be loaded onto a trailer (including a semi-trailer) that does not comply with Part 2 of Schedule 3.

 (5) Commonwealth explosives must not be loaded onto a road vehicle that is in a dangerous or defective condition or is otherwise unsuitable for the carriage of those explosives.

Loading of explosives with other goods

 19.(1)  Commonwealth explosives must not, without the approval in writing of a Competent Authority, be loaded onto a road vehicle on which there are:

(a)

dangerous goods other than explosives; or

  • (b)

    goods (not being dangerous goods) that may aggravate the effects of any accident involving, or any initiation of, the explosives.

 (2) There must not, without the approval in writing of a Competent Authority, be loaded onto a road vehicle on which there are Commonwealth explosives either:

(a)

dangerous goods other than explosives; or

  • (b)

    goods (not being dangerous goods) that may aggravate the effects of any accident involving, or any initiation of, the explosives.

 (3) In this regulation, “goods” does not include packaging, padding, insulation, security ropes, tarpaulins or other material carried on a vehicle for the purposes of protecting or securing the vehicle’s load.

Loading of unboxed ammunition or explosives in metal containers

20. Commonwealth explosives packed in metallic or partly metallic outer containers or unboxed ammunition must not be loaded onto a road vehicle on which there are other explosives packed in non-metallic containers unless the last-mentioned explosives are separated from the first-mentioned explosives by dunnage or by goods that are not:

(a)

explosives; or

(b)

other dangerous goods.

Segregation of explosives

 21.(1)  Subject to subregulations (2) and (3), explosives specified in an item in Schedule 1 must not be loaded onto a road vehicle on which there are explosives specified in any other item in that Schedule.

 (2) Subject to subregulation (5), explosives that are included in a particular group may be loaded onto the same road vehicle as any other explosives that are included in that group.

 (3) In relation to explosives specified in an item in Schedule 1:

  • (a)

    explosives that are included in group C, D or E may be loaded onto the same road vehicle as explosives that are included in any other of those groups; and

  • (b)

    detonators that are:

     (i) included in group B; and

     (ii) packaged in a manner approved by a Competent Authority as being effective to prevent propagation;

     may be loaded onto the same road vehicle as explosives that are included in group C, D, E, F or G; and

(c)

explosive substances that:

 (i) are included in group G; and

 (ii) do not give rise to loose explosive powder; and

 (iii) are less sensitive than dry RDX to mechanical stimuli;

 may be loaded onto the same road vehicle as explosive substances that are included in group C or D; and

(d)

explosive articles that:

 (i) are included in group G; and

 (ii) do not give rise to loose explosive powder;

 may be loaded onto the same road vehicle as explosive articles that are included in group C, D, E or F; and

(e)

explosive articles that are included in group S may be loaded onto the same road vehicle as explosives that are included in a group other than group K or L; and

(f)

explosive articles that are included in :

 (i) group B, C, D, E, F or G; and

 (ii) division 1.4;

 may be loaded onto the same road vehicle as other explosive articles that are included in group B, C, D, E, F, G, N or S; and

(g)

fuzes that are included in group B may be loaded onto the same road vehicle as other explosive articles to which fuzes are designed to be attached that are included in another group; and

(h)

explosive articles that are included in group F may be loaded onto the same road vehicle as:

 (i) explosive articles included in group C, D or E; or

 (ii) explosive articles included in group G that do not give rise to loose explosive powder.

 (4)If explosive articles that are included in different groups are loaded onto the same road vehicle in accordance with paragraph (3) (d) or (h), those explosive articles must, for the purposes of this regulation, be treated as explosive articles that are included in group F.

 (5) Explosives that are included in group L must not be loaded onto the same road vehicle as other explosives that are included in group L.

 (6) If explosives loaded onto a road vehicle in accordance withsubregulation (3) comprise:

  • (a)

    explosives that are included in a division specified (in column 2) in an item in the following table; and

  • (b)

    explosives that are included in a division specified (in column 3) in that item;

the combined load must, be treated as a load of explosives that are included in the division specified (in column 4) in that item:

Load limits

22.

Commonwealth explosives must not be loaded onto a road vehicle if, when loaded:

  • (a)

    the net explosive quantity of the explosives on the vehicle would exceed 10 tonnes; or

  • (b)

    the mass of the explosives on the vehicle would exceed the load-carrying capacity of the vehicle; or

  • (c)

    except where the explosives are contained in a freight container, the height of the load above the floor of the loading space of the vehicle would exceed 2.5 metres.

Safeguarding the load etc.

23. As soon as practicable after the completion of the loading of Commonwealth explosives onto a road vehicle:

(a)

the explosives must be:

 (i) secured on the vehicle to prevent movement of the load; and

 (ii) protected against weather damage, theft, destruction or other damage or loss; and

(b)

a prescribed marking must be affixed to the external surface of the front of the vehicle; and

(c)

a prescribed marking must be affixed to the external surface of each side, and of the rear, of the vehicle unless the explosives are contained in freight containers to which are affixed prescribed markings that are clearly visible (when the containers are on the vehicle) from each side of the vehicle and from the rear of the vehicle.

Division 3—Transportation

Compliance with loading requirements

24. The supervisor of the transportation of Commonwealth explosives by road must ensure that the explosives are not transported on a road vehicle if the supervisor reasonably believes that Division 2 was not complied with in the loading of the explosives onto that vehicle and in the securing and protecting of that load.

Transport of explosives with other goods

25.

(1)  Commonwealth explosives must not, without the approval in writing of a Competent Authority, be transported on a road vehicle on which there are:

(a)

dangerous goods other than explosives; or

  • (b)

    goods (not being dangerous goods) that may aggravate the effects of any accident involving, or any initiation of, the explosives.

 (2) In this regulation, “goods” does not include dunnage, packaging, padding, insulation, security ropes, tarpaulins or other material carried on a vehicle for the purposes of protecting or securing the vehicle’s load.

Towing vehicles

 26.(1)  The supervisor of the transportation of Commonwealth explosives by road must ensure that, if a motor vehicle (other than a mechanical handling vehicle) is used to tow a trailer on which the explosives are loaded, the motor vehicle complies with clauses 1, 2 and 6 of Part 1 of Schedule 3.

(2)

The supervisor of the transportation of Commonwealth explosives by road must ensure that a motor vehicle is not, except with the approval in writing of a Competent Authority, used to tow:

(a)

more than 1 trailer on which explosives are loaded; or

  • (b)

    a trailer on which explosives are loaded together with 1 or more trailers on which are loaded dangerous goods; or

  • (c)

    a trailer on which explosives are loaded together with 1 or more trailers on which are loaded goods (not being dangerous goods) that may aggravate the effects of any accident involving, or any initiation of, the explosives.

 (3) In this regulation, “trailer” includes semi-trailer.

Attendants

27.

(1)  The supervisor of the transportation by road of Commonwealth explosives must arrange for persons, sufficient in number to enable attendants to be deployed in accordance with this regulation, to accompany the vehicle or vehicles on which the explosives are loaded, as attendants.

(2)

If the explosives are being transported on a single vehicle, the supervisor must ensure that:

  • (a)

    that vehicle is accompanied by an attendant; and

  • (b)

    the attendant is qualified to drive, and has experience in driving, vehicles of that type.

 (3)If the explosives are being transported on vehicles in a convoy, the supervisor must ensure that:

  • (a)

    if the convoy includes not more than 5 vehicles on which explosives are loaded, the convoy is accompanied by an attendant; and

  • (b)

    if the convoy includes more than 5 vehicles on which explosives are loaded:

     (i) each group of 5 such vehicles is accompanied by an attendant; and

     (ii) any additional group of less than 5 such vehicles is accompanied by an attendant: and

  • (c)

    at least 1 of those attendants is qualified to drive, and has experience in driving, vehicles of each type in the convoy on which explosives are loaded.

(4)

For the purposes of this regulation:

  • (a)

    the driver of a vehicle on which explosives are loaded may not act as an attendant; and

(b)

the supervisor may act as an attendant; and

  • (c)

    the supervisor, if acting as an attendant, is taken to accompany a group of vehicles if:

     (i) the supervisor travels in 1 of those vehicles; or

 (ii) the supervisor:

 (A) travels in a separate vehicle on which no explosives are loaded; and

 (B) is in radio contact with the drivers of the vehicles for which the supervisor is responsible as attendant.

Route

 28. The supervisor of the transportation of Commonwealth explosives on a road vehicle must ensure that the vehicle:

(a)

travels by the safest practicable route; and

  • (b)

    except if no other practicable route is available, does not travel on a road on which there is an electric tramway.

Compulsory halts

 29. Subject to regulation 30, if Commonwealth explosives are being transported on a road vehicle on a journey of more than 10 kilometres, the driver of the vehicle must, in a location in which it is safe to inspect the vehicle:

  • (a)

    after the vehicle has travelled not less than 1 kilometre and not more than 10 kilometres of the journey, or as soon thereafter as it is practicable to do so, having regard to:

 (i) safety considerations; and

 (ii) any relevant State or Territory law relating to the stopping of vehicles on roads;

 stop the vehicle for the purpose of inspecting the vehicle and the explosives; and

(b)

as soon as practicable after the end of each successive 2 hour period of travelling time of the vehicle following the stopping referred to in paragraph (a), again stop the vehicle for that purpose.

Damage etc. affecting the safety of transportation

30.

If the driver of a road vehicle being used to transport Commonwealth explosives reasonably believes that there is a defect in or damage to, the vehicle or the explosives, the driver must stop the vehicle in the safest practicable location.

Inspection of vehicles

 31.(1)  If a road vehicle being used to transport Commonwealth explosives is stopped in accordance with regulation 29 or 30, the driver of the vehicle and the attendant (if any) travelling on the vehicle must inspect the vehicle and explosives.

 (2) If, upon making an inspection under subregulation (1), the driver or attendant detects a defect in, or damage to, the vehicle or the explosives, he or she must report the matter to the supervisor of the transportation.

Repairs etc.

 32.(1)  Upon receiving a report under regulation 31, the supervisor of the transportation must investigate the matters to which the report relates and, where it appears to the supervisor that action is required to be taken in respect of the explosives or vehicle before the transportation may be resumed safely, the supervisor must:

  • (a)

    if the action can be taken at the place where the vehicle is stopped without undue delay and without endangering the safety of the public, arrange for the action to be so taken; or

(b)

in any other case, ensure that:

 (i) the vehicle is moved, as soon as practicable, to the safest practicable location;

 (ii) persons in the vicinity are warned of the hazard to them; and

 (iii) a member of the local police force is informed of the required action; and

 (iv) the consignor or consignee of the goods is informed of the required action; and

 (v) so far as possible, having regard to the safety of the public, the vehicle and explosives are dealt with in accordance with the instructions (if any) of the consignor or consignee, as the case may be.

 (2) If a road vehicle being used to transport Commonwealth explosives is stopped in accordance with regulation 29 or 30 and a defect in, or damage to, the vehicle is detected and reported to the supervisor of the transportation, the supervisor must not permit the transportation of those Commonwealth explosives by that vehicle to be resumed unless it safe to do so.

Fire

33. (1)  Subject to subregulation (2), if there is a fire on a road vehicle being used to transport Commonwealth explosives:

  • (a)

    the driver of the vehicle, any attendant on the vehicle and the supervisor of the transportation must, so far as practicable attempt to extinguish the fire; and

(b)

the supervisor:

 (i) must, so far as practicable, ensure that the requirements specified in paragraph 32 (1) (b) are observed as if regulation 32 were applicable; and

 (ii) must, if necessary, request assistance from the nearest fire brigade to extinguish the fire; and

 (iii) may give any directions that the supervisor reasonably considers necessary to the driver or to any attendant on the vehicle in relation to:

 (A) the extinction of the fire; or

 (B) the protection of life or property in the vicinity of the explosives.

 (2)If there is a fire on a road vehicle that is being used to transport a small load of Commonwealth explosives in accordance with regulation 14, the driver of the vehicle, any attendant accompanying the vehicle and any supervisor of the transportation of those explosives must, as far as practicable, do their best to extinguish the fire.

Stopping vehicles in populated areas

 34. Subject to regulations 29, 30 and 38, the driver of a road vehicle being used to transport Commonwealth explosives must not, except in compliance with a lawful traffic direction, stop the vehicle in an urban area unless:

  • (a)

    in the interests of safety, the driver considers it necessary to do so; or

  • (b)

    the supervisor of the transportation has directed the driver to do so.

Refuelling

 35.(1)  The supervisor of the transportation by road of Commonwealth explosives must ensure that a road vehicle being used to transport the explosives is not refuelled, either by the driver or another person:

(a)

if the engine of the vehicle is operating; or

  • (b)

    subject to subregulation (2), if there are buildings (other than buildings in a Commonwealth area or at premises at which motor fuel for vehicles is sold to the public) adjacent to the place where the vehicle is to be refuelled; or

  • (c)

    if there is not present at all times during the refuelling a person who has a fire extinguisher, immediately available for use, capable of extinguishing an oil or petrol fire; or

  • (d)

    if the manner of refuelling is likely to cause spilling of the fuel.

 (2) Paragraph (1) (b) does not apply to the long-distance transportation of Commonwealth explosives over any part of a route planned in accordance with regulation 28 along which it is impracticable to refuel at places of restricted public access if:

  • (a)

    the refuelling takes place at a place, or places, on the outskirts of towns and in other lightly populated areas approved by the supervisor before the commencement of the transportation; and

  • (b)

    all reasonable safety precautions have been taken, including the giving of such warning as are necessary for ensuring the safety of other persons and the protection of their property; and

  • (c)

    a supervisor is in attendance during the refuelling of each vehicle concerned.

Distance between loaded vehicles

 36.(1)  The driver of a road vehicle being used to transport Commonwealth explosives must not, so far as practicable, cause the vehicle to be within 100 metres of another vehicle whether moving or stationary, on which, to the driver’s knowledge, explosives are loaded, unless the supervisor of the transportation has directed the driver to do so.

 (2) For the purposes of this regulation, a motor vehicle and a semi-trailer or other trailer that is attached to the vehicle are taken to be 1 vehicle.

Entry of loaded vehicles into buildings

 37.(1)  The driver of a road vehicle being used to transport Commonwealth explosives must not, except as provided by subregulation (2), cause the vehicle to enter a building.

 (2) The driver of a vehicle referred to in subregulation (1) may, for the purpose of loading, unloading or refuelling the vehicle, cause the vehicle to enter a building that is:

  • (a)

    within Commonwealth land within the meaning of Part III of the Act; and

  • (b)

    designed to accommodate vehicles carrying Commonwealth explosives.

Railway level crossings

38.

(1)  The driver of a road vehicle being used to transport Commonwealth explosives must not drive the vehicle across a railway level crossing unless:

  • (a)

    if the crossing is a controlled crossing, the crossing is open to road traffic; or

(b)

if the crossing is not a controlled crossing:

 (i) the driver has first satisfied himself or herself that it is safe to drive the vehicle across the crossing; or

 (ii) where the driver is not satisfied that it is safe to drive the vehicle across the crossing, the driver, after stopping the vehicle before reaching the crossing, has been informed by the supervisor of the transportation that it is safe to drive the vehicle across the crossing.

 (2) The driver of a road vehicle being used to transport Commonwealth explosives must not drive the vehicle onto a railway level crossing if it is likely that the driver may be required to stop the vehicle on the crossing.

 (3) The driver of a road vehicle being used to transport Commonwealth explosives, not being a vehicle having automatic transmission, must not, so far as practicable, while driving the vehicle across a railway level crossing, change the gear in which the vehicle is being driven.

 (4) In subregulation (1), “controlled crossing” means a railway level crossing at which there are gates, barriers, lights, bells, signals or other means under the control of the railway authority by which the crossing may be closed to road traffic for the passage of railway traffic through the crossing.

Speed limit

 39.(1)  Subject to subregulation (2), the driver of a road vehicle being used to transport Commonwealth explosives may, if other circumstances make it safe to do so, drive the vehicle on a road in relation to which a maximum speed limit is applicable at a speed not exceeding the maximum speed at which that vehicle could, if not loaded with explosives, lawfully be driven on that road.

 (2) If the supervisor of the transportation directs a driver of a road vehicle being used to transport Commonwealth explosives to drive at a speed not exceeding a specified speed, the driver must drive the vehicle at a speed not exceeding that specified speed.

Restriction on transportation of explosives at night

 40. The supervisor of the transportation of Commonwealth explosives by road must ensure that the road vehicle being used to transport the explosives is not driven on a road between sunset and sunrise unless the surface of the prescribed markings required to be affixed to the external surface of the road vehicle or the freight container under regulation 23 has been specially treated to enhance its reflective qualities in order to make the markings more easily visible during hours of darkness.

Poor visibility

 41.(1)  Except when directed to do so by the supervisor of the transportation, the driver of a road vehicle being used to transport Commonwealth explosives must not drive the vehicle on a road at a time when:

  • (a)

    if a person were at a distance of 50 metres directly in front of the vehicle; or

  • (b)

    if another vehicle were at a distance of 100 metres directly in front of the vehicle;

that person or that other vehicle would, because of the poor visibility prevailing at that time, not be visible with the assistance of any appropriate artificial illumination available to that driver.

 (2) If it appears to the supervisor of the transportation of Commonwealth explosives by road to be necessary, in interests of public safety or security, that a road vehicle being used to transport the explosives be driven at a time referred to in subregulation (1), the supervisor may direct the driver to drive the vehicle at that time, subject to such restrictions (if any) as the supervisor considers necessary in the circumstances.

Prohibition against explosives in cabin of vehicles

 42. A person must not cause Commonwealth explosives to be placed or carried in the cabin of a road vehicle unless that vehicle has no space designed for the carriage of goods that is separate from the cabin.

Carriage of fuel

43. The driver of a road vehicle being used to transport Commonwealth explosives must not permit fuel for that vehicle or any other vehicle to be carried on that vehicle other than in:

(a)

the fuel tank of the vehicle; or

  • (b)

    a receptacle that is designed to carry fuel of that kind and is secured to the vehicle otherwise than in the loading space of the vehicle.

Supervisor to inform driver and attendant of certain matters

 44. The supervisor of the transportation of Commonwealth explosives on a road vehicle must ensure that the driver of the vehicle and any attendant who travels on the vehicle are aware of:

(a)

the hazard classification code of the explosives; and

  • (b)

    the likely effect of fire on the explosives and the action to be taken in the event of such a fire; and

  • (c)

    the action to be taken in the event of damage to, or spilling of, the explosives.

Division 4—Unloading

Inspection of explosives

45. The supervisor of the unloading of Commonwealth explosives from a road vehicle must:

(a)

inspect:

 (i) the vehicle and explosives as soon as practicable after the vehicle arrives at the place at which the explosives are to be unloaded; and

 (ii) the explosives during the unloading;

 in order to determine whether any of the explosives are   damaged or stolen; and

  • (b)

    take such action (if any) as is necessary in the circumstances.

Measures to be taken after unloading

 46. As soon as practicable after Commonwealth explosives have been unloaded from a road vehicle, the supervisor of the unloading must:

(a)

cause the loading space of the vehicle to be cleaned; and

  • (b)

    cause the warning signs affixed to the vehicle in accordance with paragraphs 23 (b) and (c) to be covered or removed.

Division 5—Miscellaneous

Vehicle engine not to operate during loading etc.

47. A person must not load Commonwealth explosives onto a road vehicle, or unload Commonwealth explosives from a road vehicle, while the engine of the vehicle is operating, unless that engine is providing power for the purpose.

Vehicles not to be left unattended etc.

 48. A supervisor of the handling of Commonwealth explosives, or of a part of that handling, must ensure that, during that handling, or that part of that handling, as the case may be:

  • (a)

    a road vehicle on which the explosives are loaded is not left unattended; and

  • (b)

    the explosives, other than unboxed explosives, are not left unprotected from the weather.

Certain persons not to attend loading etc.

 49. If a road vehicle being used to transport Commonwealth explosives is not within a Commonwealth explosives area, a person other than:

(a)

the driver of the vehicle; or

(b)

an attendant; or

(c)

a supervisor of the handling of the explosives; or

  • (d)

    a person handling the explosives under the supervision of the supervisor;

must not:

(e)

during the transportation, be in or on the vehicle; and

  • (f)

    during any other part of the handling, be in, on or in the vicinity of the vehicle;

without the consent of the supervisor.

PART 3—RAIL TRANSPORT

Division 1—General

Interpretation

50. In this Part, unless the contrary intention appears:

“covered van” means a rail vehicle having a door, or doors, and permanently fixed outer walls and roof;

“flat wagon” means a rail vehicle having no outer walls or roof;

“goods train” means a train other than a passenger train;

“guard’s van” means a rail vehicle in which a guard travels or is intended to travel;

“locomotive” includes a self-propelled rail vehicle;

“passenger train” means a train used for transporting passengers, whether or not it is also used for any other purpose.

Small loads

 51.(1)  This regulation applies to Commonwealth explosives that are, or are to be, loaded onto a single rail vehicle if:

  • (a)

    the net explosive quantity of such portion (if any) of those explosives as comprises explosives that have the hazard classification code 1.4S does not exceed 20 kilograms; and

  • (b)

    the net explosive quantity of such portion (if any) of those explosives as comprises explosives other than explosives that have the hazard classification code 1.4S does not exceed 20 kilograms; and

  • (c)

    the net explosive quantity of any part of those explosives (other than explosives that have the hazard classification 1.4S) that consists of explosives that are included in a particular division does not exceed the mass in kilograms that is equal to the number (if any) specified, in relation to that division, in the column of Schedule 2 that relates to the group in which the explosives forming that part are included.

 (2)This Part (other than this regulation and regulation 63) does not apply to Commonwealth explosives to which this regulation applies.

 (3) A supervisor, or if no supervisor has been appointed, a railway authority must not permit Commonwealth explosives to which this regulation applies that are taken to be included in division 1.1 or 1.2 to be transported on a rail vehicle unless:

  • (a)

    a prescribed marking is affixed to the external surface of the front of the train of which the vehicle forms part, each side of the vehicle and the rear of the train; and

  • (b)

    the vehicle, or the train, is equipped with an efficient fire extinguisher capable of extinguishing an oil or petrol fire.

Supervision of loading and unloading

52. A person must not load Commonwealth explosives onto, or unload Commonwealth explosives from, a rail vehicle unless that loading or unloading is supervised:

  • (a)

    if that loading or unloading is made necessary, during the transportation of the explosives by rail, because of:

     (i) an accident involving the train by which the explosives are being transported; or

     (ii) damage to, or a defect in, the rail vehicle on which the explosives are being transported; or

     (iii) a transhipment of the explosives by a railway authority made necessary by a change in the gauge of the railway on the route over which the explosives are being transported;

     by an officer or employee of the railway authority; or

(b)

in any other case, by a supervisor.

Division 2—Loading

Supervisor’s responsibility

53. A supervisor of the loading of Commonwealth explosives in connection with their transportation by rail must ensure that the loading is conducted in accordance with the requirements of this Division.

Packaging and labelling

 54. Regulation 17 applies to the loading of Commonwealth explosives onto a rail vehicle as if a reference in that regulation to a road vehicle were a reference to a rail vehicle.

Requirements for rail vehicles

 55.(1)  Commonwealth explosives must not be loaded onto a rail vehicle that:

(a)

is not in good working order; or

  • (b)

    has plain-bearing axle boxes designed to be lubricated by grease; or

(c)

is not a covered van, unless:

 (i) if a covered van is unavailable or unsuitable for the transportation of the explosives, the explosives are so loaded as to be protected from the weather; or

 (ii) if the vehicle is a flat wagon, the explosives are contained in a freight container that is securely fixed to the flat wagon; or

 (iii) the explosives being loaded are of a kind that does not require protection from the weather.

 (2) Commonwealth explosives contained in a freight container must not be loaded on to a rail vehicle unless the vehicle is:

(a)

properly constructed or properly adapted; and

  • (b)

    properly equipped;

    for carrying freight containers of a kind that includes that container.

Rail vehicles not to carry other dangerous goods

56.

(1)  Commonwealth explosives must not be loaded onto a rail vehicle on which there are dangerous goods other than explosives.

 (2) Dangerous goods other than explosives must not be loaded onto a rail vehicle on which there are Commonwealth explosives.

 (3) Commonwealth explosives must not, without the approval of a Competent Authority, be loaded onto a rail vehicle on which there are loaded goods (not being dangerous goods) that may aggravate the effects of any accident involving, or any initiation of, the explosives.

 (4) In this regulation, “goods” does not include dunnage, packaging, padding, insulation, security ropes, tarpaulins or other material carried on a vehicle for the purpose of protecting or securing the vehicle’s load.

Segregation of explosives

57.

Regulation 21 applies to the loading of Commonwealth explosives onto a rail vehicle as if a reference in that regulation to a road vehicle were a reference to a rail vehicle .

Loading of unboxed ammunition or explosives in metal containers

58. Commonwealth explosives packed in metallic or partly metallic outer containers or unboxed ammunition must not be loaded onto a rail vehicle on which there are other explosives packed in non-metallic containers unless those other explosives are separated from the first-mentioned explosives by dunnage or goods that are not:

(a)

explosives; or

(b)

other dangerous goods.

Safeguarding the load etc.

 59. As soon as practicable after the completion of the loading of Commonwealth explosives onto a rail vehicle:

(a)

the explosives must be:

 (i) secured on the vehicle to prevent movement of the load; and

 (ii) protected against weather damage, theft, destruction or other damage or loss: and

(b)

a prescribed marking must be affixed to the external surface of each side of the vehicle.

Division 3—Transportation

Supervision of transportation by rail

 60. A supervisor of the transportation of Commonwealth explosives by rail or, if no supervisor has been appointed, the railway authority must ensure that the transportation is conducted in accordance with this Division.

Maximum loads

 61.(1)  Commonwealth explosives must not be transported on a rail vehicle if:

  • (a)

    the net explosive quantity of the explosives exceeds 40 tonnes; or

  • (b)

    the mass of the explosives exceeds the load-carrying capacity of the vehicle.

 (2) Commonwealth explosives must not be transported by a train if the net explosive quantity of the explosives on the train exceeds 500 tonnes.

Explosives not to be carried on passenger trains

 62.(1)  Subject to subregulations (2) and (3), a rail vehicle on which Commonwealth explosives are loaded must not form part of a passenger train.

 (2) A guard’s van on which Commonwealth explosives bearing the hazard classification code 1.4S are loaded may form part of a passenger train if the net explosive quantity of those explosives does not exceed 20 kilograms.

 (3) A locomotive or a guard’s van on which Commonwealth explosives commonly used for railway signalling purposes and having the U.N. number 0092, 0192, 0193, 0492 or 0493 are loaded may form part of a passenger train.

Segregation etc. of explosives on goods trains

63. (1)  A rail vehicle on which Commonwealth explosives are loaded must not form part of a goods train unless the vehicle is separated from the locomotive, and from the guard’s van (if any) by a distance of not less than 6 metres.

 (2) Except with the approval in writing of a Competent Authority, a rail vehicle on which Commonwealth explosives are loaded must not form part of a goods train if:

  • (a)

    another rail vehicle forming part of that train is loaded with dangerous goods other than explosives; or

  • (b)

    another rail vehicle forming part of that train is loaded with goods, not being dangerous goods, that may aggravate the effects of any accident involving, or initiation of, the explosives.

Division 4—Unloading

Inspection of explosives

 64. The supervisor of the unloading of Commonwealth explosives from a rail vehicle must:

(a)

inspect:

 (i) the vehicle and explosives as soon as practicable after the vehicle arrives at the place at which the explosives are to be unloaded; and

 (ii) the explosives during the unloading;

 in order to determine whether any of the explosives are damaged or stolen; and

(b)

take such action (if any) as is necessary in the circumstances.

Unloading and storage of explosives

 65. The supervisor of the unloading of Commonwealth explosives from a rail vehicle must ensure that the explosives are removed as soon as practicable from the vehicle to a place specified by the supervisor that is suitable for the storage of the explosives.

Measures to be taken after unloading

 66. As soon as practicable after Commonwealth explosives have been unloaded from a rail vehicle, the supervisor of the unloading must:

(a)

cause the loading space of the vehicle to be cleaned; and

  • (b)

    cause the warning signs affixed to the vehicle in accordance with regulation 59 to be covered or removed.

Division 5—Miscellaneous

Certain persons not to attend loading etc.

 67. If Commonwealth explosives are being loaded onto, or unloaded from, a rail vehicle, a person other than:

(a)

a supervisor of the handling of the explosives; or

  • (b)

    where no supervisor has been appointed, an officer or employee of the railway authority; or

  • (c)

    a person handling the explosives under the supervision of the supervisor or an officer or employee of the railway authority, as the case may be;

must not be in, on or in the vicinity of the vehicle without the consent of the supervisor or the officer or employee of the railway authority, as the case may be.

PART 4—BERTHING OF VESSELS

Directions

68.

(1)  Subject to subregulations (2) and (3), the Minister or an authorised person may direct, by order, that a vessel in which Commonwealth explosives are, or are to be, loaded may, for a purpose specified in the order, be berthed in a port specified in the order.

 (2) If a direction under subregulation (1) is given by an authorised person, the direction must not be given in respect of a vessel if, in respect of the explosives loaded, or to be loaded, onto the vessel:

(a)

the gross mass of the explosives exceeds 5,000 tonnes; or

  • (b)

    the gross mass of the explosives exceeds 1,000 tonnes and the net explosive quantity of such of those explosives as are included in division 1.1, division 1.2, division 1.5 or division 1.6 exceeds, in total, 200 tonnes; or

  • (c)

    the gross mass of the explosives exceeds 1,000 tonnes and the net explosive quantity of such of those explosives as are included in division 1.2 exceeds 500 tonnes; or

  • (d)

    the gross mass of such of those explosives as are included in division 1.3 exceeds 2,000 tonnes.

 (3) If:

  • (a)

    the port specified in an order made under subregulation (1) is a prescribed port; and

  • (b)

    the vessel to which the order relates is not provided with a berth in the port or is provided with a berth in the port that, in the reasonable opinion of the person who made the order, is not suitable for the purpose specified in the order;

that person may, by order, give such directions as are necessary for ensuring that the vessel is, for such period as is necessary, provided with a berth in the port that is so suitable.

 (4) A direction under this regulation may be given to a specified person or to persons generally.

 (5) A person who gives a direction under this regulation to a specified person must give that person a copy of the order by which the direction is given.

 (6) For the purposes of paragraph 11 (2) (a) of the Act, each of the following ports (in this regulation referred to as a “prescribed port”) is prescribed:

(a)

Fremantle;

(b)

Geraldton.

PART 5—ORDERS

Orders

 69.(1)  If the Minister or a Competent Authority is satisfied that there are circumstances requiring special provision of a temporary nature to be made under this regulation, the Minister or a Competent Authority may make provision, by order:

  • (a)

    in relation to, or in relation to any matter incidental to, the handling of Commonwealth explosives; and

  • (b)

    in relation to safety measures to be observed at, in or on a place, vehicle, aircraft or vessel at, in, on or in the vicinity of which there are Commonwealth explosives.

 (2) If an order is expressed to take effect on a day that is later than the day on which the order is notified in the Gazette, the order takes effect on that later day.

 (3) If an order made by the Minister is inconsistent with a provision of these Regulations, the order prevails and the provision of these Regulations is, to the extent of the inconsistency, of no effect.

 (4) If an order made by a Competent Authority is inconsistent with a provision of these Regulations, the provision of these Regulations prevails and the order is, to the extent of the inconsistency, of no effect.

 (5)An order under this regulation ceases to have effect at the end of 3 months after the day on which it takes effect or at the end of such shorter period as is specified in the order, unless sooner revoked.

PART 6—COMMONWEALTH EXPLOSIVES TRANSPORT

COMMITTEE

Interpretation

 70. In this Part, unless the contrary intention appears:

“Committee” means the Commonwealth Explosives Transport Committee established by these Regulations;

“Deputy Senior Member” means a person appointed under subregulation 75 (2) to be the Deputy Senior Member;

“member” means a member of the Committee;

“Senior Member” means a person appointed under subregulation 75 (1) to be the Senior Member of the Committee.

Commonwealth Explosives Transport Committee

71. There is established a committee by the name of the Commonwealth Explosives Transport Committee.

Function of Committee

72. The function of the Committee is to advise the Minister on matters relating to the transport and handling of Commonwealth explosives.

Powers of Committee

 73. The Committee has power to do all things that are necessary or convenient to be done for or in connection with the performance of its function.

Membership

 74.(1)  The Committee consists of not fewer than 6 members, each member being:

(a)

a person appointed in writing by the Minister; or

  • (b)

    a person for the time being holding or performing the duties of an office or position specified in writing, for the purposes of this regulation, by the Minister.

 (2) A member of the Committee holds office during the pleasure of the Minister.

Senior Member and Deputy Senior Member

 75.(1)   The Minister is to appoint 1 of the members to be the Senior Member of the Committee.

 (2) The Minister is to appoint 1 of the members, other than the member appointed to be the Senior Member, to be the Deputy Senior Member of the Committee.

 (3) If a person holding office as Senior Member or Deputy Senior Member ceases to be a member, the person ceases to be the Senior Member or Deputy Senior Member, as the case may be.

Resignation

76.A member referred to in paragraph 74 (1) (a) may resign by writing signed by the member and delivered to the Minister.

Deputies of members

 77.(1)  A member, other than the Senior Member, may nominate a person for appointment as the deputy of the member but the appointment is not effective until the member has given notice of the nomination to the Senior Member and the Senior Member has, in writing, approved the appointment.

 (2) The appointment of a person as the deputy of a member may be revoked by the Senior Member by notice in writing given to the deputy.

 (3) A deputy of a member may resign by writing signed by the deputy and delivered to the Senior Member.

 (4) A deputy of a member is entitled, in the absence of the member of whom he or she is the deputy from a meeting of the Committee, to attend that meeting and, when so attending, is taken to be a member.

Meetings

 78.(1)  The Senior Member is to convene such meetings of the Committee as are necessary for the performance of its function.

 (2) If:

(a)

the Senior Member is:

 (i) absent from duty through illness; or

 (ii) absent from Australia; or

 (iii) for any other reason, unable to perform the duties of the office of Senior Member; or

  • (b)

    there is a vacancy in the office of Senior Member;

the Deputy Senior Member is to convene such meetings of the Committee as are necessary for the performance of its function.

 (3) The Senior Member or, in the Senior Member’s absence from a meeting of the Committee, the Deputy Senior Member presides at all meetings of the Committee at which he or she is present.

 (4) If the Senior Member and the Deputy Senior Member are not present at a meeting of the Committee, the members present must elect 1 of their number to preside at that meeting.

 (5) At a meeting of the Committee, a quorum is constituted by 4 members.

 (6) A question arising at a meeting of the Committee is determined by a majority of votes of the members present and voting.

 (7) The person presiding at a meeting of the Committee has a deliberative vote and, in the event of equality of votes, also has a casting vote.

PART 7—MISCELLANEOUS

Packing explosives for transportation

 79. A person who packs or otherwise prepares Commonwealth explosives for transportation must ensure that the explosives are:

  • (a)

    in a condition in which they may be transported safely; and

  • (b)

    packed in packaging of a kind approved by a Competent Authority.

Intoxicating liquor and drugs

 80.(1)  Subject to subregulation (2), a person must not carry intoxicating liquor, or permit intoxicating liquor to be carried, in or on a road vehicle or a rail vehicle on which Commonwealth explosives are loaded.

 (2) Subregulation (1) does not apply to the carrying of intoxicating liquor by a passenger on a passenger train.

 (3) A person engaged in the handling of Commonwealth explosives must not be in possession of, consume, or be under the influence of:

(a)

any intoxicating liquor; or

  • (b)

    any drug (including a drug prescribed by a doctor for that person’s use) that could affect the safe handling of the explosives by that person.

 (4) For the purposes of subregulation (3), a person is taken to be under the influence of intoxicating liquor if the concentration of alcohol in the person’s blood is equal to, or more than, 0.02 grams of alcohol per 100 millilitres of blood.

Prohibition against smoking and other fire hazards

 81.(1)   A person must not:

  • (a)

    within 20 metres of a road vehicle or a rail vehicle on which Commonwealth explosives are loaded:

 (i) smoke; or

 (ii) be in possession of, or create or use, any fire or naked light; or

(b)

carry on any other activity that would be likely, having regard to the proximity of the vehicle, to result in a fire or explosion affecting the explosives on the vehicle.

 (2) A person must not carry onto, or take within 20 metres of, a road or rail vehicle on which Commonwealth explosives are loaded a cigarette or article used in connection with smoking, unless the cigarette or article is locked in a metal box that is red.

 (3) A person must not carry the box, or permit the box to be carried:

  • (a)

    on a road vehicle on which Commonwealth explosives are loaded, elsewhere than in the cabin of the vehicle; or

  • (b)

    on a rail vehicle on which Commonwealth explosives are loaded, elsewhere than in a separate area, if any, within a guard’s van, being a vehicle, or a portion of a vehicle, designed for accommodating a guard.

 (4) A person must not open the box on, or within 20 metres of, a road or a rail vehicle on which Commonwealth explosives are loaded.

Handling of certain explosives

 82.(1) In this regulation,“prescribed explosives” means:

  • (a)

    Commonwealth explosives, the net explosive quantity of which exceeds 5 kilograms, that are:

 (i) included in groups G and H; and

 (ii) capable of producing toxic smoke or a lachrymatory effect; and

(b)

Commonwealth explosives that are included in group L or group K.

 (2) A supervisor of the handling of prescribed explosives must not handle those explosives, or permit another person to handle those explosives, unless there are present during the handling not less than 2 other persons (in this regulation referred to as an “escort party”) equipped with such of the following equipment as is specified, in relation to that handling, by an authorised person, in the quantities specified by the authorised person:

(a)

suitable protective clothing and breathing apparatus;

  • (b)

    suitable equipment and materials to neutralise the effect of the explosives or extinguish any fire in the explosives;

(c)

first aid equipment and supplies;

(d)

any other necessary equipment.

 (3) If prescribed explosives are being transported by road, the supervisor of the transportation must ensure that the escort party accompanying the explosives travels on a vehicle on which there are no explosives.

 (4) The supervisor of the transportation of prescribed explosives by a road vehicle must not permit a person to ride on the vehicle when those explosives are on the vehicle, unless the person is equipped with suitable breathing apparatus.

 (5) The supervisor of the transportation of prescribed explosives by rail must ensure that each member of the crew of the train on which those explosives are being transported is equipped with suitable breathing apparatus.

 (6) As soon as practicable after each part of the handling of prescribed explosives has been completed, the supervisor of that part of the handling must cause all vehicles, equipment, appliances and materials used in that part of the handling to be inspected and, if necessary, decontaminated.

 (7) If no supervisor of the transportation of Commonwealth explosives by rail has been appointed, a reference in this regulation to the supervisor of the transportation of prescribed explosives by rail is read as a reference to the relevant railway authority.

Damaged packaging

83. A person who, during any part of the handling of Commonwealth explosives, handles Commonwealth explosives in packaging that is damaged or from which the explosives have leaked or spilled must:

(a)

notify the supervisor of that part of the handling; and

  • (b)

    carry out all directions that the supervisor gives to him or her as a consequence of being so notified.

Certificate that containers are free from explosives

84.

(1)   A Competent Authority may, in writing, appoint such persons as are necessary to certify that containers (including packaging) that have contained Commonwealth explosives are free from explosives.

 (2) If a person appointed under subregulation (1) inspects a container that has contained Commonwealth explosives, the person must, where the container is free from explosives, issue a written certificate to that effect.

 (3) If a person appointed under subregulation (1) issues a certificate that a container is free from explosives, the person must remove from the container, or deface or cover, a label or marking on the container that specifies a hazard classification code or U.N. number.

Empty containers not certified as free from explosives

85.

A container or package that has contained Commonwealth explosives, or purports to have contained Commonwealth explosives, and has not been certified as free from explosives in accordance with regulation 84 must be handled as if it contains explosives and any label, prescribed marking or additional marking affixed to the container or package must be left intact and kept unobscured.

Delegation

 86.(1)  The Minister may, by signed instrument, delegate to a Competent Authority all or any of the powers and functions of the Minister under these Regulations other than the power of the Minister to make orders under regulation 69.

 (2) A Competent Authority may, by signed instrument, delegate to an authorised person all or any of the powers and functions of the Competent Authority under these Regulations other than:

  • (a)

    the Competent Authority’s power to make orders under regulation 69; and

  • (b)

    the power to appoint a person to be an authorised person under regulation 9.

Repeal

 87. Statutory Rules 1962 No. 63 and 1965 No. 16 are repealed.

SCHEDULE 3

Subregulations 14 (3), 18 (1),

  (3) and (4) and 26 (1)

REQUIREMENTS FOR ROAD VEHICLES USED IN TRANSPORTING COMMONWEALTH EXPLOSIVES

PART 1—MOTOR VEHICLES AND ARTICULATED VEHICLES

1.

The vehicle must be:

(a)

registered in a State or Territory; or

  • (b)

    registered under the system of registration administered by:

 (i) the Department of Administrative Services; or

 (ii) the Department of Defence.

 
  • 2.

    The vehicle must be maintained in a safe operating condition.

     
  • 3.

    The vehicle must not use a fuel other than diesel fuel or petrol.

 4.

Each electric storage battery on the vehicle must be located in a well ventilated place that:

  • (a)

    is designed to prevent any short circuit in the battery or battery connections; and

(b)

does not form part of the loading space of the vehicle.

 5.

All electrical circuits on or under the loading space of the vehicle must be protected by fuses or circuit breakers.

 6.

The exhaust system of the vehicle must be so designed and fitted that it is not likely, directly or indirectly, to cause ignition of any part of the load.

 7.

The vehicle must have:

  • (a)

    not fewer than 3 efficient fire extinguishers, consisting of, or including:

     (i) an efficient fire extinguisher, fitted in the cab of the vehicle or adjacent to it, being:

     (A) a gas fire extinguisher of not less than 1.5 kilogram capacity; or

     (B) a dry-powder fire extinguisher of a sufficient capacity to be capable of extinguishing an incipient fire in the vehicle’s motor or load and designed to extinguish liquid-hydrocarbon fires; and

     (ii) at least 2 water-delivering fire extinguishers, each having a capacity of not less than 9 litres; and

  • (b)

    an efficient hazard-warning system capable of operating all direction-turn signal lamps on the vehicle simultaneously; and

     (c) a spare wheel suitable for use as a load-bearing wheel on the vehicle; and

     (d) equipment suitable for use in replacing a wheel and tyre on the vehicle; and

  • (e)

    not less than 3 portable warning signs, suitable for use in the event of the vehicle breaking down, being double-sided signs designed to stand erect on the road surface around a broken-down vehicle:

     (i) in the form of an equilateral triangle having sides not less than 29 centimetres in length and a border not less than 4.5 centimetres in width around the perimeter of the triangle; and

     (ii) with red reflective material or button reflectors on both sides of the border of the triangle that would be clearly visible at night, at a distance of 180 metres, to the driver of an approaching vehicle using its headlights.

PART 2—TRAILERS

1.

The trailer must be:

(a)

registered in a State or Territory; or

  • (b)

    registered under the system of registration administered by:

 (i) the Department of Administrative Services; or

 (ii) the Department of Defence.

 2.

The trailer:

(a)

must be fixed to the towing vehicle by:

 (i) a pintle-hook system for trailer attachment; or

 (ii) a b all-joint system for trailer attachment; or

 (iii) an automatic pin-coupling system for trailer attachment; and

(b)

must:

 (i) have an efficient braking system designed to stop the trailer if it should become separated from the towing vehicle; or

 (ii) be fixed to the towing vehicle by 2 safety chains.

 3.

If the trailer is designed to carry a load in excess of 1 tonne, the trailer must have not fewer than:

(a)

4 wheels; and

(b)

2 single-axle systems.

 4.

All electrical wiring on the trailer must be enclosed in conduit of seamless metal or heavy-duty plastic.
