Explosives (Commonwealth Games Transportation Restrictions) Amendment Regulation 2018 (Qld)

1   Short title

This regulation may be cited as the Explosives (Commonwealth Games Transportation Restrictions) Amendment Regulation 2018.

2   Commencement

This regulation commences on 25 March 2018.

3   Regulation amended

This regulation amends the Explosives Regulation 2017.

4   Amendment of s 136 (Conditions for transporting explosives under s 50(3) of Act)

Division 8 Transport restrictions for Commonwealth Games

145P   Definitions for division

In this division—

relevant explosive means—

(a)a class 1 explosive other than—

(i)an unrestricted firework; or

(ii)an explosive designed to activate an airbag, seatbelt, fire extinguisher or parachute; or

(iii)an electric match; or

(iv)a safety fuse or igniter; or

(v)a power device cartridge; or

(b)a class 2 to 9 explosive; or

(c)security sensitive ammonium nitrate.

restricted area means an area shown as a restricted area on a map in schedule 6A.

145Q   Condition for authorities to transport explosives—Act, s 18

(1)For section 18(1) of the Act, the condition stated in subsection (2) is prescribed for an authority that authorises the transport of a relevant explosive in a vehicle or boat.

(2)The authority holder must not transport the relevant explosive in any quantity in a restricted area during the period between 25 March 2018 and 18 April 2018.

(3)Subsection (2) does not apply to the holder of a fireworks contractor licence or a fireworks operator licence transporting a relevant explosive in a vehicle or boat if the transport is authorised by the chief inspector.

145R   Condition for transporting explosives under s 50(3) of Act

(1)For section 50(3)(b) of the Act, the condition stated in subsection (2) is prescribed for the transport of a relevant explosive.

(2)A person must not transport a relevant explosive in any quantity in a restricted area during the period between 25 March 2018 and 18 April 2018.
