Explosives Amendment Regulation (No. 1) 2012 [s 1] 1 Short title This regulation may be cited as the Explosives Amendment Regulation (No. 1) 2012 . 2 Regulation amended This regulation amends the Explosives Regulation 2003 . 3 Amendment of s 64 (Chief inspector may impose interim explosives limits) Section 64(2), ‘levels’— omit, insert— ‘limits’. 4 Amendment of s 68 (Manufacture of explosives) Section 68(e)— omit, insert— ‘(e) for an explosive that is a mixture of ammonium nitrate and fuel oil, with or without other substances— (i) add a colouring agent that is soluble in the fuel oil before mixing the ammonium nitrate and fuel oil; and (ii) ensure the explosive is manufactured as required under AS 2187, part 2 or alternative safety measures for the standard; and’. 5 Amendment of s 78C (Restriction on holder of licence selling security sensitive explosive to existing client) Section 78C(5), ‘subsection (3)’— omit, insert— ‘subsection (4)’. Explosives Amendment Regulation (No. 1) 2012 [s 6] 6 Amendment of s 84 (Definitions for div 2) Section 84, definition required places , paragraph (c), before ‘cupboard’— insert— ‘a’. 7 Amendment of s 104 (How manager must deal with request to store explosive etc.) Section 104(2)(e)— omit, insert— ‘(e) for a request to store an explosive—that the explosive must, unless an exemption is given by the chief inspector for section 105(1)(d), be— (i) properly classified, packaged, marked and labelled as required under the Australian explosives code or the Australian dangerous goods code; and (ii) in a safe condition for storage, handling and transport;’. 8 Amendment of s 105 (Requirements for explosives stored at government magazine) (1) Section 105(1)(c)— renumber as section 105(1)(d). (2) Section 105(1)— insert— ‘(c) the explosive is— (i) an authorised explosive; or (ii) an unauthorised or prohibited explosive for which the chief inspector has issued to the applicant an explosives trial approval for the storage of the explosive; and’.
