s1 3 s3 Explosives Amendment (No. 1) No. 302, 1995 ˙ Short title 1. This regulation may be cited as the Explosives Amendment Regulation (No. 1) 1995 . ˙ Regulations amended 2.(1) This regulation (other than schedule 2) amends the ExplosivesRegulation 1955 . (2) Schedule 2 amends the Explosives (Fruit Ripening) Regulation 1955 . ˙ Amendment of s 2 (Definitions) 3.(1) Section 2, definition “approved form” omit. (2) Section 2— insert— “approved form” means a form approved by the chief executive. “dangerous substance” , for part 9, means— (a) coal gas; or (b) ethylene; or (c) acetylene; or (d) another unsaturated organic compound or substance that is claimed to have ripening or colouring properties. “explosive of doubtful quality” , for schedule 3, means an explosive that an inspector considers does not have the composition, quality and character mentioned for the explosive in the register of explosives. “travel expenses” of an inspector who has to examine, test, inspect or sample explosives under the Act, for schedule 3, means— (a) the cost of travel; and (b) the expenses the inspector is entitled to under the Public ServiceManagement and Employment Act 1988. ’.

(2) Section 56, first sentence— omit, insert— 56.(1) This section applies to the storage of no more than 250 kg of division 3 of class 7 explosives.’. ˙ Amendment of s 59 9.(1) Section 59, as heading— insert— Licence to sell explosives ’. (2) Section 59, first sentence— omit, insert— 59.(1) This section applies to a licence to sell explosives.’. (3) Section 59, last sentence— omit, insert— (6) When buying explosives from a licensee, a person must not— (a) state anything, relevant to the purchase, to the licensee that the person knows is false or misleading in a material particular; or (b) omit from a statement made, in relation to the purchase, to the licensee anything without which the statement is, to the person’s knowledge, misleading in a material particular.
s 10 6 s 12 Explosives Amendment (No. 1) No. 302, 1995 Maximum penalty—5 penalty units. (7) It is enough for a complaint against the person for an offence against subsection (6) to state that the statement was false or misleading to the person’s knowledge.’. ˙ Amendment of s 62 10.(1) Section 62, as heading— insert— Sale of division 3 of class 7 fireworks ’. (2) Section 62, first sentence— omit, insert— 62.(1) This section applies to the sale of division 3 of class 7 fireworks.’. ˙ Amendment of s 63 11.(1) Section 63, as heading— insert— Blasting explosives ’. (2) Section 63(2) and (3)— omit. ˙ Insertion of new s 63AA 12. After section 63— insert— ˙ Fireworks in public places 63AA. A person must not (without lawful excuse) throw, fire or possess fireworks in a public place. Maximum penalty—10 penalty units.’.
