187 Qllmisfanzk ANNO DUODECIMO ELIZABETHAE SECUNDAE REGINAE No. 33 of 1963 An Act to Amend " The Explosives Acts, 1952 to 1961," and "The Queensland Marine Acts, 1958 to 1963," each in certain particulars ASSENTED TO 13th DECEMBER, 1963] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELBUNARY 1. (1) Short title. This Act may be cited as "The Explosives Acts and Another Act Amendment Act of 1963." (2) Commencement of Act. This Act shall come into operation on a date to be fixed by the Governor in Council by Proclamation published in the Gazette.
188 Explosives Acts . and Another Act Amendment Act of 1963, No. 33 2. Parts of Act. This Act is divided into Parts as follows :- PART I-PRELIMINARY; PART II-AMENDMENTS OF "THE EXPLOSIVES ACTS, 1952 TO 1961"; PART III-AMENDMENTS OF "THE QUEENSLAND MARINE ACTS, 1958 TO 1963." PART II-AMENDMENTS OF "THE EXPLOSIVES ACTS, 1952 TO 1961" 3. (1) Construction of Part II. This Part II of this Act shall be read as one with "The Explosives Acts, 1952 to 1961." (2) Collective title . "The Explosives Acts, 1952 to 1961," and this Part II of this Act may be collectively cited as "The Explosives Acts, 1952 to 1963.". . 4. Amendment of s. 6 . Section six of "The Explosives Acts, 1952 to 1961," is amended by adding the following subsection:- "(5) Nothing in this Act applies to the storage and use of explosives in connection with the exploration for and production of petroleum under and subject to "The Petroleum Acts, 1923 to 1962," " 5. Amendment of s. 8 (1). Subsection (1) of section eight of "The Explosives Acts, 1952 to 1961," is amended by omitting the definition "Minister". and inserting in its stead the following definition:- "Minister"-The Minister for Health or other Minister of the Crown for the time being charged with the administration of this Act;". 6. Amendment of s. 10 .- Section ten of "The Explosives Acts, 1952 to 196 1," is amended by omitting subsection (2) and inserting in its stead the following subsection:- "(2) The Chief Inspector of Explosives shall, by virtue of holding that office and without further or other appointment, be the Officer in Charge of Government Magazines." 7. Amendment of s. 19 . Section nineteen of "The Explosives Acts, 1952 to 1961," is amended by omitting the words "and to the Officer in Charge of Government Magazines". 8. Amendment of s. 20 . Section twenty of "The Explosives Acts, 1952 to 1961," is amended by omitting the words "Chief Inspector and to the Officer in Charge of Government Magazines" and inserting in their stead the words "Chief Inspector of Explosives". 9. Amendment of s. 48 (1). Subsection (1) of section forty-eight of "The Explosives Acts, 1952 to 1961," is amended by, in subparagraph -viii) of the second paragraph thereof, omitting the words "in licensed magazines " and inserting, in their stead, the words "in Government magazines or licensed magazines (which fees or rents may differ in amount in respect of such classes of magazines respectively or in respect of any particular magazine included in either such class); the persons by whom and the manner in which and the time when payment of any fees or rents so prescribed is to be made;".

This Part III of this Act shall be read as one with "The Queensland Marine Acts, 1958 to 1963." (2) Collective title. "The Queensland Marine Acts, 1958 to 1963," and this Part III of this Act may be collectively cited as "The Queensland Marine Acts, 1958 to 1963." 11. Amendment of s. 229 . Section two hundred and twenty-nine of "The Queensland Marine Acts, 1958 to 1963," is amended by omitting subsection (4).
