Exotic Diseases in Animals (Equine Influenza) Amendment Notice (No. 1) 2008 [s 1] 1 Short title This notice may be cited as the Exotic Diseases in Animals (Equine Influenza) Amendment Notice (No. 1) 2008 . 2 Notice amended This notice amends the Exotic Diseases in Animals (Equine Influenza) Notice 2007. 3 Amendment of s 7 (Restricted movements—Act, s 10A) Section 7, after subsection (2)(d)— insert— ‘(3) Also, despite subsection (1), the movement of an animal of the family Equidae to or from, or within, a place in the restricted area is not a restricted movement for the restricted area if— (a) the movement is an on-hoof movement; and (b) the animal is moved only— (i) within the restricted area; and (ii) in daylight hours; and (c) the animal is returned to the place where it was located at the beginning of the day on which the movement happens. ‘(4) However, subsection (3) does not apply to the movement of an animal of the family Equidae to or from, or within, a place if the person who owns or is in control of the animal suspects, or ought reasonably to suspect, that— (a) the animal is infected with equine influenza; or (b) another animal of the family Equidae at the place is infected with equine influenza. ‘(5) In this section— on-hoof movement , of an animal of the family Equidae, means a movement of the animal by— Page 2 2008 SL No. 1
