s1 2 s5 Exotic Diseases in Animals Amendment (No. 1) No. 186, 1996 ˙ Short title 1. This regulation may be cited as the Exotic Diseases in Animals Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the Exotic Diseases in Animals Regulation 1981 . ˙ Omission of s 3 (Approval of forms) 3. Section 3— omit. ˙ Insertion of new s 4A 4. After section 4— insert— ˙ ‘ Animal product ‘ 4A. Animal blood is an animal product for the Act, section 5, definition “animal product”.’. ˙ Replacement of s 6 (Order to cleanse or disinfect) 5. Section 6— omit, insert— ˙ ‘ Order to cleanse or disinfect ‘ 6.(1) This section applies if an inspector gives an order under the Act— (a) to cleanse and disinfect a place, vehicle, vessel or other thing or a part of a person’s body; or (b) to disinfect animal product, animal pathogen or a biological preparation. ‘ (2) The inspector may give the order orally or in writing.
s6 3 s8 Exotic Diseases in Animals Amendment (No. 1) No. 186, 1996 ‘ (3) If the order is written, it must be in the approved form, describe what is to be cleansed or disinfected and state— (a) the way the cleansing and disinfection is to be done; and (b) the nature and concentration of the disinfectant to be used; and (c) where the cleansing and disinfection must take place; and (d) when the cleansing and disinfection must be finished.’. ˙ Replacement of s 8 (Places of entry or exit to or from a control zone) 6. Section 8— omit, insert— ˙ ‘ Entry to and exit from a control zone ‘ 8.(1) An inspector may order that a place be used as the entry to, or exit from, a control zone for an animal, animal carcass, animal product, animal pathogen or biological preparation. ‘ (2) The inspector may give the order orally or in writing. ‘ (3) If the order is written, it must describe the animal, animal carcass, animal product, animal pathogen or biological preparation to which it relates.’. ˙ Replacement of s 10 (Order to destroy by an inspector) 7. Section 10— omit, insert— ˙ ‘ Inspector’s order to destroy ‘ 10. If an inspector gives someone a written order to destroy something under the Act, the order must be in the approved form.’. ˙ Replacement of ss 12 and 13 8. Sections 12 and 13— omit, insert—
s9 4 s9 Exotic Diseases in Animals Amendment (No. 1) No. 186, 1996 ˙ ‘ Application for compensation ‘ 12. An application for compensation must be made by— (a) giving it to a government veterinary officer or an inspector; or (b) sending it to the chief executive by certified mail. ˙ ‘ Filing of notice of application in District Court registry ‘ 13. An application to a District Court for determination of the market value of an animal or property must be filed in the registry of the court within 60 days after the Minister gives the applicant written notice of a failure to agree about any of the following— (a) the market value of the animal or property; (b) the appointment of a valuer; (c) the amount fixed by a valuer as the value of the animal or property.’. ˙ Repeal 9. All subordinate legislation, other than the Exotic Diseases in Animals Regulation 1981 , made under the Act is repealed. ENDNOTES 1. Made by the Governor in Council on 4 July 1996. 2.
