EXHIBITED ANIMALS PROTECTION ACT 1986 - REGULATION

(Relating to the fee payable on an application being made by a local council for a licence to use premises

for an animal display establishment.)

HIS Excellency the Governor, with the advice of the Executive

Council, and in pursuance of the Exhibited Animals Protection Act 1986, has been pleased to make the Regulation set forth hereunder.

The Exhibited Animals Protection Regulation 1989 is amended:

(a)

by inserting in clause 14 (2) after the word “authority” the words “(other than an applicable authority referred to in subclause

(5) )”;

(b) by inserting after clause 14 (4) the following subclause:

(5) If the applicant for an applicable authority is the council of a city, municipality or shire and the application is made in respect of an animal display establishment for admission to which there is no charge, the application fee is:

(a)

if the application is for an applicable authority referred to in subclause (1) (a) or (b) - $500; or,

(b)

if the application is for an applicable authority referred to in subclause (1) (c) - nil.

EXPLANATORY NOTE

The object of this Regulation is:

(a) to require a local council to pay a fee of $500 when applying for a licence

for an animal display establishment that is run by the council and for

admission to which there is no charge; and

(b) to enable the council to renew the licence without payment of a fee.
