REGULATION

(Concerning the issue of exemptions relating to acquisition, disposal and

removal of animals)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Exhibited Animals Protection Act 1986, has been

pleased to make the Regulation set forth hereunder.

The Exhibited Animals Protection Regulation 1989 is amended:

(a) by inserting after clause 40 the following clause:
Exemption from requirements concerning acquisition,
disposal and removal of animals
40A. (1) The holder of an authority is exempt from the
requirements of clause 39 (c) and 40 (2) if the holder of the
authority :

has, to the satisfaction of the Director-General, completed an animal exhibitor’s accreditation course of a kind specified by the Director-General; and

holds a current certificate of exemption issued by the Director-General for the purposes of this subclause; and

complies with any conditions to which the certificate of exemption is subject.

(2) The Director-General may, by notice in writing, cancel a certificate of exemption issued under this clause if the person to whom the certificate is issued fails to comply with the requirements of the Act, this Regulation or the conditions to which the certificate is subject.

(b)

by inserting in clause 45 after the word “authority” where secondly occurring the words “or a certificate of exemption issued to the holder under clause 40A”.

EXPLANATORY NOTE

The object of this Regulation is to exempt certain holders of authorities under the Exhibited Animals Protection Act 1986 from the requirement that they obtain the consent of the Director-General of the Department of Agriculture before they acquire animals for exhibition, dispose of exhibited animals or remove animals from authorised premises.

The holders of authorities who are exempted from this requirement are persons who have satisfactorily completed an animal exhibitor’s accreditation course of a kind specified by the Director-General, hold a certificate of exemption issued by the Director-General and comply with any conditions to which the certificate of exemption is subject.

A certificate of exemption may be cancelled if the person to whom it is issued fails to comply with the requirements of the Exhibited Animals Protection Act 1986, the Exhibited Animals Protection Regulation 1989 or the conditions to which the certificate is subject. In addition, failure to comply with those conditions renders the holder of an authority to whom a certificate has been issued liable to a maximum penalty of $1,000.

This Regulation is made under the Exhibited Animals Protection Act 1986, including section 4 and section 53 (the general regulation making power).
