CIVIL AVIATION REGULATIONS

EXEMPTION

I, RONALD STANLEY COOPER, General Manager, Safety Regulation and Standards Division, Civil Aviation Authority, a delegate of the Civil Aviation Authority, under regulation 308 of the Civil Aviation Regulations, exempt the following aircraft:

(a)    Moyes “BMX Tug” aeroplane registered with the Australian Ultralight Federation Limited as number 10-1253;

(b)    Moyes “Dragonfly” aeroplane registered with the Australian Ultralight Federation Limited as number 10-1328;

from compliance with the following provisions of the Civil Aviation Regulations:

(c)    Parts III and IV;

(d)    Part 5;

(e)    regulations 92, 133, 134, 139, 155 and 157;

(f)    regulation 150 (but only in relation to the dropping of tow lines used in towing hang gliders);

(g)    regulation 163 (but only in relation to operations in proximity to aircraft to which section 95.8, 95.10, 95.32 or 95.55 of the Civil Aviation Orders applies);

(h)    Division 4 of Part XII;

(i)    regulations 207 and 228, subregulations 230 (2) and 242 (2) and regulation 258;

subject to the aircraft being operated in compliance with:

(j)    the conditions set out in the Schedule; and

(k)    the conditions set out in subsection 3A, subparagraphs 4.1 (a), (b), (d), (e), (f) and (g) and subsections 5, 6 and 7 of section 95.10 of the Civil Aviation Orders.

A word or phrase used in this instrument that is defined for the purposes of section 95.10 of the Civil Aviation Orders has the same meaning in this instrument as it does in the Order.

SCHEDULE

The aeroplane must not be used for any purpose except:

(a)   the personal carriage of the pilot; or

(b)   the aerial inspection of stock, fencing, or farm or pastoral equipment that is located on land owned by, or under the control of, the pilot or a member of the pilot’s immediate family; or

(c)   the towing of hang gliders.
