Excise Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Excise Act 1901.

Interpretation

1. Regulation 2 of the Excise Regulations is amended by omitting sub-regulation (1) and substituting the following sub-regulation:

“(1) In these Regulations, unless the contrary intention appears—

‘spirituous beverage’ means—

(a) vodka; or

(b) a spirituous beverage that is manufactured by mixing, compounding or blending spirit with ingredients other than caramel or water;

‘the Act’ means the Excise Act 1901.”.

2. Regulation 83a of the Excise Regulations is repealed and the following regulation substituted:

Interpretation

“83a. In this Division, ‘fortifying spirit’ has the same meaning as in Part VIa of the Distillation Act 1901.”.

Delivery of spirits

3. Regulation 84 of the Excise Regulations is amended by omitting “fresh grapes” and substituting “grapes, products of grapes or grapes and products of grapes”.

Repeal of regulation 85

4. Regulation 85 of the Excise Regulations is repealed.

Application for approval

5. Regulation 86 of the Excise Regulations is amended by omitting sub-regulation (2).

Authorized use of spirits

6. Regulation 92 of the Excise Regulations is amended by omitting sub-regulation (3).

Repeal of Part VII

7. Part VII of the Excise Regulations is repealed.

Heading to Part XX

8. The heading to Part XX of the Excise Regulations is omitted and the following heading substituted:

PART XX—SPIRITUOUS BEVERAGES.

Further Amendments of the Excise Regulations

9. The Excise Regulations are further amended as set out in the Schedule.

SCHEDULE Regulation 9

FURTHER AMENDMENTS OF THE EXCISE REGULATIONS

Regulations 224 to 232 (inclusive), 234a and 234b

Omit “liqueurs” (wherever occurring), substitute “spirituous beverages”.

Sub-regulation 234c (1)—

Omit “liqueurs”, substitute “spirituous beverages”.

Sub-regulation 234c (2)—

Omit “liqueurs”, substitute “spirituous beverages”.

Paragraph 234c (3) (a)—

Omit “liqueur”, substitute “spirituous beverage in the container”.

Paragraph 234c (3) (b)—

Omit “liqueur”, substitute “spirituous beverage”.

Paragraph 234c (3) (d)—

Omit “liqueur”, substitute “spirituous beverage in the container”.

Sub-regulations 234d (2) and (3)—

Omit “liqueur”, substitute “spirituous beverage”.

 

Sub-regulation 234d (4)—

(a) Omit “The manufacturer”, substitute “A manufacturer”.

(b) Omit “liqueur” (wherever occurring), substitute “spirituous beverage”.

(c) Omit “a label”, substitute “manufactured by him a label”.

Sub-regulation 234d (5)—

Omit “liqueur” (wherever occurring), substitute “spirituous beverage”.

Regulation 234f

Repeal the regulation.
