REGULATIONS UNDER THE EXCISE ACT 1901-1952.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Excise Act 1901-1952.

Amendments of the Excise Regulations.

1. Regulation 21 of the Excise Regulations is amended—

(a)by inserting after the words—

“Cigarette Paper;”

the word—

“Glycols;”; and

(b)by omitting the word “Saccharine” and inserting in its stead the word “Saccharin”.

2. Regulation 88 of the Excise Regulations is repealed.

3. Regulation 117 of the Excise Regulations is repealed and the following regulations are inserted in its stead:—

Application of Excise Tariff Item.

“117. The application of Excise Tariff Item 2 (q) to spirit for use in public hospitals is subject to the provisions of regulations 117a to 125 (inclusive) of these Regulations.

Spirit to be of certain Strength.

“ 117a. The spirit must be of a strength not loss than 65 degrees overproof as determined by Sikes’ hydrometer.”.

4. Regulation 119 of the Excise Regulations is amended by omitting the words “ and also furnish ” and inserting in their stead the words “and, if the Collector so requires, furnish”.

5. Regulation 121 of the Excise Regulations is repealed and the following regulation inserted in its stead:—

“Use of Spirit.

“121. Spirit delivered under these Regulations for use in a public hospital (except spirit delivered to a principal public hospital for distribution to other public hospitals) shall be used only in the hospital in the preparation of medicines, medicinal extracts, infusions, tinctures or the like, or for scientific purposes.”.

6. Regulation 125 of the Excise Regulations is repealed and the following regulation inserted in its stead:—

Quantity of Spirit that may be Delivered.

“125. Unless otherwise permitted by the Collector, the maximum quantity of spirit that may be delivered under these Regulations in a month to a public hospital, other than a principal public hospital, is a quantity sufficient for the normal monthly requirements of the hospital.”.

7. Regulation 125a of the Excise Regulations is repealed and the following regulation inserted in its stead:—

“Application of Excise Tariff Item.

“125a. The application of Excise Tariff Item 2 (q) to spirit for use in the manufacture of medicinal preparations for use in public hospitals is subject to the provisions of regulations 125b to 126 of these Regulations.”.

8. Regulation 125b of the Excise Regulations is amended by omitting the words “Australian rectified spirit or Australian absolute alcohol” and inserting in their stead the word “spirit”.

9. The heading appearing immediately before regulation 152 of the Excise Regulations is omitted and the following heading inserted in its stead:—

“SPIRIT FOR USE IN UNIVERSITIES, TECHNICAL COLLEGES AND OTHER EDUCATIONAL INSTITUTIONS.”.

10. Regulations 152 and 153 of the Excise Regulations are repealed and the following regulations inserted in their stead:—

“152. The application of Excise Tariff Item 2 (p) to spirit for use in universities for scientific or educational purposes is subject to the provisions of regulations 153 to 160a of these Regulations.

“153. The spirit must be of a strength not less than 65 degrees overproof as determined by Sikes’ hydrometer.”.

11. Regulation 154 of the Excise Regulations is repealed.

12. Regulations 155, 156 and 157 of the Excise Regulations are amended by omitting the words “absolute alcohol or white spirit” and inserting in their stead the word “spirit”.

13. Regulation 158 of the Excise Regulations is amended—

(a)by omitting the words “absolute alcohol and white spirit” (twice occurring) and inserting in their stead the word “spirit”; and

(b)by omitting the words “such alcohol and white spirit” and inserting in their stead the words “the spirit”.

14. Regulation 159 of the Excise Regulations is amended by omitting the words “absolute alcohol and white spirit” and inserting in their stead the word “spirit”.

15. Regulation 160 of the Excise Regulations is amended by omitting the words “absolute alcohol or white spirit” and inserting in their stead the word “spirit”.

16. After regulation 160 of the Excise Regulations the following regulation is inserted:—

“160a. For the purposes of regulations 152 to 160 (inclusive) of these Regulations, a reference to a university shall be doomed to include a reference to a technical college or other educational institution prescribed by Departmental By-laws for the purposes of Excise Tariff Item 2 (p).”.

17. Form 41 in the Schedule to the Excise Regulations is repealed and the following form inserted in its stead :—
