EVIDENCE (WITNESSES' AND INTERPRETERS' FEES AND EXPENSES) AMENDMENT REGULATIONS 1995

Made by the deputy of the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Evidence (Witnesses' and

Interpreters' Fees and Expenses) Amendment Regulations 1995.

Principal regulations

2.      In these regulations the Evidence (Witnesses' and Interpreters' Fees and

Expenses) Regulations 1976* are referred to as the principal regulations.

Regulation 2 amended

3.      Regulation 2 of the principal regulations is amended —

in the definition of "paying officer" by deleting "Under Secretary"

(a) and substituting the following

chief executive officer "; and

(b) by deleting the definition of "Under Secretary".

Regulation 4 amended

4.     Regulation 4 (2) of the principal regulations is amended by deleting

"wages or salary" and substituting the following —

income

Regulation 6 amended

5.     Regulation 6 (1) of the principal regulations is amended by deleting

"earnings" and substituting the following —

every kilometre over 50 kilometres that he is required to travel. "; and

income

Regulation 8 amended

6.     (1) Regulation 8 (1) of the principal regulations is repealed and the

following subregulation is substituted

fares incurred by him. (1) A witness or interpreter shall be paid any bus or rail

"or interpreter".	(2)	Regulation 8 (2) of the principal regulations is amended by deleting
after subregulation (2) the following subregulation	(3)	Regulation 8 of the principal regulations is amended by inserting

transport, he shall be paid at the rate prescribed in item 6 for (2a) If an interpreter does not travel by bus or rail

7.      Regulation 11 (2) of the principal regulations is repealed.

Schedule amended

8. (1) The Schedule to the principal regulations is amended in item 2 by

deleting "75.00'" and substituting the following —

5.       Interpreters' fees

During standard hours:

For the first 2 hours or part thereof	65.00
For each additional V2 hour or part thereof	15.00

During non-standard hours: 

For the first 2 hours or part thereof 104.00

For each additional V2 hour or part thereof 24.00

Standard hours are — 

0800-1800 on Mondays to Fridays

Non-standard hours are —

1800-0800 on Mondays to Fridays
Saturdays, Sundays and public holidays

6.       Rate per kilometre. . . 37.5 cents

7. Meals—

Breakfast	6.00
Lunch	6.00
Dinner	12.00

8.       Overnight accommodation (bed only)

Maximum per day 90.00
