1—Short title

These regulations may be cited as the Evidence (Reproduction of Documents) Regulations 1993.

2—Commencement

These regulations will come into operation four months after the day on which they are made (see Subordinate Legislation Act 1978 section 10AA).

3—Interpretation

In these regulations, unless the contrary intention appears—

the Act means the Evidence Act 1929;

document means a book, paper, map, plan, drawing, photograph or other written, graphical or pictorial matter.

4—Approved process

For the purposes of section 45C(5) of the Act, a process described in the Schedule is an approved process for the reproduction of documents.

Schedule—Approved process

(Regulation 4)

1The Document Imaging Claims Environment (DICE) system, operated by or on behalf of the Motor Accident Commission, consisting of—

(a)a process, commonly known as document imaging, by which—

(i)the image of a document is converted into digital data and recorded by a computer; and

(ii)the image may be reproduced from the recorded digital data; and

(b)the manual procedures associated with that process.

2The system referred to in clause 1 is approved on condition that the system is examined by Opticon-Australia Pty. Ltd. at intervals of not more than two years and a certificate is issued as soon as practicable after each examination certifying—

(a)that the electronic and optical processes involved in the system appear to be operating correctly; and

(b)that the system contains adequate safeguards against—

(i)interference with, or mishandling of, documents that are to be recorded; and

(ii)interference with, or contamination or degradation of, the stored data.
