EVIDENCE REGULATIONS 2012

Regulations under the Evidence Act 1939

1Citation

These Regulations may be cited as the Evidence Regulations 2012.

2Commencement

These Regulations commence:

  • (a)

    if these Regulations are notified in the Gazette before the commencement of the Evidence (National Uniform Legislation) Act 2012 – on the commencement of that Act; or

  • (b)

    otherwise – from the date these Regulations are notified in the Gazette.

3Prescribed qualifications for reporting scientist

For the definition reporting scientist in section 24 of the Act, each of the following is a prescribed qualification:

  • (a)

    a degree of Bachelor of Molecular Biology awarded by a university in Australia or New Zealand;

  • (b)

    a degree equivalent to a degree mentioned in paragraph (a);

  • (c)

    another science degree that, combined with at least 6 months experience as a forensic scientist at a laboratory, is equivalent to a degree mentioned in paragraph (a) or (b).

4Order for taking of evidence

For section 50(3)(a) of the Act, each of the following is an appropriate judicial authority:

  • (a)

    the Supreme Court of a State or another Territory;

  • (b)

    the District Court of New South Wales, Queensland or South Australia;

  • (c)

    the County Court of Victoria;

  • (d)

    the Local Court of New South Wales;

  • (e)

    the Magistrates Court of Queensland, South Australia or the Australian Capital Territory.

5Regulations repealed

The Regulations specified in the Schedule are repealed.
