Evidence (Prescribed Persons) Amendment

Regulations 2022

Made by the Governor in Executive Council.

1.   Citation

These regulations are the Evidence (Prescribed Persons)

Amendment Regulations 2022.

2.   Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Evidence (Prescribed Persons)

Regulations 2005.

4.             Regulation 3 inserted

After regulation 2 insert:

service provider with that corporate name established
by order under the Health Services Act 2016
section 32(1).

3.           Term used: PathWest Laboratory Medicine WA

In these regulations —

Path West Laboratory Medicine WA means the health

5.            Regulation 4 amended

(1)	Delete regulation 4(1).
(2)	In regulation 4(2) delete "section 5013(l)." and insert:
section 5013(1) of the Act.
Note: The heading to amended regulation 4 is to read:

Office prescribed (Act s. 50B authorised officer)

6.           Regulation 5 replaced

Delete regulation 5 and insert:

5.            Persons prescribed (Act s. 5013 forensic scientist)

The persons listed in the Table, employed in the
Forensic Biology Department of PathWest Laboratory
Medicine WA, are forensic scientists for the purposes
of the definition of that term in section 50(1) of the
Act.
