(TOOWOOM' BA) LAND SALE ACT OF [ASSENTED TO 26TH NOVEMBER, 1926. ] AMEN 19 D 1 M 2 ENT ACT OF 1926. W HEREAS certain persons being the surviving Preamble. Trustees of a certain piece of land, being sub- division one of suburban allotment eighteen of section nine, situated in the city of Toowoomba, parish of Drayton, county of Aubigny, being desirous of obtaining authority to sell the said land and apply the proceeds of such sale to certain purposes in connection with the Evangelical Lutheran Church, applied for and obtained authority so to do by an Act intituled "The Evangelical Lutheran Church (Toowoomba) Land Sale Act 0/ 1912,"* and, purporting to act under the authority conferred upon them by the said Act, by a conveyance dated the second day of April, one thousand nine hundred and thirteen, conveyed the said land to certain purchasers, which conveyance was on the eighth day of April, one thousand nine hundred and thirteen, duly registered and numbered ninety-seven, book seventy-five: And whereas by mistake the said land was in the said Act wrongly described as subdivision one of suburban allotment number nineteen of section nine aforesaid, and was in consequence also by mistake wrongly described in the said conveyance as subdivision one of suburban allotment nineteen of section nine aforesaid: And whereas it is necessary that the said Act and the said conveyance should respectively be amended by substitution therein of the correct description of the said land for the incorrect description thereof: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the * 3 Geo. v., supra, page 571'4.

Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. This Act may be cited as "The Evangelical Lutheran Church (Too'Woomba) Land Sale Act of 1912 Amendment Act ot 1926." Amendment 2. In "The Evangelical Lutheran Church (Too- of Act. woomba) Land Sale Act of 1912"* the words" subdivision one of suburban allotment number nineteen of section nine" are repealed and the words "subdivision one of suburban allotment eighteen of sec.tion nine" are inserted in lieu thereof. The amendment of the said last-mentioned Act hereby made shall be deemed to have been made therein on the date of the passing of the said Act-namely, the seventh day of December, one thousand nine hundred and twelve. Amendment 3. The instrument being the aforesaid conveyance ~ ! nveyance. dated the second day of April, one thousand nine hundred and thirteen, is hereby amended by the sub- stitution of the words and figures "subdivision 1 of suburban allotment 18 of section 9" for the words and figures "subdivision 1 of suburban allotment 19 of section 9" where those words twice occur in the said instrument. The said conveyance shall, as from the second day of April, one thousand nine hundred and thirteen, be read and construed as if the piece of land thereby conveyed were described therein as subdivision 1 of suburban allotment 18 of section 9, county of Aubigny, parish of Drayton, being the true description of the said land intended to be thereby conveyed. * 3 Geo. v., 8upra, page 5754.
