  1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Tate AP, Beach and McLeish JJA) dismissing an application for leave to appeal from a decision of the County Court of Victoria (Judge Tsalamandris) dismissing the applicant's application for leave to commence a proceeding at common law claiming damages under s 134AB(16)(b) of the Accident Compensation Act 1985 (Vic) in relation to alleged injuries suffered during the course of the applicant's employment with the respondent.

  2. There is no reason to doubt the correctness of the Court of Appeal's decision.  An appeal to this Court would enjoy no prospect of success.  Special leave should be refused.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
