The Agreement is a single enterprise agreement.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. CaseChat Overview and Summary

Estee Lauder T/A M.A.C Cosmetics applied to the Fair Work Commission for approval of the Estee Lauder National Retail Services & Online Sales Enterprise Agreement 2022. The application was made by Estee Lauder, trading as M.A.C Cosmetics, which is represented by the Retail and Fast Food Industries Union. The dispute concerns the terms and conditions of employment for employees covered by the proposed enterprise agreement.

The legal issues before the court were whether the proposed agreement was a "good faith" agreement and whether it complied with the statutory requirements of the Fair Work Act 2009. The court was required to consider whether the agreement met the requirements for approval under section 232 of the Act, including whether the agreement provided for the proper protection of employees' rights and interests, and whether it was made in good faith.

The court found that the agreement was made in good faith and met the statutory requirements for approval. The court noted that the agreement provided for fair and reasonable terms and conditions of employment, including provisions for minimum wages, leave entitlements, and dispute resolution mechanisms. The court also found that the agreement provided for the proper protection of employees' rights and interests, and that it complied with the relevant provisions of the Fair Work Act.

The court approved the Estee Lauder National Retail Services & Online Sales Enterprise Agreement 2022, subject to certain modifications. The modifications related to the calculation of penalty rates and the definition of "rostered day off". The court noted that these modifications were necessary to ensure that the agreement complied with the relevant provisions of the Fair Work Act.
