1Name of Proclamation

This Proclamation is the Essential Services Proclamation (No 2) 2022.

2Commencement

This Proclamation commences on the day on which it is published on the NSW legislation website.

3Definitions

In this Proclamation—

the Act means the Essential Services Act 1988.

Note—

The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Proclamation.

4Grounds for Proclamation

It appears to the Governor that the supply or distribution of coal is likely—

  • (a)

    to cease, or

  • (b)

    to be interrupted or reduced, or

  • (c)

    to be provided in a manner that does not, or is not likely to, meet the reasonable requirements of the community, or

  • (d)

    otherwise to be rendered insufficient for the reasonable requirements of the community.

5Declaration of essential service and specification of responsible Minister(1)

The supply or distribution of coal is declared to be an essential service in relation to which regulations may be made under the Act, section 9.

(2)

The Minister for Energy has responsibility for recommending the making, and for the administration and enforcement, of the regulations.

6Duration of Proclamation

This Proclamation continues in force for 30 days from the day on which it commences, unless sooner revoked.
