ESSENTIAL SERVICES ACT 1988—ORDER

DECLARING STATE OF EMERGENCY IN RELATION TO

PETROLEUM AND PETROLEUM PRODUCTS

NEW SOUTH WALES

WHEREAS it appears that:

(a) the production, supply and distribution of petroleum and petroleum products is likely to be rendered insufficient for the reasonable requirements of the community; and
(b) an emergency situation is likely to exist in relation to the production, supply and distribution of petroleum and petroleurn products:

Therefore, I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and

in pursuance of section 10 of the Essential Services Act 1988, do, by this

my Order, declare that a state of emergency exists in relation to the
production, supply and distribution of:

petroleum, that is to say, any hydrocarbons of mineral origin or any mixture of any such hydrocarbons (whether or not they contain elements other than hydrogen and carbon and whether or not they are mixed with any other substance) in a liquid form at ambient temperature and atmospheric pressure; and

petroleum products, that is to say, petrol, aviation fuel, heating oil, kerosene, lubricating oil, diesel fuel, liquefied petroleum gas and
any other energy resource (other than gas) that is a derivative of
petroleum obtained by distillation, catalytic cracking or other
refining process.

This Order applies to and has effect throughout the whole of the State

of New South Wales.

The Minister for Industrial Relations is, pursuant to section 10 (2) (b)
of the Essential Services Act 1988, the Minister who may give directions

under section 11 of that Act in relation to the above essential service.

This Order shall take effect from its making and shall (unless sooner

revoked) continue in force for the period of 30 days.
