An Act to authorize the Granting of Leases of certain Land in the City of Essendon permanently reserved as a Site for Public Recreation, and for other purposes.
Preamble
WHEREAS by an Order in Council of the 20th day of February, 1884[1], certain land at Essendon being the land described in the Schedule was permanently reserved as a site for public recreation:
AND WHEREAS by virtue of a Crown grant of the same day entered in the Register Book of the Office of Titles volume 1566 folium 313048 the said land is vested in the Minister of Lands and the corporation of the city of Essendon:
AND WHEREAS by virtue of an Order in Council of the 2nd day of November, 1921[2], the said corporation is the committee of management of the said land:
AND WHEREAS it is expedient to authorize the said corporation as committee of management of the said land to grant leases of the said land, and to make other provision as hereinafter enacted:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title
This Act may be cited as the Essendon (Recreation Ground) Land Act 1971.
2.Definitions
In this Act unless inconsistent with the context or subject-matter—
"corporation" means the corporation of the city of Essendon;
"reserve" means the land described in the Schedule.
3.Granting and conditions of leases
(1)Notwithstanding anything to the contrary in any Act, the corporation as committee of management of the reserve may from time to time grant leases of the reserve for the purposes of sport or recreation or social activities or purposes connected therewith including the erection of buildings.
(2)A lease under this section—
(a)shall be subject to such covenants conditions exceptions and reservations as the corporation thinks fit;
(b)shall be for a term not exceeding twenty-one years; and
(c)shall be subject to approval by the Governor in Council.
(3)The moneys received by way of rent under any lease granted under this section shall be applied by the corporation for such purposes (whether in relation to the reserve or not) as the Minister directs.
(4)No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this section.

Land in respect of which the corporation of the city of Essendon may grant leases for the purposes of sport or recreation or social activities or purposes connected therewith including the erection of buildings.
10 acres 2 roods 9 perches, being section 28, city of Essendon, parish of Doutta Galla, county of Bourke.
