ESPERANCE PORT AUTHORITY ACT 1968
ESPERANCE PORT AUTHORITY AMENDMENT REGULATIONS 1993
Made by the Esperance Port Authority and approved by His Excellency the
Governor in Executive Council.
Citation
1. These regulations may be cited as the Esperance Port Authority
Amendment Regulations 1993.
Commencement
2. These regulations shall come into operation on 1 September 1993.
Principal regulations
3. In these regulations the Esperance Port Authority Regulations 1969* are
referred to as the principal regulations.

Heading to Part IV amended
4. The heading to Part IV of the principal regulations is amended by
deleting "TONNAGE RATES" and substituting the following heading —
VESSEL CHARGES ".
Regulation 68 repealed and regulations 68 and 68A substituted
5. Regulation 68 of the principal regulations is repealed and the following
regulations are substituted —

Vessel charges and berthing dues
68. (1) Vessel charges shall be paid by all vessels using
4630 GOVERNMENT GAZETTE, WA [27 August 1993 (2) All vessels lying alongside wharves and trans-shipping cargo to or from lighters or other vessels shall be charged the same berthing dues in respect of that cargo as if the cargo had been landed on or taken off the wharves.
(3) Subject to subregulation (4) when computing berthing dues for cargo carrying vessels, the officer in charge shall have the option of proceeding on the basis of the tonne of 1 000 kilograms, or the cubic metre, or the kilolitre, and the fractions of these units shall be charged on a pro rata basis.
(4) Notwithstanding subregulation (3) the officer in charge shall compute berthing dues for the animals specified in this subregulation in accordance with the following —
(a)
one bullock, cow, steer, heifer or similar animal
one tonne;
(b) 3 calves or foals one tonne;
(c)
15 sheep, pigs, goats or similar animals
one tonne.
(5)
A vessel shall be charged at the rate of $1.00 for each
tonne/kilolitre of cargo loaded or discharged with a minimum
charge of $100.00 per vessel.
(6) A vessel which occupies a berth but does not load or
discharge cargo shall pay —
(a) $1 300.00 for the first day or part thereof; and
(b)
$650.00 for every following 12 hour period or part thereof.
Berthage dues — Taylor Street Jetty
68A. (1) Vessels using the Taylor Street Jetty shall pay —
(a)
for a Licensed Fishing Vessel where the overall length of the vessel inclusive of any overhang —

does not exceed 6 metres 350 exceeds 6 metres but does not exceed 10 metres 405
exceeds 10 metres but does not
exceed 20 metres 545
exceeds 20 metres but does not
exceed 30 metres 720 exceeds 30 metres 900; and
(b) for a vessel licensed to carry passengers 300. (2) The berthage dues referred to in subregulation (1) are payable for a period of 12 months ending 31 December in each year but where the use of a vessel commences after 30 June in any year, one half of the prescribed dues are payable.

(3) A vessel, other than a vessel referred to in subreg -ulation (1), moored alongside any part of the Taylor Street Jetty, other than the Northern Berth face shall pay —
(a) a fee of $10.00 per day or part thereof; or (b) at a rate of $55.00 per month or part thereof.
Regulation 73 amended
6. Regulation 73 (3) of the principal regulations is amended by deleting
paragraph (a).
Second Schedule amended
7. The Second Schedule to the principal regulations is amended —
(a) by repealing Part 1 and substituting the following Part — it

The rates of wharfage dues on cargo (whether inward cargo or outward cargo) shall be as follows —
