GUMMOW J:   This application for special leave to appeal from a decision of the Full Court of the Federal Court of Australia was heard in Sydney on 31 July 2009 by a Court comprising Justices Hayne, Heydon and myself.  The Court made an order refusing special leave with costs.  On 9 December 2009, the parties filed a consent to the making of an order in the following terms:

The order made by the Court on 31 July 2009 directing the applicants bear the cost of the special leave application in this proceeding be set aside. 

The Court makes an order in those terms.
