enacted by H i s Excel lency t h e Governor of New South W a l e s w i t h

t he advice of t h e Legis la t ive Counci l thereof Tha t t he said first reci ted Act of H i s said la te Majesty shal l be a n d t h e same is hereby cont inued in force except as to so m u c h thereof as relates to t he t ime of pass ing and execut ion of any sentence of death as the re in is men t ioned from

a n d after t h e said thir ty-f i rs t day of A u g u s t one t housand e ight
hundred and forty-two un t i l t he thir ty-f i rs t day of A u g u s t one thou­
sand eight h u n d r e d and forty-four.
2. Prov ided a lways and be it enacted T h a t n o t h i n g in the said

first reci ted Act or in th i s Act contained shall be deemed to author ize any Jus t i ce of t he Peace to cause any person to be removed to Sydney to be examined unless such person shall have been apprehended wi th in t he Police Distr ic t of Sydney or informat ion shall have been given on oa th by some credible witness before such Jus t i ce tha t there is s t rong g round for suspect ing such person to be a t ranspor ted felon or offender
