Application for Orders Relating to Instruments Covering New Employer and Non-Transferring Employees

[1] An application was made under section 319 of the Fair Work Act 2009 (the Act). The application was made by EP6 Management Pty Ltd T/A Citigate Melbourne (EP6 Management).

[2] The application outlined that EP6 Management had entered into an agreement with Citigate Melbourne Pty Ltd for the sale of Citigate Melbourne, a hotel in Melbourne. A term of the contract of sale is that all current employees be offered ongoing employment at the Citigate Melbourne with continuous recognised service and preserved benefits.

[3] The matter was listed for E-Hearing before Fair Work Australia on 9 December 2011.

[4] I have reviewed the application and the accompanying material including the agreement. I am satisfied that the provisions of paragraphs (a) to (g) of subsection 319 (3) of the Act have been met. Consequently the application is granted and the Order [AE873408] in the terms sought will be issued accordingly.
