This regulation may be cited as the Environmental Protection (Waste Management) Amendment Regulation (No. 1) 2000 . ˙ Regulation amended 2. This regulation amends the EnvironmentalProtection(WasteManagement) Regulation 2000 . ˙ Amendment of s 11 (Definition for pt 3) 3. Section 11, from ‘, mentioned in’ to ‘schedule 1,’— omit . ˙ Amendment of s 51 (Clinical waste to be removed within 7 days) 4. Section 51— insert— ‘ (5) This section does not apply to clinical waste generated within a scheduled area. (6) In this section— “clinical waste” does not include discarded sharps.’. ˙ Insertion of new pt 7, div 1, hdg 5. Part 7— insert — ‘ Division 1—Other offences ’. ˙ Insertion of new pt 7, div 2 6. The administration and enforcement of part 3, to the extent it relates to a waste facility owned, operated or otherwise controlled by a local government, is devolved to that local government. ˙ ‘ Devolution—non–complying waste equipment ‘ 68B.(1) The administration and enforcement of section 67(2) in relation to a person mentioned in section 67(1)(b) is devolved to the relevant local government for the land on which the waste management works are performed. ‘ (2) However, the administration and enforcement of the section is not devolved if the person is also a person mentioned in section 67(1)(a).’. ˙ Amendment of sch 9 (Dictionary) 7.
