Environmental Protection Regulations Amendment (Prohibited Plastics and Balloons) Regulations 2024

Made by the Governor in Executive Council.

Part 1Preliminary1.Citation

These regulations are the Environmental Protection Regulations Amendment (Prohibited Plastics and Balloons) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    Part 1 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on 1 June 2024.

Part 2Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018 amended3.Regulations amended

This Part amends the Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018.

4.Part 4A inserted

After regulation 18 insert:

Part 4A — Offence relating to prescribed plastic film signage

18A. Offence to use prescribed plastic film signage outdoors for promotional or advertising purposes

  • (1)

    In this regulation —

prescribed plastic film signage means a disposable plastic item that is —

  • (a)

    a banner, placard, sign, bunting or similar thing; and

  • (b)

    made wholly or partly from soft plastic;

soft plastic —

  • (a)

    means plastic that is not rigid; but

  • (b)

    does not include the following —

  • (i)

    nylon;

  • (ii)

    polyester fabric;

  • (iii)

    woven mesh;

  • (iv)

    plasticised canvas.

  • (2)

    A person must not use, or authorise another person to use, prescribed plastic film signage outdoors for promotional or advertising purposes.

Penalty for this subregulation: a fine of $5 000.

Part 3Environmental Protection Regulations 1987 amended5.Regulations amended

This Part amends the Environmental Protection Regulations 1987.

6.Schedule 6 amended

In Schedule 6 under the heading “Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018” after item 13 insert:
