s1 3 s5 Environmental Protection Policies Amendment Policy No. 208, 2004 (No. 1) 2004 Part 1 Preliminary 1 Short title This policy may be cited as the Environmental Protection Policies Amendment Policy (No. 1) 2004 . 2 Commencement This policy commences on 4 October 2004. Part 2 Amendment of Environmental Protection (Air) Policy 1997 3 Policy amended in pt 2 This part amends the Environmental Protection (Air) Policy 1997. 4 Amendment of s 10 (Application) (1) Section 10(a)(iii)— renumber as section 10(a)(iv). (2) Section 10(a)(ii)— omit, insert — ‘(ii) a development approval; or (iii) the amendment of an environmental authority or development approval; or’. 5 Amendment of s 13 (Air pollution dispersion modelling and monitoring of releases) Section 13(5)(a)— omit, insert —
s6 4 s8 Environmental Protection Policies Amendment Policy No. 208, 2004 (No. 1) 2004 ‘(a) whether monitoring is needed to assess compliance with any of the following, as applicable— (i) development conditions of the applicant’s development approval; (ii) the applicant’s environmental authority; (iii) the applicant’s environmental management program; (aa) if monitoring is needed—the frequency of the monitoring;’. 6 Amendment of s 14 (Definition for div 1) Section 14, definition unreasonable release , paragraph (a), example— omit, insert — ‘Example for paragraph (a) — A development approval has been issued for an activity. The release of contaminants to the air environment from the activity causes environmental nuisance. If the activity was carried out in contravention of the development conditions of the development approval, and the activity is not authorised in another way stated in section 436 of the Act, the release of the contaminant would cause unlawful environmental harm.’. 7 Amendment of s 22 (Permitted concentration of lead in leaded petrol for use in vehicles) Section 22(3), ‘an environmental authority’— omit, insert — ‘a registration certificate for the activity’. 8 Amendment of s 23 (Permitted concentration of lead or sulfur in liquid fuel for use in stationary fuel burning equipment) (1) Section 23(2), from ‘under’— omit, insert —

(2) Section 23(3)(a), from ‘under’ to ‘direction’— omit, insert — ‘under a relevant authority’. (2) Section 12(a)(ii)— omit, insert —

(2) Section 17(1), after ‘authority’— insert — ‘or development approval’. 13 Amendment of s 27 (Explanation) Section 27(2)(a) and (b)— omit, insert — ‘(a) to decide an application for any of the following— (i) an environmental authority; (ii) a development approval; (iii) approval of a draft environmental management program; or (b) to monitor compliance with any of the following— (i) a condition of an environmental authority; (ii) a development condition of a development approval; (iii) a standard environmental condition of a code of environmental compliance for a chapter 4 activity; (iv) an environmental management program; or’.
s 14 8 s 17 Environmental Protection Policies Amendment Policy No. 208, 2004 (No. 1) 2004 Part 4 Amendment Of Environmental Protection (Waste Management) Policy 2000 14 Policy amended in pt 4 This part amends the Environmental Protection (Waste Management) Policy 2000. 15 Amendment of s 8 (Introduction) Section 8(2)(b), from ‘as’— omit, insert — ‘as— (i) a development condition of a development approval; or (ii) a condition of an environmental authority; and’. 16 Amendment of s 14 (Decisions to which this part applies) (1) Section 14(1)(a) and (b)— omit, insert — ‘(a) whether to grant or refuse an application for a development approval or an environmental authority; or (b) what should be the development conditions of a development approval or the conditions of an environmental authority; or’. (2) Section 14(2)— omit . 17 Amendment of s 18 (Definitions for pt 5) Section 18, definitions “authorised activity” and “holder”— omit, insert — ‘ authorised activity —

s 26 12 s 27 Environmental Protection Policies Amendment Policy No. 208, 2004 (No. 1) 2004 26 Amendment of s 49 (Review of policy) (1) Section 49(2)(b), after ‘number of’— insert — ‘registered operators and’. (2) Section 49(2)(c)— omit, insert — ‘(c) the increase in the number of registered operators and holders of environmental authorities who are complying with the relevant conditions and have improved the quality of waste water releases;’. (3) Section 49— insert — ‘(3) In this section— relevant conditions means— (a) for a registered operator for an activity— (i) the development conditions of a development approval for the activity; or (ii) the standard environmental conditions of a code of environmental compliance for the activity; or (b) for the holder of an environmental authority—the conditions of the authority.’. 27 Amendment of sch 2 (Dictionary) (1) Schedule 2, definition environmental management decision , after ‘environmental authority,’— insert — ‘development approval,’.
