Environmental Protection Legislation Amendment Regulation (No. 3) 2008 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the Environmental Protection Legislation Amendment Regulation (No. 3) 2008 . Part 2 Amendment of Environmental Protection Regulation 1998 2 Regulation amended in pt 2 This part amends the EnvironmentalProtectionRegulation 1998. 3 Amendment of sch 1A (Prescribed criteria for section 151 of the Act) (1) Schedule 1A, part 1, section 1(a)(v) to (vii)— renumber as section 1(a)(vi) to (viii). (2) Schedule 1A, part 1, section 1(a)— insert— ‘(v) a national park (Cape York Peninsula Aboriginal land);’. Page 2 2008 SL No. 216

(2) Section 25(1)— insert— ‘(i) for an application for a relevant authority for a national park (Cape York Peninsula Aboriginal land)—the indigenous management agreement for the protected area;’. 6 ‘31A Insertion of new s 31A After section 31— insert— Restriction on granting relevant authority for national park (Cape York Peninsula Aboriginal land) ‘The chief executive can not grant a relevant authority to a person for a national park (Cape York Peninsula Aboriginal land) without the written consent of the land trust for the protected area if, under the indigenous management agreement for the area, the consent of the land trust is required for the grant of the authority.’. 2008 SL No. 216 Page 3
