s1 4 s5 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 Part 1 Preliminary 1 Short title This regulation may be cited as the Environmental Protection Legislation Amendment Regulation (No. 1) 2004 . 2 Commencement This regulation commences on 4 October 2004. Part 2 Amendment of Environmental Protection Regulation 1998 3 Regulation amended in pt 2 This part amends the EnvironmentalProtectionRegulation1998. 4 Amendment of s 6F (General definition) (1) Section 6F— insert ‘(ea) a standard environmental condition of a code of environmental compliance for a chapter 4 activity;’. (2) Section 6F(ea) and (f)— renumber as section 6F(f) and (g). 5 Amendment of s 6R (Restrictions) Section 6R(b), from ‘under’— omit, insert ‘under—

s 10 6 s 10 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 ‘Subdivision 1 Preliminary’. 10 Replacement of ss 44 and 44A Sections 44 and 44A— omit, insert ‘44 Definitions for div 3 ‘In this division— anniversary changeover application , for a registration certificate or environmental authority, means an application under section 318A 1 of the Act to change the anniversary day for the registration certificate or environmental authority. interim year see section 318B(1)(a) 2 of the Act. prescribed authority means any of the following— (a) a registration certificate; (b) an environmental authority; (c) a development approval; (d) an integrated authority. transfer application means a transfer application under chapter 4A, part 4, division 2 or chapter 5, part 9, 3 of the Act. ‘Subdivision 2 Fees for prescribed authorities ‘44A Fees for prescribed authorities ‘(1) The following fees are prescribed for prescribed authorities— (a) for a registration certificate, each of the following— (i) the fees stated in schedule 6, part 1, division 1; 1 Section 318A (Changing anniversary day) of the Act 2 Section 318B (Special provisions for changeover in anniversary day) of the Act 3 Chapter 4A (Environmental authorities for petroleum activities), part 4 (Dealings with environmental authorities), division 2 (Transfers) or chapter 5 (Environmental authorities for mining activities), part 9 (Transfer of authorities) of the Act
s 10 7 s 10 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 (ii) the fee under section 44AA for an anniversary changeover application; (iii) the fee under section 51A for late payment of an annual fee; (b) for a development approval for a chapter 4 activity—the fees stated in schedule 6, part 1, division 2; (c) for an environmental authority for petroleum activities, each of the following— (i) the fees stated in schedule 6, part 1A; (ii) the fee under section 44B for a transfer application; (iii) the fee under section 44C for an anniversary changeover application; (iv) the fee under section 51A for late payment of an annual fee; (d) for an environmental authority (mining activities), each of the following— (i) the fees stated in schedule 6, part 2; (ii) the fee under section 44B for a transfer application; (iii) the fee under section 44C for an anniversary changeover application; (iv) the fee under section 51A for late payment of an annual fee; (e) for an integrated authority, each of the following— (i) the fees stated in schedule 6, part 2A; (ii) the fee under section 48A for adding a new constituent part to the integrated authority; (iii) the fee under section 51A for late payment of an annual fee. ‘(2) However, subsection (1)(a) or (b) does not apply if— (a) the registration certificate or development approval relates to a devolved activity; and
s 11 8 s 11 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 (b) the local government to which the fee for the registration certificate or development approval is payable has made a resolution or local law prescribing a lower fee. ‘(3) If subsection (1)(a) or (b) does not apply, the fee payable for the registration certificate or development approval is the fee prescribed by the resolution or local law.’. 11 Insertion of new pt 4, div 3, sdivs 2A and 2B After section 44A, as inserted by this regulation— insert ‘Subdivision 2A Additional fee provisions for registration certificates ‘44AA Fee for anniversary changeover application ‘The fee payable for an anniversary changeover application for a registration certificate must be worked out using the following formula— A = 150 + ⎛⎝ - 3 -- B - 6 --- 5 - × D ⎞⎠ where— A is the amount of the fee for the anniversary changeover application. B is the prescribed annual fee amount for a registration certificate for the chapter 4 activities to which the application relates. D is the number of days in the interim year. ‘44AB Application fee not payable if prior application for development approval made ‘(1) This section applies if—
s 12 9 s 12 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 (a) before starting to carry out a chapter 4 activity, a person applies for a development approval for development for the activity; and (b) the person applies for a registration certificate for the activity— (i) before the development application is approved; or (ii) within 10 business days after the development application is approved. ‘(2) The application fee provided for under this regulation for the registration certificate is not payable. ‘44AC Refund of annual fee component of application fee ‘(1) This section applies if— (a) an administering authority refuses an application for a registration certificate for 1 or more chapter 4 activities, other than continuing chapter 4 activities; and (b) no registration certificate is granted for any of the activities. ‘(2) The administering authority must refund to the applicant the annual fee component of the application fee paid by the applicant. ‘Subdivision 2B Additional fee provisions for environmental authorities’. 12 Amendment of s 44C (Fee for anniversary changeover applications) Section 44C(2)— omit .

(2) Section 49(2)(a), ‘environmental authority application’— omit, insert ‘application for the relevant authority’. (3) Section 49(2)(b), from ‘when’— omit, insert ‘within the time for payment of the fee stated in an annual notice given to the person under section 316 of the Act.’. (4) Section 49(3)— omit, insert ‘(3) If a waiver application is made for an application fee, the annual fee component of the application fee is not required to accompany the application for the relevant authority.’. (5) Section 49(4), ‘316(2)(a)’— omit, insert— ‘316(3)(b)’. 18 Amendment of s 50 (Criteria for deciding waiver application) (1) Section 50(3)(a), ‘environmental or integrated’— omit, insert ‘relevant’. s 19 12 s 19 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 omit, insert ‘(4) Also, the administering authority may waive payment of an amount of a fee only if— (a) the administering authority is satisfied the activity is being, or will be, carried out in a way that complies with— (i) if the relevant authority is a registration certificate—the development conditions of the development approval for the activity or the standard environmental conditions of the code of environmental compliance for the activity; or (ii) if the relevant authority is an environmental or integrated authority—the authority; and (b) for waiving payment, under subsection (1)(c) or (d), of an annual fee for a registration certificate—the applicant has started to carry out the activity when the application is made.’. s 32 20 s 32 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 anniversary changeover application , for part 4, division 3, see section 44. continuing chapter 4 activity means a chapter 4 activity— (a) that is carried out by a registered operator who proposes to dispose of the operator’s business to someone else (the proposed buyer ); and (b) for which the proposed buyer applies for a registration certificate. interim year for part 4, division 3, see section 44. licensed vehicle , for transporting regulated waste, means a vehicle authorised to be used for transporting the waste under the required authority. prescribed annual fee amount (a) for a registration certificate or development application, means— (i) if the certificate or application includes not more than 1 chapter 4 activity—the amount stated in schedule 1 opposite the activity; or (ii) otherwise—an amount equal to the higher or highest of the amounts stated in schedule 1 opposite the chapter 4 activities included in the certificate or application; or (b) for an integrated authority, means an amount equal to the higher or highest annual fee for the environmental authorities that are constituent parts of the integrated authority. prescribed authorit y for part 4, division 3, see section 44. relevant authority , for part 4, division 3, subdivision 4, see section 48C. required authority , for an environmentally relevant activity, means any of the following required under the Act for the activity— (a) for a chapter 4 activity— (i) a registration certificate; and

Part 3 Amendment of Environmental Protection (Interim Waste) Regulation 1996 33 Regulation amended in pt 3 This part amends the EnvironmentalProtection(InterimWaste) Regulation 1996 . 34 Amendment of s 3 (Definitions) (1) Section 3— insert required authority , for an environmentally relevant activity, means any of the following required under the Act for the activity— (a) for a chapter 4 activity— (i) a registration certificate; and (ii) if the activity is not subject to a code of environmental compliance—a development approval;

(3) Section 3, definitions regulated waste treatment and storage facility , waste disposal facility , waste recycling and reprocessing facility and waste transfer station , from ‘a licence’— omit, insert— ‘, or is acting under, the required authority.’. (4) Section 3, definition waste incineration facility , from ‘an approval’— omit, insert— ‘, or is acting under, the required authority.’. 35 Amendment of s 6 (Requirements for waste containers etc.) Section 6(5), ‘owner, occupier or licensee of’— omit, insert ‘owner or occupier of, or the registered operator or environmental authority holder in relation to,’. Part 4 Amendment of Environmental Protection (Waste Management) Regulation 2000 36 Regulation amended in pt 4 This part amends the EnvironmentalProtection(WasteManagement) Regulation 2000 .
s 37 23 s 39 Environmental Protection Legislation Amendment No. 209, 2004 Regulation (No. 1) 2004 37 Amendment of s 12 (Unlawful disposal of waste at waste facility) Section 12(2)(a)— omit, insert ‘(a) the person who— (i) is the registered operator for the facility; or (ii) holds an environmental authority for the facility; or’. 38 Amendment of s 13 (Restrictions on burning waste at waste facility) (1) Section 13— insert ‘(ab) under a development condition of a development approval; or (ac) under a standard environmental condition of a code of environmental compliance for a chapter 4 activity; or’. (2) Section 13(ab) to (b)— renumber as section 13(b) to (d). 39 Amendment of s 38 (Consignment numbers for waste transported into Queensland) Section 38(4)— omit, insert ‘(4) The administering executive must grant the application if the executive is satisfied— (a) the intended transporter holds, or is acting under, the required authority for transporting the waste to the intended receiver; and (b) the intended receiver holds, or is acting under, the required authority for carrying out the intended treatment.’.
