s1 4 Environmental Protection and Another Act Amendment Act 2002 The Parliament of Queensland enacts— s3 No. 10, 2002 PART 1—PRELIMINARY 1 Short title This Act may be cited as the Environmental Protection and Another Act Amendment Act 2002 . PART 2—AMENDMENT OF ENVIRONMENTAL PROTECTION ACT 1994 2 Act amended in pt 2 This part amends the Environmental Protection Act 1994. 3 Amendment of s 75 (Development for Integrated Planning Act, sch 8, pt 1, item 6) (1) Section 75(1), after ‘mining activity’— insert — ‘or petroleum activity’. (2) Section 75(2)— insert — ‘ “petroleum activity” means an environmentally relevant activity that is carried out— (a) on land the subject of any of the following authorities granted or issued under the Petroleum Act 1923 — (i) a prospecting petroleum permit; (ii) an authority to prospect;

s4 5 s5 Environmental Protection and Another Act Amendment Act 2002 No. 10, 2002 (iii) a petroleum lease; (iv) a pipeline licence; and (b) for the purpose of the authority.’. 4 Amendment of s 76 (Additional material change of use for Integrated Planning Act) Section 76(4), after ‘activities)’— insert — ‘or an environmental authority for a petroleum activity as defined in section 75’. 5 Insertion of new ch 13, pt 3 After section 616— insert — ‘PART 3—VALIDATION PROVISION FOR ENVIRONMENTAL PROTECTION AND ANOTHER ACT AMENDMENT ACT 2002 ‘617 Validation of particular environmental authorities ‘ (1) This section applies to an environmental authority issued or purporting to have been issued— (a) on or after 1 July 1998 and before the commencement of this section; and (b) for— (i) a mining activity as defined in this Act when the authority was issued or purported to have been issued; or (ii) a petroleum activity as defined in section 75. ‘ (2) The environmental authority is taken to be, and to always have been, valid.’.
