ENVIRONMENTAL PROTECTION AMENDMENT REGULATIONS
(No. 5) 1996

Made by His Excellency the Governor in Executive Council on the recommendation of the Environmental Protection Authority.

Citation

1. These regulations may be cited as the Environmental Protection

Amendment Regulations (No. 5) 1996.

Commencement

2. These regulations come into operation on the day fixed under section 2 of

the Planning Legislation Amendment Act 1996.

Regulation 2C inserted

3. After regulation 2B of the Environmental Protection Regulations 1987*,

By His Excellency's Command, J. PRITCHARD, Clerk of the Council.

the following regulation is inserted —

Proposals of prescribed class

2C. For the purposes of section 38 (1) and (3) of the principal Act, a

proposal which involves a significant

(a) discharge of waste; or
(b) emission of noise, odour or electromagnetic radiation,

into the environment is a proposal of a prescribed class.
