I, the Minister for Planning, in pursuance of sections 115U (4) and 115V of the Environmental

Planning and Assessment Act 1979, make the following Order.

Explanatory note
The object of this Order is to declare development for the purposes of The Northern Road Upgrade project
to be State significant infrastructure and critical State significant infrastructure.
The project is the upgrading, widening and realignment of The Northern Road between Mersey Road,
Bringelly and Glenmore Parkway, Glenmore Park and ancillary development.
This Order is made under sections 115U (4) and 115V of the Environmental Planning and Assessment Act
1979.

1      Name of Order

This Order is the Environmental Planning and Assessment Amendment (The
Northern Road Upgrade) Order 2017.

2      Commencement

This Order commences on the day on which it is published on the NSW legislation website.

Schedule 5 Critical State significant infrastructure

Insert after clause 5:

6      The Northern Road Upgrade project

(1)  Development for the purposes of The Northern Road Upgrade project, being:

(a)

the upgrading, widening and realignment of The Northern Road between Mersey Road, Bringelly and Glenmore Parkway, Glenmore Park, to be carried out on land in the local government areas of the City of Liverpool and the City of Penrith, and

(b)

ancillary development, including construction compounds, utilities infrastructure (including adjustments to, or relocation of, existing utilities infrastructure), signage, emergency systems and systems for the control and management of roads.

(2) In this clause:
development does not include surveys, test drilling, test excavations,
geotechnical investigations or other tests, surveys, sampling or investigation
for the purposes of the design or assessment of the project.
