Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Environmental Planning and Assessment Act 1979.

Explanatory note
The Sydney International FIFA Fan Fest is to be held at Darling Harbour during the 2010 FIFA World Cup from 11 June 2010 until 12 July 2010. It is a free event that is to include live broadcasts on one or more giant screens of the 2010 FIFA World Cup final matches and associated screen based and stage based entertainment.
The object of this Regulation is to facilitate preparations for the Fan Fest by excluding development for the purpose of that event from being development or an activity within the meaning of the Environmental Planning and Assessment Act 1979.
The Major Events Regulation 2010 has declared the Fan Fest to be a major event for the purposes of the Major Events Act 2009 for the period commencing 1 June 2010 until 20 July 2010.

This Regulation is made under the Environmental Planning and Assessment Act 1979, including the definition of development in section 4 (1), paragraph (k) of the definition of activity in section 110 (1) and section 157 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Environmental Planning and Assessment
Amendment (Sydney International FIFA Fan Fest) Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Environmental Planning and Assessment Regulation 2000

Insert after clause 288:

288A

Special provision relating to Sydney International FIFA Fan
Fest

(1)	Development for the purposes of the Sydney International FIFA Fan Fest during the period from 1 June 2010 to 20 July 2010 is not development for the purposes of the definition of development in section 4 (1) of the Act.
(2)	Development for the purposes of the Sydney International FIFA Fan Fest during the period from 1 June 2010 to 20 July 2010 is not an activity for the purposes of paragraph (k) of the definition of activity in section 110 (1) of the Act.
(3)	In this clause, Sydney International FIFA Fan Fest means the event described in Part 2 of the Major Events Regulation 2010.
